RE: Requested information on Westlake Street dock issue
Dear Mr. Hubert:
You have requested information regarding the the City's position regarding an easement purportedly
granting some form of lake access,and perhaps the right to have a dock,to the owner of Lot 3,Block
2,Hillside Park over Lot 12,Block 1,Hillside Park. Both aforesaid lots abut Westlake Street,a City
right-of-way which ends at the shore of Stubbs Bay, Lake Minnetonka.
Lot 3 is not riparian since it does not abut the lakeshore, and in fact is located approximately 400'
distant from Lot 12 and 400' from the lakeshore. Lots 3 and 12 are within the City's LR-1A, Single
Family Lakeshore Residential Zoning District in which "private docks" are an accessory use subject
to the City code and other applicable regulations, including boat storage density regulation(Zoning
Code Section 10.23, Subd. 5[A]).
By definition, "accessory use or structure" is "a use or structure subordinate to and serving the
principal use or structure on the same lot and customarily incidental thereto" (Zoning Code Section
10.02). The principal use of Lot 12 is the single family residence existing on Lots 10-12. Any dock
on or in the lake adjacent to Lot 12 therefore can only be used by the owners/occupants of Lot 12.
Further, the Orono Zoning Code prohibits residential property owners from engaging in the
"business of docking,mooring or storing boats",which is defined as'renting or otherwise providing
space, including boat buoys,for docking,mooring or storing one or more boats belonging to persons
other than the owner or occupant of the property, except when licensed as a joint use', unless a
Marina Business License is obtained. Such a license cannot be issued except in the B-2 Marina
Business zoning district(Municipal Code Section 5.43, Subd. 1, Subd. 6).
The Joint Use regulations are also enclosed. It is my opinion that the City would not issue a joint
use dock license for this situation(Section 5.42).

Lots 10-11-12 have an interesting history regarding lake access. As early as 1967 the City was
advised of a purported right-of-way easement in favor of Lots 3, 5 and 18, Block 2 (Sept. 13, 1967
letter). The City required the removal of a 7-slip marina on the property in 1979 (see attached
letters). In 1984 the City advised a Mr. Bonner that the City does not recognize such old easement
rights(letter of Nov. 1, 1984). In 1995 the Building Inspections Department was involved in having
the owner of Lot 3, Mr. Perl, remove his dock from the right-of-way (inspection slips of 4/26/95).
The situation with Lots 10-11-12 is not necessarily unique. A similar situation in the Navarre area
of Orono involves a number of off-lake properties which have an easement for "bathing and boating
purposes" over a private lakeshore homestead parcel. Also, other off-lake properties in the Navarre
area have similar deeded "bathing and boating" easements over four City-owned vacant parcels
between Crystal Bay Road and Lake Minnetonka. The City has taken the position that those off-lake
owners do not have the right to construct docks on the lakeshore parcels for the reasons noted above.
I would also note that in the second described Navarre situation,the lakeshore parcels owned by the
City are vacant,which provides an even greater basis for denial,because no accessory structure may
be placed on a parcel of land that does not have a principal structure (Section 10.03, Subd. 9A).
Given the above background information,thank you for providing me with a copy of the easement,
which appears to have been granted in 1920. It appears to merely grant "an easement and right-of-
way...over Lot 12...to the lakeshore of Stubbs Bay..." without specifying any dock rights. It can
probably be construed as a walking easement. The City will not recognize this easement as granting
to the owner of Lot 3 the right to have a dock extending on or from Lot 12. The City will act to have
such a dock removed if one is placed.
Also,any easement created after April 1984 would have required City approval(Code Section 11.03
Subd. 2.66, Definition of Class I Subdivision). Since the easement in question was apparently
granted prior to 1984, that requirement may not apply. Any new or replacement easement would
require City subdivision approval.

RE: Request for Information Pertaining to Installation of Docks on Stubbs Bay
Dear Mr. Gaffron:
Thank you very much for our phone conversation yesterday in regard to some questions
that I had pertaining to the installation of docks on Stubbs Bay of Lake Minnetonka.
Our office represents Mr. and Mrs. Jay Jasper of Waconia, who are the owners of Lots
10, 11 and 12, Block 1, Hillside Park, in Orono. A copy of the Certificate of Title for this
property is enclosed for your information.
This property is for sale and there is a prospective purchaser. However, the purchaser
does not wish to purchase the property unless the "blanket" right-of-way that presently exists
across this property as shown on the Certificate of Title can be removed. It is my
understanding that the owner of this existing right-of-way is not willing to simply relinquish his
interest. However, it is my understanding that he would consider the relinquishment of the
interest if, in exchange, he could have the right to install a dock off of the southwest corner of
Lot 12 of Block 1, with a very limited restriction of access to the dock over this property.
It is my understanding the proposed purchaser of this property would remove the
existing buildings and construct a completely new dwelling. Obviously, it would be of help to
all parties if this blanket right-of-way could be released and redevelopment of this property
could occur.
Therefore, we would like to investigate the possibility of obtaining permission from the
City of Orono to grant the right to allow an additional dock to be installed in approximately the
location indicated, which right would be made legally appurtenant to the owner of Lot 3, Block
2, of Hillside Park,through an easement or other type of document. For your further

information, I am enclosing herewith copies of Hennepin County Half Section Plats showing
this area and the proposed approximate location of the docks.
As of the moment of writing this letter, I do not have a copy of the deed recorded in
Book 926 of Deeds, page 188, which sets forth the right-of-way that we would like to have
released. If you need a copy of this document, please let me know and I will try to get you one
as soon as possible.
