I am writing to you in response to your email to me dated January 8, 2014. Thank you for your email but we respectfully disagree with your City Attorney's interpretation of the Orono zoning ordinance. We believe that the use of the property by Orono Station is a continuation of the previous uses of the Property and fall within the permitted uses allowed in the B-1 district as a"Garden Supply Company". We also want to make sure the City is not confused about the business to be conducted at the site. Our tenant NutriGreen Lawn Services will only be conducting its sales and distribution operations from this site. NutriGreen will not be using the site to run its residential lawn services business. The City has forwarded to me your correspondence dated January 22, 2014, where you indicate that your client will be operating a business that has been determined by staff to not be an allowed use. The City staff has directed me to write this letter informing you that if your client is currently operating a business that he may be subject to a civil suit or criminal enforcement of the City's Code. I believe there is support, at a staff level, for your client to amend the code so that his business becomes an allowed use subject to reasonable conditions imposed by the City Code. It is my hope that the City will not be forced to bring legal action to enforce the provisions of the existing City Code. I am writing this letter to follow up my correspondence dated February 24, 2014. It is my understanding that your client, Brad Erickson, has visited City Hall on several occasions to express his displeasure with the City's opinion regarding the properties he owns at 2120 and 2160 Wayzata Boulevard. It is further my understanding that he has indicated that he has no intention of following through with the suggestions made in my February 24, 2014 letter. Mr. Erickson's position is unfortunate because I feel there is a way to amicably resolve the issues surrounding the two properties that he owns. I have been instructed by City staff to initiate the appropriate legal action in the event Mr. Erickson continues the current business operations.
