ISSUE - Updating Council on staff efforts with regard to the fuel
leakage problem.
INTRODUCTION - At the Council's last meeting Bill Wear discussed
the letter he had given the City in regard to the fuel leakage
that continues on his property at 2160 Wayzata Boulevard. He had
indicated in Attachment A the difficulty he had in dealing with
the Pollution Control Agency in this matter.
DISCUSSION - The Orono City staff and independently the City of
Long Lake have been trying to contact Pollution Control Agency to
discuss the problem. The particular situation handled at this
property back in April was handled by an individual who has
subsequently left the Pollution Control Agency. Although the PCA
is presently attempting to reorganize to handle these types of
problems and there is an indication that they have been given up
to a million dollars from the Federal Government to handle
leaking underground storage tanks, which is obviously the suspect
in the particular leakage. Because of the efforts of the two
communities to date have not resulted in any concrete action on
the part of PCA, Attachment B was transmitted to the PCA on July
20, 1987.
RECOMMENDATION - Staff is continuing to work on this problem to
have PCA take corrective actions outlined in Attachment B and
will be updating the Council at their next meeting as to any
progress .
PROPOSED MOTION - Moved by , seconded by , to accept staff's
information regarding the fuel leakage at 2160 Wayzata Boulevard.

Honorable Mayor and City Council Members :
On April 1, 1987 the Orono Police and Long Lake Fire Department
were called to Ay building at 2160 West Wayzata Boulevard to
investigate a strong smell of gasoline. The fire department
found gasoline seeping into a monitor well on the east side
of my building.
The PCA were called in, and I assume they called their emergency
contractor, Bay West. My tenants in the immediate area closed
their businesses and Bay West ventilated the well and removed
the gasoline. Bay West drilled test wells around my building,
with negative results . At this point PCA and Bay West ordered
that my tanks be uncovered and tested.
Theiests% of my tanks proved them to be sound and not leaking.
However, gasoline is still present on my property and is still
flowing into my monitor well from someone elses land. I am ,
still pumping gasoline from my monitor well, but it is a slow
process due to the fact gasoline continues to flow in as I
pump it out. Also there are four 55 gallon drums of gasoline
on my property that I would like to have removed but neither
the drums nor the hazardous material inside belong to me.
I feel action must be taken to find the source of this gasoline
leakage which I feel is a significant and serious hazard. Long
Lake and Orono must not put our soil and most importantly our
water supply in jeopardy.
If the source of the leak cannot be found I would like to ask
the help of Orono and Long Lake in applying for "super fund"
monies as the hazard was not created or encouraged by me.
The expense as of July 7th are in excess of $20 , 000 . 00.

Dear Mr. Kable:
On July 14, 1987 , I spoke with your department on the above subject
property. I would like to review the situation again to you.
1. On April 1, 1987, there was a gasoline leak at 2160 Wayzata
Boulevard.
2. Clean up was ordererd due to the hazards involved - Baywest was
cotacted by the P.C.A. to do the clean up.
3. Gasoline tanks were tested (Petro Tite Test), and pursuant to NFPA
criteria, the tanks passed.
4. The cause of the leak has not been found, leaving the site with no
responsible party.
5. The leak has continued without the P.C.A. monitoring it or looking
into where the gasoline came from.
6. 4-55 gallon drums are on the site marked "flamable", and no
one to claim them.
I am requesting you to continue to pursue the source of the leak and
remove the 4-55 gallon drums and any other materials that pose a pollution
problem to the health, safety and welfare of the public. If you have any

Issue - Informational update and acceptance of request from property owner
for possible assistance in applying for superfund monies to assist in the
situation.
Introduction - As noted in Attachment A, there has been the issue of fuel
in the soil in the area of the Orono Shopping Center. While the original
critical public safety issue has been reduced, the monitoring wells
continue to show presence of fuel in the soil. Despite tesing of existing
tanks on the site and additional monitoring wells on the site, the source
has not been found. Given that suspected sources have proven not to leak,
the PCA and the property owner continue attempts to determine the source.
As noted in the letter, the property owner is reaching a point where he may
request superfund assistance and would like the two cities to help in the
application.
Recommendation - It is recommended that the City of Orono discuss with the
PCA and other agencies involved in this situation the appropriate role the
City could play should the owner apply for the funds.
Additionally, the staff will work with the PCA to have the 55 gallon drums
moved to an appropriate location. The staff will continue to monitor the
progress to determine the source and solutions to problem correction.
PROPOSED MOTION: Moved , seconded _, That the Orono City Council
accept the information from the property owners regarding the possible
request for assistance and should the application be made, have the staff
bring the issue back regarding the City' s recommended assistance.
Additionally, the Council acknowledges staff's efforts regarding continued
monitoring the situation and work to remove the 55 gallon drums on the
