Re: Renewal of Pond Conditional Use Permit
Dear Mr. Dougan:
When we talked a few weeks ago I promised to send you information regarding the possibility of
renewing your CUP for constructing a pond near the west end of your property. Enclosed is the
current CUP application form package for your use should you wish to proceed.
In the 10 years since your CUP was originally approved a number of regulation changes have taken
place which may affect your application. The primary change of concern is that the Wetlands
Conservation Act(WCA) may require that you hire a professional wetland delineator to determine
whether any of the low area you will be excavating is protected wetland. You should contact the
Minnehaha Creek Watershed District (471-0590), as they are the administrators of the WCA for
Orono, and they will advise you what information is needed for their permit process.
Orono is currently in the process of completing a comprehensive Surface Water Management Plan.
Since your ponding area may impact or be impacted by that plan, if you do apply for renewal the
City Engineer may have specific recommendations regarding pond design or location.
