Van Erickson and Peter VVelles were absent. Representing Staff were Pubtic Service Director Greg Gappa, City Planner Elizabeth Van�ornmeren, and Recorder Sherry Frost. Chair Wilson calied the meeting to order at 7:20 p.m. (#1)APPRUVAL O�'MINUTES OF'JU1tiE 2, 1�97 MEETING Wilson noted that the Cammission decided not to meet earlier on site for this meeting as indi�ated in the 7une minutes to�iscuss the sketch plan bein$considered far praperty on Saga Hill due to changes being considereti for th�sketch pt�n. (#6) TREE PRESERVATION PQLICY Beai repvrted that a meeting of the sub-committee was hetd resulting in a broad based policy. Points 1 through 5 will be disc�ssed with Council and the policy will be reviewed by the Planning Commission for a recommendation. The policy is directed at developers with emphasis ort carnmercial propert�es. BeaI said the committee recognized the rights of private praperty owners and has recoznmended a brochure be pravided relati�g the philasophy of Orono regarding preservation of its rural them�e. Gaffrcm had mentioned at thai meeting concern for "taking" of tand. The policy will be reviewed by Council at their July ]4 meeting. Wilson indicated that a couple members of the Planning and Park Commissions�ould review with Staff and passibly the consulta�rt ta grovide the details af the policy. Wiison indicated that the poti�cy as cunently presented is a broad parameter and the Mayor has asked the policy to move forward. Beal asked Staff if de�ails could be developed once Coancil received the broad policy. It was indicated that the consultani could aid in this development. 1 MINUTES 4F THE REGULAR ORUNO P�RK COMMISSION MEETING HELD ON JULY 7, 1997 (#6- Tree Preservation- Continued) Wilson asketi Van Zomeren her opinion regarding commercial property. Van Zomeren said she has reviewed the zoning ardinance, code, and cornprehensive plan to see what is detailed regarding tree preservation. There are landscaping t-equirements noted for commercial property af l2%. Van Zomeren noted that the City of Minneapolis requires 2�%and questions whether 12% is adequate.. �an 2c�meren would like to see more developed site plan regulations for commercia.l properties. She sa.id she is in the process of recadifying the 2onin� codes. Van Zomeren noted the need far the City to determine how stringent zoning codes should be for the Highway 12 commercial area. She cited an example af excess parking and minimum landscaping requirec! for Rick's Super Vaiu in Navarre. She opined that additional trees and shrubs would improve sites and be an opp4rtumty for being a eaialy�st in improvin�commerciat areas. She acl�nowledged Council's decision to decline provading inpat in landscaping on a prior commercial application. Van Zameren noted�hat cor�metcial site plans are related but separate fram tree preservation. Wilson asked how commercial site plans interface with tree preservation. Van�pmeren said tree preservation should occur and noted examples of commercial areas where significant trees are located. Wilson questic�ned wh�ther tree preservation belortged in site plannin� or as a separate issue natin�the possibitity af requirement a buffer area in cammercial properties ta maintain the rural atmosphere. Van Zomeren said tree preservation cauld be part af the landscaping plan. Sea1 indicated the 12%landscaping r�uirement fails to state where the landscaping should he placed. Van Zomeren reviewed the existing ordinance and comprehensive plan which was distributed to Park Commissianers noting where buffering is indicated ta maintain a rt�ral feel ta property. She saw the references as bein�a starting point far providing needed pres�rvation. It was noted that the reyuirements are more general but have no specifics to hold owners to a standard. Examples�vere shown irt the comprehensive plan where enviranmental goals in�reserving natural resaurces were indicated(3.18), naturat resources to be included in develflpment proposals{3.21)and retention of vegetation by the lake prahibit�ng clear or thin cutting (3.22}requiring CUP in 0-75' setback. Van Zomeren nated there are slope restrictians over 18°l0. Gappa indicated bluff areas cannat be disturbed withaut a CUP according to the zoning ordinance(nat referenced in comprehensive plan). Van Zomer�n noted eavironmental comments. Wilson indicated the need for more specific requirements. Ilse noted that the cornprehensive plan is mare general ar semi-specific that cauld be developed in the zoning ardinance. z N�NUTES OF THE REGULAR fJR�NO PARK COMMISSION MEETING HELD ON JULY 7, i 997 (#b - Tree Preservatic�n -Cantinued} Wilson acknowledged that the phitosophy of preservation is within the ordinance and comprehensive plan giving more credibility to a tree preservation policy. Van Zomeren noted references ta rural areas regarding native vegetation within the 0-75' shoreland {4.13), land use for future development enhancin$the environment and preservatian of views (4.1 S}, rural density and open space retaining waodlands and wi}diife(4.9). (VVhite arrived at this time.) Beal questioned whether or not the comprehen�ive plan needs to be revised. Van Zomeren indicated that it will have to be done. She said she was surprised by the amount af references to tree preservatian in her review stating that priorities are the same as in the proposed tree preservation policy. The "teeth" for adherence to paticies will be through #he subdivision ordinances. Van�ameren reference definitzon#58 of shade trees. Van Zomeren said species and size should be indicated. Beai said subdivision#2 on gage 3 refers to it. Van Zomeren referenced the first paragraph in 4.32 where it indicates the supply is provided by the developer. She noted it could be argued that the tree preservation should make that provision. �Vhite said if the Commissioners had known these policies were in the ordinances and codes, these requirements would have been required. VVilson noted the lack of reference to what is required for fields. Van Zomeren said vegetation plans can be requested. ti'an Zomeren referenced the general policy statement regarding the removal of trees. She suggested tree location coutd be nated and the possibility af bufferinp atong the road frontage. She nated that is has probably been arbitrarily enforced in the past. New trees are to be at least 2" in diameter. Van Zomeren noted that the policy has nat been used in the past. She indicated that the Jyland Develapment which is now vacant land and recentty appraved does not have to inventory ail trees. 5he noted that this is simiiar for Saga Hill. She does not beiieve tree removal will occur here but there are parcels where it cauld happen and should be protected. 3 MINUTES OF TH�REGULAR ORONO PARK COMMIS�ION MEETING HELD ON JULY 7, 199? {##6 - Tree Preservatian- Continued) McDertnott questianed the definition of a significant tree. White said trees of 6" ar more cannat be cut in the shoretand district. Van�omeren said the zoning�ode is scattered in its reference to trees but is clear in the 0-75' lakeshore in alI zonin�districts regarding ciear cutting oftrees. She believes tree preservatian should be compatible with referenc,.e to significant trees. S�asked what the Cc�mmission would be comfortable with as far as definition of significant trees. Beal noted that the de6nition of significant trees is noted els�where. Ilse suggested 6" as used in the 4-75' setback instead of the S" £or replacement. Wilson said it should be specifi� as to what is dane. She n�ted that the zoning code refers to a 12" trur;k above graund level as not less than 2" diameter. There are good lists of species for bo�h coniferous and deciduous trees. Van Zomeren said there is the issue of improving what is happening regarding tree r�maval. Wilson felt tree removal is aniy occumng randomly and not clear cutting. Beal noted this does not refer to privat�p�operty. White cited the example of the ordinance involving dead tree removal. This cannot be done without inspection. �V'ilson asked what should be brought to Council in light of comments r�ade by Van Zomeren. Beal asked what is involved in strengthening the zoning ordinance. Van Zomeren said the vegetatian pian could be expanded regarding types of trees. Beal asked iF this couid be done with a new ordinance. Van Zomeren said it should all be referenced in one addendum to the ordinance as the "tree preservatifln ordinanee" and mac�e reference to else�vhere'sn the ordinance to the tree policy. 5he felt the definitions in the submittal re�quirements are reviewed regarding direction to applicants. She asked if 11.64 is needed or should b�ir�ccxporated. The tree preservatian wauld he a new chap#er and referenced in the zoning code. Van Zomeren said the code would have to be reviewed to verify there are no contradictians. She said the commerciai subdivisions are regulated by the zaning districts and is repartedly satisfied with what is w-rit#�n in the zvning code. The code can be amended, deleted, and upgraded where necessary. The zotung code, however, needs to ref�rence the tree ordinance policy to strengthen it. Van�omeren confirmed far Wilson that all devalopers, both residential and can�rnercial, must adhere to the zoning code. V�iison asked how what has been done so far fits in with the codes and whether it can be enforced. Van Zomeren indicated the purpose, authority, and broad concepts can be placed in the purpose statement. Bea1 noted#2's intent is to inform private (and owners what can be done. Van�omeren said the distinctior� is when an application is made to the City to divide land, which woutd initiate the tree inventory and hovv trees are to be preserved. Wilson noted that this would not affect a person wanting to remove a tree on their property. She felt the right of the private property owtier needs to be recognized. McDermott questioned if tree removal wou�d be allowed if it affected ma'sntaining the n�ralness of the praperty. He noted iree removal is restricted in the shoreland district. t�ilson noted that the purpose of the shore�and ordinance is to prot8ct lakes from pallution. Beai said the purpose of#2 is to show tl�at �overnment is not to be heavy handed regarding what private property owners can do with their propetty_ �se questioned whether the policy can pratect the right of each property owner versus a person subdivic�ing their property. Beat indicated that it has been detertnined that the City has the rigl�t ta regulate subdivision. Wilsan indicated that she feels the buffer�one areas are impartartt. McDermatt felt #2 goes against buffering and questioned whethec some restriction would be included for pr�vate property ow�ers. Wilson did not agree with IwlcDermott but thought there wauld be some restrictions. Van�omeren questioned the effect of deciding level af enforcernent on subdivisions may impact the ruralness af the property. She nated smaller properties may not have the same impact. She indicated that the ability t� inventary trees and regulate what happens tivith trees wi�l not change. Beal suggested#2 be eliminated and buffering cited elsewhere. Wilson notecl the purpose is ta set guideiines. Gappa noted that the guidelines wauld only affect new constructian or subdivision. V�n Zomeren said tree loss c�.n cscccur with the instaliation of a new septic. It was determined that#2 showed t�e thaught pro�ess the committee was takir►g. Beat suggested starting v�th#he guide�nes for development. Wiison said additionai dctail can cc�me�ater and pres�nt the general concept to the council with some directton. Van Zomer�n noteci that the purpose is not to micro�anage individual properties. Beal question��whether the issue was people clear cutting trees. McDermott said he would not be happy if that oceuned but people have that right. 5 MiNiJTES 4�' THE REGULAR QR�NO PARK CONIlVIISSION MEETING HELD QN 3ULY 7, 1997 (#6 - Tree Preservation - Cantinued) Commission determined to delete#2. #1 would remain with the refer�nce to the City of Plymauth deteted. #3 was revised to say, "Provide a guidebook far property owners, giving reeommendations on basics of tree preservation and reforestation and maintenance. This is considered an impartant......,...that is targeted at commercial and residential developers. (#3 will now become#2 since the original #2 was deleted.) The last sentence in#4 (now#3)wiii say," Spectfics reg�trdin�tree preservation and refare�tation will be provided by outside eonsultants with Staff„�;;uidance. Regarding#4, Van Zomeren questioned whether the number of tree would create a problem for prQviding a building pad. McDermott said Council ean make individual exceptions. Van Zomer�en sa.id she is nat clear on density of zoning districts. She cited the example tt�t 100%of the progerty dves not t�ave to�xe protected and the intent could result in no develapme�t. Wilson said the property would have to meet certain param�eters. Besl suggested leaving tl�e parameters to be set by consultant. Regarding poticy f+�r commercial properties, Van Zomeren cited what she lac>ks for in applicatians. She acknowledged the need to preserye trees but felt there was mc�re need �'or landscape development. She said the Commission n�eds to recogru�e that there are ather needs than tree preservation alone. She suggested a separate commercial site devei�pment palicy s�ould be considered. White noted that Navarre is not rural and does not reflect 4rono's plvlosophy af a rural eommunity. Wiison agreed that the stat�ment in#4 is an ambiguous stat�rrtent. Ct�rnmercial development would be required to follaw tree preservatian policy along with the other guidelines. McDermatt questioned wi�at#4 would da for properties such as the Dickey Prc�perty. Wilson said it needs reforestation. Van 2omeren questianzd what should be required for subdivision of what is naw corn fields. Wilsan said the requirements should includ�buffering. Wilson sugg�sted bufferin� adds grace and softens property. Ilse questioned what the Commission wants Highway 12, which is the heart of Orano, to look like. Van Zomeren said she is concerned with the Higiiway 12 parcel that is available for development. Wilson said tree buffering shou}d occur. 1VIcDermott said it would reyuire a specific ordinance far that to accur. Ilse and Beat agreed that a separate ardinance should be required. 6 MIlVUTES OF TI-�REGULAR ORONQ PARK COlV4MISSTON MEETING HELD ON 7ULY 7, 1997 (#6 - Tree Preservation- Corrtinued) Van Zameren questic�ned whether parkin�lot requirements shautd t�e traded with increasing tandscaping and trees. Wilson encowa�ed Van�omeren to be stringent. The new#4 is the determination of criteria. #5 will state, "A commercial site develapment poficy is needed to encourage developmem." Wilson said tl�is should contain very spe�ific guidelines for spec�fic buffering. It was suggested that a#6 be added to refer to refarestatian. The consultant will be deferred to regarding int�rnal tree% a.nd buffering. Commissioners voiced concern with cornfields or pasture land now becoming reforested and whether that was the gaai. McDermott suggested referencing the 5-acre zoning and returnin�property that was onee prairie back to prairie. 'Wilson suggested#6 be reforestation or prairie development. Ilse asked how this would affect horse farms. Wilson said 5 acre prop�rties should be dealt with differentty. Wilson said there should be a parameter for reforestation or preservation. McDermatt suggested different parameters far different parcel sizes. Wilson thought this was dealt with under#4 where criteria is determined. McDermott said the tar�er acreages can be retained as open field or prairie under criteria determined in�. It will be noted in the preamble that Qrono has 6een devetoped well over th�years(which was noted at the end of the original #S)_ Wilson said she would iike to encourage the Council that the n� step in the process be the crafting of the poticy with the consultant, Staff, and several members of the Plan�ing and Park Commissions. Van Zomeren nvte�that the consultant is under contFact. Wilson said Council wilt to asked ta pay the cost of using the consultant for this task. Wilson asked if the consuitant would be hired tta handle the tree presetvation issues once a policy is estabiished. White said the devetopers could be required to hire a consultant. B�a1�vill redraft and submit with assistance from Van Zomeren for Ct�uncil review on Juty 14. Wilson thanked Beal and Van Zomeren for their work on this issue. � MINUTES OF THE REGULAR fJRONO PARK C()MMISSION MEETTNG HELD ON 3tJLY 7, 1997 (#2) OLD CRYSTAL BAY ROAB BIKE TRAIL UPDATE Crappa reparted that the bike trail has been paved to the student center. Some restvratian and seeding is still required. The Councii has rejected the bids for the last section as a resuit of a challenger to the process regarding an addendum. It will be rebid in 199.8, which will allow the City to know the plans being considered for the schooi property. Hennepin Parks will aiso be constructing their section of the trail next year. VVilsan asked if the DNR grant money has been received. Gappa said the money has not yet been received but shall be when the last trail connection is made. McDermott questioned fencing placed along the trail south of Highway 12 on Qid Crystal Bay Road. Gappa said the garticulaz fencing was a result of an easemerrt a�reernern. {#3)PARK DEVEL4PMENT PLANNII�TG/MA3NTENANCE Wilsan noted that the Cammission will reguiarly review the park plans. Gappa will update the progress being made at each park and its maintenance each momh. A. ANTOINE Gagpa regortec!that the playground equipmen# should arrive shortly. Site gregaration will take place when that accurs. Completion of the improvements should occur in early August. Gappa will eall and check on the anticipated date of arriva] for the equipment. Gappa indicateci tl�at the neighbors have asked that a portion of a garage be saved and doors removed. Gappa and Park Cornmissioners agreed that all of the buildings will be removed as pla.rmed. B. CRYSTAL BAY The pc�or condition of the fields was noted during the Park Tour. Gappa reported tha.t a contractor had extra black dirt he donated for use at the park. The City has agreed to pay for spreading of the Z,O(�7-3,000 yards of dirt. Wilson questioned whether the dirt will be seeded. Gappa said dormant seeding and mulchin�will be done in th�fall. Commissioners asked that something be done now. White suggested seeding now wi#h rye. Gappa said he wauld attempt to gut same type of seeding on the dirt. s MINLTTES O� THE REGtIL.AR ClR�NO PARK CIJM�v1ISSION MEETiNG HELD aN.TULY 7, 1997 {#3 -Park I3evelopment and Planning- Continued) C. BEDERWOOU Commission discussed whether the short basketball court should be considereci at this time. Ilse recognized providing far the needs of oider children as painted out by the neighbor who requested the basketball court. Ilse suggested the "Walk for Parks" pragram be instituted far next April to fund the court_ T'his program encourages groups to raise funds for these type of park amenities. McDermott indicated that this program could also raise the funds far the�;azebo at Antoine. �Uilson questioned whether the Park Commission shoutd match funds raised by this pres�ram. Van Zameren suggesteci setting a contribution limit. Wilson asked Ilse to pursue implementation af the pragram for next spring and deternune what needs are c�esired that could be addressed in this format. White will include this program in�is I,ong Rang�Funding Plan of which Ilse and White are on the sub- committee. The sub-committee wiil rapart back in September. McDermott asked that the neighbor who requested the basketball court be notified of this pragram. Iise asked what the policy is regarding weed control. She indicated that she sa.w someone spraying for weeds at the park without leaving notifieations af spraying havin�been done. Gappa said the City has�ontrac�ed for weed coritrol at some parks. Ilse said she does not favor parks being sprayed c�uestiotvng the safety of such activity. Wilson said there were people both for and against spraying. Gappa said the contract comes up for rebidding ne�year. Beai noted the nee�i ta differentiate between no�aus weed spraying. Gappa said there is concern with spreadin�weeds to neighboring praperties. WiIson noted there are harmless chemicals available for broaaleaf spraying. White said people generally over apply the chemicals. Wilson asked Gappa to review this i�sue. Gappa said he would ch�k with Hennepin Parks re�arding what applicatians they use. Van Zomeren and MeDerrnott both indicated that the praper notices shouid be displayed after sprayin�occurs. IIse reported that garbage being ieft by the mounds is blowing ar�und the park. She asked whose job it is to take caze of this detail. �Ga.ppa indicatsd that the baseball groups occasionally will take care of this matter but he will check on it and institute more than weekly pick up of tras�. It was questione�tl whether the basehall groups have a key to the dumpster. Gappa asked that Cammissioners cail him if they see a particular problE�n. Wilson suggested the trash be picked up c�n Mondays. Dse said the policy had been one where the last user of the fi�ds each night wouEd bring the�arbage to the dumpster. She suggested this be recommunicated to the groups. She a�so noted that the schedule of games should be posted. McDermott questioned whether there are a list of rulea which shauld be followed for t�e parks. t"sappa said there was not. HACKBERRY McDermott asked about the back stvp being moved. Witsan asked that this be checked on. Sk�e asked whether there was a problem with the benches. She noted that the fieids are in good condi�ion. Gappa said the sign for the park was moved and placed aiong Willow Drive. E. DICKEY Gappa noted that mowing has taken place allowing for movement in and out of the park. He indicated no improvements are ptanned for the park. Ilse suggested a picnic ta.6Ie shoutd be placed on the wesi end of the property. Wilson asked that Ilse work with Gappa on tlus rec�uest. F. NAVARRE l�an Zomeren indicaLed that the Plaizning Commissian intern wilt be conducting a housing inventory in the Navarre area along with a survey. The residents witi be asked if they use the park and how they feel about their neighbnrhoad. Gappa reparted that the bushes have been removed from the park as welt as dead trees. McDermott commented that th�e park looks�ood. G. FRENCH CREEK Ga.ppa regQrted that the prairie looks good. He said they have been trying to widen the trail areas_ H. AIGH�'(3UD Wilso�indicated that the Commissian has talked about worliing an impraving the trails and the low 1}ring areas. She indicated fall and spring are the best times for this to occur, Ilse reparted that the Lake Minnetonka Enviranmental School is adapting this park(and considering adopting Dickey Park in the future). 10 MINUTE5 OF THE REGULAR URONO PARK COMMISSION MEETING�-IELD UN 3ULY 7, I997 (#4) IAWRY WOODS ACCESS UPDATE Gappa provided a handout which includes a let#er ta the property owner af the triangular piece of property for possible access to Lowry Woods. Th�neight�ors have not want�to provide an easement or sell this piece of progerty. Mrs. Johnson informed Gappa that the neighbors are not interesteci in providing access ta Lowry Woods. Gappa said the Cauncil would have to make any condemnatian deternunation. He reparted that Mrs. 3ohnson is concerned with pa.rking and accidents occurring on the curve of the roadway. Gappa said ths piece of property wauld have to be acquired to offer aff-street parking. This would require two condemnati�ns. Wilson asked Commissipners whether condemnation should be pursued. Gappa noted that ihe Co�zncil makes seriaus consideratian of any cQndemnations. He indicated that the intent of the nature conservancy is to preserve the la-nd whiah is heing done. Gappa believed the cost for providing access shouid totai $10,000-$�5,000. Wilson suggested pedestrian access only but Gappa questianed where cars would park. Wilson thought the property �auld be used by walkers anly. Gappa notecl that no parking si�ns could be considered. White suggested the matter tye placed on hold to see whether future development may answer the access question. Ilse asked that Staffnote this passibility for future subdivisian. McDermott indicated that access from Outlot A would only require one condemn�ativn. He was informed that the owners ofthat property did nvt want to see access provi�ed either. eommissianers decided ta put the matter an hald for the time being. McDermott asl�ed Gappa to check with the Cat�nty to see if there are any ptans for improvement of CoRd 84. Gappa said he would do so. {#5� OPEN SPACE PLAN This itern was postponed for discussio�at the August meeting. (Item #6 preceded Item #2.) (#7}PARK CQMMUNICATI4NS White is providing pictures for insertion into the newspapeF regarding the Park Tour. Van Zomerea suggested the new biack dirt applied on the fields at Crystal Bay Park be note� as well. Wilsvn asked that a special notice be placed in the newspa�er when the playgound equipment is installed at Antrsine. McDermatt will head up a ribbon-cutting ceremony. lI NIlNU'IES OF THE REGULAR ORt3N0 PARK COMMISSION MEETING HELD UN JULY ?, 1997 (#8)NEW BUSINESS Wilson asked that the�ommissioners review the bil�e/hike trail plan at the September meeting. Gappa will check that ali members have a copy of the bike/Iuke traii plan�ap as weit as provide copies of the open space map for Welles and Ericksan. Wilson said the Commission will be re�iewing the Park Plan and {)pen Space at each meeting and asked Commissiane}-s to bring the apprapriate mat�rials to each rneeting. The Park Master Ptan will be reviewed for cc�mpletion. The Pazk Inventary is complete anti McDermoti wiii make final correctians and distribute to Commission members. Qther plans were reviewed for any needs rec{uirin�attention. The Long Term Funding will be reviewed in October. Gappa indicated that there have been twc�committees selected for the east and�vest n+eighborhoads regarding Highway 12 design plans. Tl�ey will meet momhIy. He suggested the Park Cor�missian send a representative to the meetings. Witson suggested that Erickson vr VVelles be considered to represent the Commission. Gappa indicated that the ne�meeting is the first Wednesday in August, which follaws the Perk Commission Meeting of August 6, allowing a representative ta be chosen at the Augusi meeting. Gap�a reported that the reeognition of Bruce and Ruth Dayton will be made at the July 14 Council Meeting. It vuas suggested that all members who can attend come to the meeting.
