PS2421-04(02/12) Addendum to Minnesota Department of Public Safety Minnesota Vehicle License—Zoning Verification by City of Orono Dated August 7,2013 Minnetonka Leasing, Inc., d/b/a/ Sell to Morries ("Morries") is permitted to engage in wholesale operations as a licensed Minnesota Motor Vehicle Dealer at 2605 Wayzata Boulevard in Orono, Minnesota(License Site)pursuant to current applicable zoning regulations (Orono Code §78- 822(a)(1)). Morries is also allowed to engage in certain activities which are related to its wholesale operations at the License Site pursuant to two Conditional Use Permits issued by the City of Orono. These permissions are detailed in City of Orono Resolutions 4845 and 5470 attached hereto. Said Resolutions impose significant and material restrictions on the activities of Morries, including most significantly, a general prohibition of any retail motor vehicle sales activities on or from the License Site, except fleet sales which are permitted. Under existing zoning regulations and Conditional Use Permits, Morries can engage in certain activities as a Minnesota licensed used Motor Vehicle Dealer, including phone and internet communications concerning purchase and wholesale re-sales of used motor vehicle inventory, storage of used motor vehicle inventory, wholesale brokering or sale of used motor vehicles, including sale of used motor vehicles to licensed Minnesota Motor Vehicle Dealerships. Under existing zoning regulations and Conditional Use Permits, Morries is specifically allowed or permitted to maintain and operate the following facilities on the Licensed Site in accordance with Minnesota Statute § 168.27, subd. 10(a)(2). 1. Office space in the existing commercial building where the books, records, and files necessary to conduct the business may be kept and maintained, and personnel may be available during normal business hours (9:00 a.m. to 4:30 p.m., Monday through Friday). Dealership business hours may be conspicuously posted on the exterior of the building in a manner readily viewable by the public; 2. There are permitted and allowed areas, both indoors and outdoors,to store or display for"wholesale resale"motor vehicles which are owned or under lease by Morries; and 3. The existing monument sign which is readily viewable by the public from Wayzata Boulevard and that clearly identifies the site as the business location of Morries. The City of Orono expressly prohibits any and all retail sales of new or used vehicles at the Licensed Site except fleet sales, which are permitted. Furthermore, vehicles stored at the site may not be listed for sale on the internet for retail sale. The City of Orono confirms that Morries has complied with Resolutions 4845 and 5470 as of August 7, 2013. 1718142.
