This permit for the construction of a new residence is incomplete. The following items must be revised and submitted in order for the application to be considered complete and for the plan review to continue: 1. Certificate of Survey. There is information missing from the submitted survey particularly existing topographic information extending 50 feet outside the property boundaries. Please provide an updated certificate of survey meeting all of the City's survey requirements (attached). a. Per City Code Section 18-136(a) each residential property is limited to one curb cut. Your plan shows that you are proposing to maintain the two existing curb cuts. With the redevelopment of the property all non-conformities must be brought into conformance. Please revise your plans to reflect only one curb cut. b. The survey should be revised to clarify which buildings are to be removed after the completion of the new residence. *Please note, some of the existing buildings will not conform to Code requirements once the existing principal structure is no longer the principal structure. 2. Wetland Evaluation. Please see the attached information regarding wetland evaluation. This project may trigger the administration of the City's wetland ordinance. **Please note, additional requirements and/or escrows may apply. 3. Construction Plans. The submitted construction plans are labeled "Not for Construction". The plans are reviewed for Building Permit must be the official For Construction plans. Please clarify. 4. Escrow Agreement. He will be completing the additional 50 feet of survey. Item b, the existing garage we would like to stay on the property and have planned to update the structure to mimic the new house to be built(architecturally-wise ie. siding, roofing). In order to keep the existing garage, what do we need to do to get a variance or a conditional use permit? What are the timelines for completing this? Item 2 will be figured out based on Mark's survey (I am assuming). Item 3 will be completed by Elise (the architect). Item 4 we do not have. As we discussed there are a couple options for addressing the wetland delineation. Let me know what you and the property owner decide. Also,you will need to contact the Police Department regarding the road weight restriction issue, however after I spoke with the PD today to get information on this for my own knowledge and I don't believe this is a viable option for you. The plans are dated 2-10-10. We have the following comments with regards to engineering matters: • The drainage swale directing runoff to the neighboring property is not acceptable. To the extent possible, stormwater runoff should be managed to the right of way north and south of the proposed home. • The submitted site plan attached to the house plans and dated 2-25-10 shows significantly different grading at the west side of the proposed house. The survey plan or site plan should be updated to match. • The survey plan notes that the western driveway will be abandoned with the project. This should be confirmed and clearly shown on the plan. • A field review shows the possibility of a wetland located within the southeast area of the property that would trigger the wetland ordinance. The wetland and buffer will need to be shown on the plans. • This project will disturb more than 100 CY of material. Sediment and erosion control information meeting the requirements of Orono's City Code 79-7(c)(2) must be submitted. The minimum $2000 sediment and erosion control financial security should be required of the owner for this permit. A couple of the revisions depend on whether or not the property owner is going to reorient the house to Wear Circle, or remove the walk-out. 1. Address the City Engineer's concerns listed in the March 12, 2010 letter. 2. Get the wetland delineated. Either the conservative estimate by Bonestroo or hire a professional delineator. 3. The edge of the wetland must be shown on the survey as well as the 25-foot buffer. 4. Show driveway portions to be removed. 5. Indicate the buildings to be removed. 6. Show the existing and proposed septic tanks, lines, and mound drainfields. 7. Show extent of silt fencing or other erosion control measures. 8. Show significant trees—particularly in areas of proposed grading or proposed septic areas. 9. Show new driveway (if home is reoriented to the Wear Circle)—one curb cut. If you choose to access off of Wear Circle, I recommend making a written request to the City to change your property address to a Wear Circle address. Also, as we discussed,the accessory garage on the property (aka the sentimental garage) will be allowed to remain as at 43' it meets the principal structure setback of 30'from a side yard. Code section governing accessory structures on Through Lots: Sec. 78-1431. Accessory buildings and structures on through lots. All accessory buildings and structures on through lots located in R districts shall meet the following requirements: (1) The building or structure shall meet the principal building setbacks that are established under sections 78-230, 78-255, 78-305, 78-330, 78-350, 78-370, 78-395, 78-420, 78-444. (2) No negative impacts to adjacent neighbors or public right-of-way result in the placement of the building or structure, determined at the discretion of the planning director. Should the planning director determine that item (2) above cannot be met an accessory structure or building may be permitted by conditional use permit if the planning commission determines no negative impacts result in the placement of the building or structure. The planning commission may apply reasonable conditions as part of the approval. Have a nice weekend. This planning staff signature assures compliance with the hardcover, setbacks,grading and site plan. Historically, we have issued temporary certificates of occupancy in situations where necessary corrections were simple, not life safety issues, or where winter conditions do not allow for finalization of the exterior improvements, grading etc. Temporary COs have become something of a convenience for builders and home owners who have pending closing dates or wish to move in to a nearly completed home. However by their very nature, issuance of a temporary CO allows a property owner to move into and occupy the home before all requirements have been met. On occasion,this fact has made it difficult to require a homeowner to come into full compliance with the approved plans. Staff should use temporary COs with caution, as our ability to compel a property owner to comply is not as strong once they occupy the home. As of today,the form for temporary certificates of occupancy shall include a signature line for planning staff approval. I would like to have a meeting to discuss whether or not we need to develop a zoning compliance CO or if we are able to accomplish our goals with a cooperative effort.
