Box 66 -- Orono, MN 55356 Crystal Bay, MN 55323-0066 September 15, 1999 John Mayer Mayer Distributing 2105 Daniels Street HAND DELIVERED Long Lake, MN 55356 Re: Proposed Zoning Amendment Dear Mr. Mayer: Per Council's direction at Monday night's meeting, your appropriate method for pursuing a zoning amendment to add "petroleum bulk storage and distribution" as an allowable use in the'I' Industrial District, is through a formal zoning amendment application process. Such an amendment can only be initiated by 1)the Planning Commission; 2) the City Council; or 3) petition of the owner of the property which is under consideration for zoning amendment. Therefore, you must have the owner of the VCI property be the applicant(or at minimum as a co- applicant with you) for such amendment(see Zoning Code Section 10.10 Subd. 2, attached). Any amendment to the zoning district list of allowed uses cannot be site specific, but must encompass the entire Orono industrial zone,which runs from Old Crystal Bay Road to the east line of Washington Scientific's property (the boundary between Orono and Long Lake), from Highway 12 to the Burlington Northern right-of-way, or about 44 acres. The required submittals for the initial rezoning request application will include as a minimum: 1. Completed application form (attached). 2. $350.00 non-refundable application fee. 3. Certified list of all property owners within the "I" Industrial District and within 350' of the boundaries of said District. 4. A detailed description of your request, which should as a minimum address the following topics: a. Detailed description of proposed use, including description of typical/intended site facilities as well as a detailed description of the site operation. Potential impacts on neighboring and nearby properties/uses, such as visual impacts, noise, vibration, odors, lights, and hours of typical operation. d. Environmental protection, site operation controls, etc. e. Other topics which may be identified by staff,Planning Commission, or City Council during the review process(see the attached application requirement package) The zoning code amendment review process normally takes approximately 60 days from the date the City receives a complete application submission. If you are successful in this code amendment, you would then have to apply for a commercial site plan review and proceed with a similar 2-month review process in regards to detailed site planning. It is my understanding that the Council at Monday night's meeting provided little if any indication whether there is support for your proposed use.The zoning code amendment likely will be reviewed in the context of the Council's vision for the future of the industrial park, and staff s role will be to assist Planning Commission and Council in defining and understanding the proposed use and its potential positive or negative aspects. As the Council has discussed its vision for the Industrial District as part of the process of updating the City's comprehensive Community Management Plan,the Council's vision is for light industrial uses such as high-tech manufacturing and office-showroom. A bulk fuel storage and distribution facility does not appear to match this vision.The question for the Council to address is whether this use matches, or is compatible with,the Council's vision for the Industrial District. The next application deadline is Wednesday September 22 at noon for a public hearing at the October 18 Planning Commission meeting. Box 375 Wayzata MN 55391 Re: Boat Shelter-�275 Wayzata Boulevard Dear Sirs: It has come to the attention of this department that a boat shelter has been attached to the rear of the building at 2725 Wayzata Boulevard. This letter is to notify you that additions to buildings require building permits in the City of Orono. The Building Code requires buildings to be designed to certain standards based on the buildings use. This structure does not meet any building code requirement. Therefore,the City must require you to remove the structure. If you wish to construct a conforming structure please contact the building and zoning staff to discuss the building permit application procedures. As per Minnesota State Building Code Section 1306.0100 Subpart 1,fire protection systems are required in new buildings, buildings increased in floor area and buildings that will have an occupancy classification changed. The property is located within the I, Industrial District. ABC Supply Company has proposed to locate a wholesale building products warehouse and office space within the existing building. The Orono Municipal Code permits "warehousing"and wholesaling" in the I district. It is our position that the proposed use of the building for warehousing and wholesaling is permitted. It has been brought to our attention that outdoor storage is proposed for the site. Outdoor storage is only allowed by a conditional use permit issued by the Orono City Council. The required submittals for a conditional use permit will include at a minimum: 1. Complete Land Use/Conditional Use Permit application form(attached). 2. $350.00 application fee 3. Certified list of all property owners within 350' of the property. 4. A detailed description of the proposed use including: a) Outdoor storage areas and screening, as the property is located adjacent to residential property b) Lighting plan for outdoor storage area(s) c) Potential impacts on adjacent properties, such as noise, hours of operation, and visual impacts d) A site plan indicating outdoor storage area(s), traffic areas, and parking e) Landscaping plan e) and any other topics that may be addressed by the Planning Commission, City Council, and Staff during the review process. The conditional use permit review period is approximately 60 days, and requires a public hearing with the Planning Commission prior to City Council review. The City Council has the authority to set reasonable conditions as it relates to outdoor storage on the property, should the conditional use permit be approved. The primary concerns will be screening,lighting,noise,and hours of operation. Because the property is located adjacent to residential uses,the preferred screening would be some form of natural buffer(trees, shrubs,etc.). It is our understanding there is no retail component to the proposed use of the property. Retail uses are not permitted in the I, Industrial District.
