A RESOLUTION VACATING
PART OF A DRAINAGE AND UTILITY EASEMENT
FILE NO. 10-3474
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS,James W. Pierpont and Judith A. Pierpont(husband and wife), the
owners of Lot 15, Block 1, THE FARM AT LONG LAKE Hennepin County, Minnesota,
(commonly known as 1801 West Farm Road in the City of Orono),have petitioned for vacation of
part of a drainage and utility easement within said Lot 15; and
WHEREAS,after mailed,published,and posted notice,a public hearing was held by
the Orono Planning Commission on June 21,2010,regarding said vacation and all interested persons
were given an opportunity to be heard; and
•
WHEREAS, immediately following this public hearing the Orono Planning
Commission recommended approval of the vacation by a vote of 5 - 0; and
WHEREAS,in consideration of the following findings the Orono Council finds the
vacation as proposed is in keeping with the public interest:
1. James W. and Judith A. Pierpont are the owners of all property underlying the
portion of the drainage and utility easement proposed to be vacated.
2. The gas, electric, telephone and cable companies have consented to the vacation.
3. The City Engineer finds the vacation acceptable.
4. The vacation will eliminate the encroachment of two buildings on the easement.
These buildings existed long before the easement was dedicated in the plat of The
Farm at Long Lake.

NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council hereby
vacates that part of the 10 foot wide drainage and utility easement lying southerly of the North line of
Lot 15, Block 1,THE FARM AT LONG LAKE,Hennepin County,Minnesota,as dedicated to the
public in the recorded plat thereof,described as follows:Commencing at the most northerly corner of
said Lot 15; thence on an assumed bearing of South 87 degrees 47 minutes 57 seconds East along
the north line of said Lot 15 a distance of 42.00 feet to the point of beginning of the easement being
vacated; thence continuing South 87 degrees 47 minutes 57 seconds East along said north line a
distance of 124.00 feet;thence South 2 degrees 12 minutes 03 seconds West a distance of 10.00 feet;
thence North 87 degrees 47 minutes 57 seconds West a distance of 124.00 feet; thence North 2
degre#02Anutes 03 seconds East a distance of 10.00 feet to the point of beginning.
