Dear Ms. Aronsohn:
I am writing in reply to your letter dated January 24, 2008. I apologize for the delay in
getting back to you on this but our office, including myself, have been devastated by the
cold virus that has been going around. I hope that you have been able to avoid it.
In the letter you state that the house is vacant and boarded up. I inspected the property
and agree. If the intent is to not rent the house or otherwise occupy it, then the septic
system does not need to be brought up to code. I would strongly advise that the existing
septic tanks be pumped out, lids crushed and backfilled with dirt. This would help to
limit liability on the vacant parcel and eliminate Orono's concerns about the house being
re-inhabited.
I discussed this matter with the planners for the city and they wanted me to inform you
that the large pole shed on the property was permitted as an accessory structure. If the
existing house is torn down, and a new house is not built immediately, then the pole shed
would need to be removed also. Since there would be no primary structure then an
accessory structure cannot be allowed to stay.
If you would like a list of contractors that can properly abandon the septic tank(s)please
go to www.12ca.state.mn.us/programs/ists/ists.xls. These contractors are state licensed so
you may choose whomever you wish from the list regardless of county. Please feel free

Dear Mr. Gibbs:
We have traded phone calls a few times and have not connected, but I would like to put
this matter to rest so perhaps you can either send me a letter or e-mail me with the
solution to our request.
In your letter of November 19, 2007 you state that the septic systems in Orono must be in
compliance by December 31, 2010. The property referenced above is a single-family
dwelling but we have boarded it up because it was in no shape to be rented out. As the
house is not inhabited, how does this compliance standard affect our property?
I will appreciate it if you can let me know how we are to proceed being the house is
vacant.
