The City has denied your permit because of incidents that occurred on 04-15-02. The following is a list of violations that occurred. 1. Burning without a valid permit (Last permit had expired on 01-07-02). 2. Burning in several locations without any one attending the fires. 3. Burning without a water supply available. 4. Allowing the fire to burn uncontrolled Per Orono Municipal Ordinance 167, open burning permits will be denied for a period of six months. Resident at mOId Long Lake Road was concerned because of smokeash and hot embers that were being blown around in the area. Upon arrival to the area.I noticed that there were several areas that were being burned on the property of the Wayzata Country Club. A large area near Old Long Lake Road and the Luce Line was a concern. Smoke ash and embers were being blown to the north and the fire was not being attended to. I spoke with one emploee who said that they had one person watch the multiple areas,but he had retumed to the shops. Wayzata Fire responded and was also concerned due to the multiple areas that were burning and no one was watching them. We spoke to the manager Distel Robert. Mr.Robert had a very poor attitude toward us being there. We advised him of the complaints and asked him if he had a permit to burn. Roberts said he contacted our office in the morning and notified them of the burn. I asked him if he had read the requirements of the permit regarding to providing a w iter supply and to have the fire be watched. He said that he was watching it. There were several areas that were burning,some of them several hundred yards soar. No water supply was available. The smoke was blowing toward several houses. Had two other residence speak to the firefighters about the problem. I ads ised Roberts that no more areas could be lit on fire until tomorrow. In checking with the city offices,the Wayzata CC did not have a current permit and could not burn. I returned to Wayzata CC and spoke withRoberts about the illegal burn. He showed me a copy of the permit he had and it showed that it had expired in Januar of 2002. I advised him that charges for burning without a permit was being looked at and that he could not burn any more unless he obtains the proper permits. B. C. D. FOR THE PURPOSE OF BURNING THE FOLLOWING ITEMS are to be completed before the inspector arrives. Sites inspected subject to availability of staff time. (If inspector has to re-inspect site because items were incomplete, there will be a $20.00 charge per re-inspection): 1. Site address must be posted and visible from the street. Where more than one house is served by the same private driveway or unnamed private road, additional sets of numbers shall be placed at every fork or other driveway as necessary to direct traffic to every house including the house farthest from the street. 2. Burn pile must be staked at bum site meeting the following: A. Small Brush Disposal Fires (>2 Acre Lot Size) C. Recreational Fires (All Lot Sizes) - Minimum 75' from Buildings -Minimum 50' from Buildings - Minimum 50' from Lot Lines - Minimum 25' from Lot Lines - 8' Maximum Diameter, 4'Maximum Height - 3' Max. Diameter, 3'Max. Height - 60 Day Permit - Annual Permit - Inspection is required for each burn - Inspection required before permit issuance. -Notify both the Police and Fire Departments - An inspection is not required for each burn for each burn -Notify Police Department only for each burn B. Large Brush Disposal Fires (> 5 Acre Lot Size) D. Prairie Management Burns -Minimum 75' from Lot Lines - 90 Day Permit - 15' Maximum Diameter, 6'Maximum Height - Approved Prairie Management Companies - 60 Day Permit -Minimum 50' from Buildings -Inspection is required for each burn -Notify Police Department only for each burn -Notify both the Police and Fire Depts for each burn - Inspections required before permit issuance. 3. Draw a map on the back side of application locating the burn pile on your property. 4. If these conditions are not met, the permit will be denied and you may not apply for another permit for 30 days. 5. No permit fee is required except for more than 3 permits for brush disposal fires per year. All organizations and individuals regardless of tax status will be charged a S100.00 annual fee for more than 3 brush disposal fire permits per year. VIOLATIONS OF PERMIT CONDITIONS MAY SUBJECT PERMITTEE'TO CRIMINAL AND/OR CIVIL ACTION ALL BURNS MUST BE REPORTED including bums on evenings and weekends to the Orono Police Department during regular business hours and a minimum of 30 minutes before burning, (952)249-4700(8:00-4:30,Monday- Friday). For Small and Large Brush Disposal Fires,in addition to the Police Department,the Fire Department must be notified - Long Lake (952-473-9701),Maple Plain (763-479-0506),Mound (952-472-3555)or Wayzata (952-404-5337). SPECIAL CONDITIONS: Call 651-772-7930 no more than 1 hour prior to burning for DNR recorded message. • e " • . - 11111 ORDINANCE NO. 167 ,SECOND SERIES AN ORDINANCE REGULATING OPEN BURNING WITHIN THE CITY OF ORONO The City Council of Orono ordains as follows: Section 1. Section 9.30 of the Orono City Code is hereby deleted. Section 2. The Orono Code is hereby amended by the addition of Section 9.30 as follows: Open Burning. Subd. 1. purpose. The purpose of this section is to establish permitted categories of open burn events within the City of Orono and provide for a permitting process for burning. Subd. 2. Definitions. For the purposes of this section,the terms defined herein have the meanings given them. 1111 a. Open Burning. Open p n burning means the burning of any matter if the resultant combustion products are emitted directly to the atmosphere withoutpasssine through a stack,duct or chimney. Open birrnin,includes Recreational Fires,&mall Brush Disposal Fires, and Large Brush Disposal Fires, fires for fire department training purposes,and fires for maintenance of native prairie areas. b. Recreational Fires. Recreational fires are allowed on any size lot provided that all other permit conditions can be met. Recreational fire means a fire set with approved starter fuel no more than three (3)feet in height and diameter, using dry, clean wood;producing little detectable smoke,odor or soot beyond the property line; conducted with an adult tending the fire at all times; for recreational, ceremonial, food preparation or social purposes; extinguished completely before quitting the. occasion;and respecting weather conditions,neighbors,burning bans,and air quality so that nuisance, health or safety hazards will not be created. Approved mobile cooking devices such as manufactured hibachis, charcoal grills,wood smokers and propane or natural gas devices are not defined as recreational fires. Recreational Fire Sites shall not be located closer than fifty (50) feet to any structure or twenty-five (25)feet from any lot line. An adequate water supply for fire suppression purposes must be provided. 10 • 1 c. Small Brush Disposal Fires. A minimum lot size of 2 acres is required for small brush disposal fires. Small brush disposal means a fire set with approved starter fuel no more than 8' in diameter and 4' in height using any clean dry wood, producing minimal smoke, odor or soot beyond the property line;conducted with an adult tending the fire site at all times; extinguished completely before leaving the site; and respecting weather conditions, neighbors,burning bans, and air quality so that nuisance,health or safety hazards will not be created. Small Brush Disposal Fire Sites shall not be located closer than seventy-five (75) feet to any structure or fifty (50)feet from any lot line. An adequate water supply for fire suppression purposes must be provided. Only materials generated on site may be burned. Burning of materials brought onto the property from other sites is prohibited. d. Large Brush Disposal Fires. A minimum lot size of 5 acres is required for large brush disposal fires. Large brush disposal fires means a fire set with approved starter fuel no more than 15' in diameter and 6' in height using any clean dry wood, producing minimal smoke, odor or soot beyond the property line; conducted with an adult tending the fire site at all times; extinguished completely before leaving the site; and respecting weather conditions, neighbors, burning bans, and air quality so that nuisance,health or safety hazards will not be created. Large Brush Disposal Fire Sites shall not be located closer than one hundred fifty (150) feet to any structure or seventy-five (75) feet from any lot line An adequate water supply for fire suppression purposes must be provided. Only materials generated on site may be burned. Burning of materials brought onto the property from other sites is prohibited. e. Fire Department Training Fires. A fire used for the purpose of fire department training under the conditions of a permit from the Minnesota Pollution Control Agency. f. Native Prairie Restoration Fires. Fires used for the purposes of Native Prairie Maintenance conducted under the supervision of qualified individ»als or firms specializing in this type of work. g. Starter Fuels. Starter Fuels means dry, untreated, unpainted kindling, branches or cardboard, or charcoal fire starter. Paraffin candles and alcohols are permitted as starter fuels and as aids to ignition only. Propane gas torches or other clean gas burning devices causing minimal pollution should be used to start an Open Burn. h. Wood. Wood means dry, clean fuel only as a twigs, branches, limbs, "presto logs," charcoal, or cordwood. "Wood" does not include wood that is green, with leaves or needles, rotten, wet, oil soaked, or treated with paint, glue or preservatives. 2 Subd. 3. Prohibited Materials. No person shall conduct, cause or permit open burning of refuse, leaves, oils, petro fuels, rubber, plastics, chemically treated materials,or other materials which produce excessive or noxious smoke such as tires, railroad ties,treated,painted or glued wood,composite shingles,tar paper,insulation, composition board, sheetrock,'wiring,paint or paint fillers. No person shall conduct,cause or permit open burning of hazardous waste or salvage operations, or open burning of solid waste generated from an industrial or manufacturing process or from a service or commercial establishment or building material generated from demolition of structures. No person shall conduct, cause or permit open burning of discarded material resulting from the handling, processing, storage, preparation, serving or consumption of food. Subd.4. Permit Required for Open Burning. No person shall start or allow any open burning on any property in the City of Orono without first having obtained an Open Burning Permit. Subd. 5. Purposes Allowed for Open Burning. Open Burn Permits may be issued only for the following purposes: • a. Elimination of fire or health hazard that cannot be abated by other practical means. b. Ground thawing for utility repair and construction. c. Disposal of vegetative matter for managing forest, prairie or wildlife habit_:. and in the development and maintenance of land and rights-of-way where chipping. composting, landspreading or other alternative methods are not practical. d. Disposal of diseased trees generated on site, diseased or infected nursery stock, diseased bee hives. e. Recreational Fires for recreational, ceremonial,food preparation or social purposes. f. Fires for the purpose of fire department training. Fires for training purposes require a permit from the Minnesota Pollution Control Agency and the City of Orono. Subd. 6. Permit Application for Open Burning and Permit Fees. Open Burning Permits shall be obtained by making application on a form prescribed and adopted by the City of Orono. 3 • An Open Burning Permit may require a non-refundable application fee. Permit fees shall be set annually by City Council Resolution. However,the City Council may at other times amend its Resolution setting the fees as it deems necessary. The fees established by City Council Resolution shall continue to be the required fee until amended by a Resolution. Fees collected shall be retained by the City•for administrative costs of issuing permits. Subd. 7. permit Process for Open Burning. Upon receipt of the completed Open Burning Permit application and permit fee, a City of Orono staff person shall determine that the requirements for open burning under this Code are satisfied. Thereafter, a Permit may be issued. a. Recreational Fire inspection requirements include an inspection of the bum • site by City staff before a permit is issued. Reinspection of the site is not required before conducting each burn within the permit time limits. b. Small and Large Brush Disposal Fires, Fire Department Training Fires, and Native Prairie Restoration Fires inspection requirements include an inspection, of the initial burn site,by city staff before a permit is issued. Reinspection of the site is required before conducting any additional burns within the permit time limits. c. Notification requirements include notifying the Orono Police Department for any open burn including Recreational Fires. For Small and Large Brush Disposal Fires, Fire Department Training Fires, and Native Prairie Restoration Fires in addition to notifying the Orono Police Department, the fire department having jurisdiction must also be notified. Subd. S. T irne Period for Permits. Permits for Recreational Fires are valid for one year from the date of issuance. Permits for all other fires are valid for 60 days from the date of issuance. Subd. 9. Hours for Open Burning. Open burning is allowed only during the hours between 7:00 a.m. and 11:00 p.m. Subd. 10. permit Holder Responsibility. Prior to starting an Open Burn,the Permit holder shall be responsible for confirming that no burning ban or air quality alert is in effect. Every Open Burn event shall be constantly attended by the Permit holder or his/her competent adult representative. The Open Bum fire shall be completely extinguished before the Permit holder or his/her representative leaves the site. It is the responsibility of the Permit holder to have a valid Permit, as required by this section, available for inspection on the site by the City staff, Orono Police Department, Minnesota Pollution Control Agency (MPCA), or Department of Natural Resources (DNR). 4 The Permit holder is responsible for compliance and implementation of all general conditions, special conditions and the burn event safety plan as established in the Permit issued. Subd. 11. Jevocation of Open Burning Permit. The Open Burning Permit is subject to revocation at the discretion of the Minnesota Pollution Control Agency, Department of Natural Resources, the applicable Fire Chief, City staff or Orono Police Department. Reasons for revocation include, but are not limited to: a fire hazard existing or developing during the course of the burn,any of the conditions of the Permit being violated during the course of the burn, pollution or nuisance conditions developing during the course of the burn, a fire smoldering with no flame present or burning of materials brought onto the property from another site. Revocation of an open burning permit will result in a 6 month moratorium for issuance of open burning permits for the applicant or subject property. Subd. 12. Denial of Open Burning Permit. If established criteria for the issuance of an Open Burning Permit are not met or during review of said application, it is determined that a practical alternative method of disposal of the material exists, or a pollution or nuisance condition would result, or if a burn event safety plan cannot be drafted to the satisfaction of City staff, then the City of Orono staff person may deny the Open Burning Permit application. Applications for an open burning permit within 6 months of the revocation of a previous permit will be denied. This 6 month moratorium will apply to both permits issued to the same applicant or for the same property. Subd. 13. Bunning Ban or Air Quality Alert. No Recreational Fire or Open Burn will be permitted when the City staff, City's Fire Chief,Fire Marshall, City's Police Chief or DNR has officially declared a burning ban due to potential ha7nrdous fire conditions or when the MPCA has declared an Air Quality Alert. Subd. 14. Rules Adopted by Reference. Minnesota Statutes 88.16 to 88.17 and 88.171 and Minnesota Uniform Fire Code are hereby adopted by reference and made a part of this Ordinance as if fully set forth herein. Subd. 15. Penalty. Any person violating any provision of this chapter is guilty of a misdemeanor and upon conviction, shall be punished by a fine and/or imprisonment. 5 • Subd. 16. Liability. Any person conducting open burning within the City of Orono shall be responsible for any costs incurred by the City, and fire department, and any . adjoining property owners, as a result of the bum, including,but not limited to, fire suppression costs,property damage, personal injury and administrative fees. • Section 3. Adoption and Publication. This ordinance shall be published in The Pioneer and The Laker newspapers and become effective immediately upon publication.
