Stat. § 1 I5B.178 that certain actions proposed to be taken by DRB#8 LLC at the Washington Scientific III site, located at the address referenced above(the Site),will not constitute conduct associating DRB#8 LLC with the release or threatened release of hazardous substances, pollutants,or contaminants at the Site for the purpose of Minn. Stat § 11513.03, subd. 3(4)(1998). The Minnesota Pollution Control Agency(MPGA)staff in the Voluntary Investigation and Cleanup (VIC)Unit has reviewed the documents submitted for the Site(the Site Documents). The Washington Scientific Industries Inc. (WSI)facility is a contract manufacturer for precision metal components. In 1987, WSI identified chlorinated solvents in the soil and ground water at the Site on the south portion of its facility during the construction of a parking lot expansion. In 1988, WSI installed a ground water pump-out system as a remedy under the MPCA Resource Conservation and Recovery Act (RCRA)Program. The Site was transferred from the RCRA Program to the MPCA VIC Program for regulatory oversight as the Washington Scientific 11 site(MPCA Project Number VP 1002 1)on August 10, 1998. On July 24, 1999,the MPCA approved a pump-out system shutdown proposal by WSI contingent upon installing additional downgradient monitoring wells and initiating a long term monitoring plan. The Site Documents describe soil and ground water investigations that have occurred at the Site since 1987. Attachment B in Table 1 summarizes the soil and ground water compounds that have been identified during the course of these Site investigations(the Identified Release). The MPCA and WSI intend to continue to work cooperatively to address the Identified Release under MPCA Project Number VP 10021. Based upon a review of the information provided to the MPCA VIC Program,and subject to the conditions set forth in this letter,a determination is hereby made pursuant to Minn.
