On September 17, 2014, we received an after-the-fact building permit application for a tree house partially
constructed on your property located at 2875 Wear Circle. Upon review, we have identified several issues
you should be aware of:
1. Through Lot. Your property is considered a "through lot" as it has street frontage on both the front
and rear lot lines; the RR-1B zoning district requires a 50-foot principal structure setback from street
lot lines. An accessory structure located on a "through lot" must conform to the 50-foot principal
structure setbacks.
2. Right-of-Way. In a situation where a property boundary extends into the right-of-way, the rear
street setback is measured from the edge of the right-of-way. The Watertown Road right of way is
66 feet wide; however it is not centered on the paved roadway. The north boundary of the right-of-
way extends approximately 33-feet into your property. Therefore the required 50-foot setback is
measured from this line. Based on your annotated survey, the tree house is estimated to be set back
only 30 feet from the right-of-way.
3. Building Code. Building Official, Lyle Oman, reviewed the plans and submittals for the proposed tree
house and has indicated there are too many unknowns regarding a structure supported by trees.
There is an unacceptable risk of liability for the City and therefore he will require a structural
engineer to design and certify the structure.
For the above reasons we are unable to approve the requested permit. As the structure is currently under
construction you have the following options: either discontinue construction and remove the structure; or
apply for an after-the-fact setback variance to permit the structure to remain in its current location. Please
note, the building code requirements (#3 above) will still apply. An after-the-fact variance application
requires an application fee of$1,400 (double the $700 fee) and submittal of an updated survey showing the
tree house under construction.

Sec. 78-1. Definitions.
The following words, terms and phrases,when used in this chapter, shall have the meanings ascribed to
them in this section, except where the context clearly indicates a different meaning. Unless specifically
defined in this section, the words and phrases used in this chapter shall have the meanings given to
them in chapter 82.
Lot line means the property line bounding a lot; except that where any portion of a lot extends into the
public right-of-way or a proposed public right-of-way,the line of such public right-of-way shall be the lot
line.
Sec. 78-420.Area, height, lot width and yard requirements.
(a) Height. No structure or building in the RR-1B district shall exceed 2%stories and shall not exceed 30
feet in height except as provided in section 78-1366
(b) Lots. The following minimum requirements shall be observed:

Sec. 78-1406.Additional yard provisions.
Required yards in the districts specified shall be subject to the following additional requirements:
(1) Through lots. Through lots in any district shall have a required front yard on each street.
(2) 8 and I districts: adjacent lots. In the B and I districts, where the average depth of at least two
existing front yards for buildings within 150 feet of the lot in question are less or greater than the
minimum front yard depth required for the district, required front yards shall not be less than the
average depth of such existing front yards; however, the depth of a front yard shall not be less than five
feet nor be required to exceed 50 feet.
(3) R districts:adjacent lots. In any R district, where the average depth of at least two existing front
yards for buildings within 150 feet of the lot in question and within the same block front is less or
greater than the minimum front yard depth required for the district, the required front yard shall not be
less than the average depth of such existing front yards; however,the depth of a front yard shall not be
less than ten feet nor be required to exceed 50 feet.

LAND USE APPLICATION ESCROW AGREEMENT

Recitals
1. Owners have filed Land Use Application #2.CI S'CC.G formally requesting the City to review plans
for the property addressed: 2-(C-15 i )-eCtf- C k—. (the "Subject Property") legally
described as
2. Owners request the City to review said plans which requires City approval and may require
consulting legal and/or engineering review.
3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Owners establish an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUQS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $ /7C0 cwith the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with the Owners reviewing the plans, and preparing agenda packet material for City Council
review of Land Use Application #206 • kr, Eligible expenses shall be consistent with expenses the Owners
would be responsible for under a land use application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§415.01 and 366.012.
