City Code Section 78-1432 states the following: <br /> Sec. 78-1432.Time of construction. No accessory building or structure shall be constructed on <br /> any lot prior to the time of construction of the principal building to which it is accessory. <br /> This prohibits the construction of any accessory structure on a property prior to <br /> construction of a principal building. The City regulates docks as accessory structures <br /> because they serve the principal use and are incidental to the principal use. An accessory <br /> structure per City Code Section 78-1 is defined as: <br /> Sec. 78-1. Accessory use or structure means a use or structure subordinate to and serving the <br /> principal use or structure on the same lot and customarily incidental to the principal use or <br /> structure. <br /> Currently, absent a principal building the dock is illegal per the City Code Sections noted <br /> above. The dock must be removed within 14 days of the receipt of this letter to avoid <br /> legal action. An inspection will occur on September 8, 2004 to verify removal of the <br /> dock.
