A CONDITIONAL USE PERMIT
FOR WETLAND ALTERATION
PER ORONO CODE SECTION 78-1610
AND FOR LAND ALTERATION
PER ORONO CODE SECTION 78-966
AND
REVISING THE CONDITIONAL USE PERMIT
APPROVED BY RESOLUTION NO. 5819
FILE NO. 10-3447
WHEREAS, the Wayzata Country Club, a Minnesota nonprofit Corporation,
(hereinafter "the Owner") is the owner of the property located at 200 Wayzata Boulevard
West within the City of Orono (hereinafter the "City") and legally described in attached
Exhibit A; and
WHEREAS, the Owner has made application to the City for a conditional use
permit for land alteration and for wetland alteration to convert a ditch with wetland qualities
to a pond and to excavate three areas to provide for replacement of the wetland; and
WHEREAS, the Owner has made application the City to revise the
conditional use permit for wetland alteration approved by Resolution No. 5819 to change the
location of part of the replacement wetland; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on February 16, 2010, at which time all persons desiring to
be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:

1. This application was reviewed as Zoning File #10-3447.

2. The City's wetland consultant has reviewed the plan and finds:
a. The purpose of the wetland alteration is to convert a ditch to a pond that
will serve as a storm water pond.
b. The pond will treat the runoff upstream discharge area before it is
discharged downstream, ultimately flowing through Peavey Lake into Lake
Minnetonka.
c. Created wetland and wetland buffers will mitigate the loss of 0.19 acre of
wetland.
d. To offset the mitigation area proposed to be abandoned an equivalent area
of wetland and wetland buffer has been created.
3. The Planning Commission reviewed this application on February 16, 2010 and
on a vote of 5 - 0 recommended approval of the conditional use permit.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the owners and the public, and the effect of the proposed
conditional use on the health, safety and welfare of the community as well as
the impact on properties in the vicinity.
5. The City Council finds that granting the conditional use permit is in accord
with the objectives and purposes of the RR-1B zoning district in which the site
is located and of the City's wetland protection regulations as well as with the
comprehensive municipal plan. The City Council also finds the proposed
wetland and land alteration would not be detrimental to the public health,
safety or welfare, or materially injurious to properties or improvements in the
vicinity.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a conditional
use permit for wetland alteration and for land alteration to convert a ditch with wetland

qualities to a pond and to excavate an area to provide for replacement of the wetland, subject
to the following conditions:
1. Council approval is based on the plans submitted by the applicant and attached to this
Resolution as Exhibit B. Any changes or amendments to this plan will require further
Planning Commission and City Council review.
2. Provision of the standard flowage and conservation easement and restrictive
covenant over the wetlands and wetland buffers or equivalent.
3. Provision of an additional $1,500 escrow and a revised escrow agreement to guarantee
planting of the wetland and buffers as described in the plans attached to this resolution
as Exhibit B and the plans attached to Resolution No. 5819 as Exhibit B.
4. Issuance of a permit or conditional approval of a permit by the Minnehaha Creek
Watershed District.
5. Authorities granted by this resolution run with the property not with the owner, but are
permissive only and must be exercised by obtaining a land alteration permit before
February 22, 2011 or grounds will exist for revocation of the conditional use permit.
6. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.
7. The undersigned Owner has read, understand, and hereby agrees to the terms of this
resolution and on behalf of the owner and the owner's successors and assigns, hereby
agrees to the recording of this resolution in the chain of title of the property.
In addition the Orono City Council hereby revises Resolution No. 5819 to delete as a
mitigation area Mitigation Basin C as shown on page 6 the plans attached to the Resolution as
Exhibit B replacing it with part of Mitigation Basin as shown on the plans attached to this
Resolution. Resolution No. 5819 otherwise remains in force.

the West 1/2 of the Northwest Quarter of Section 1, Township 117, Range 23 and that
portion of the abandoned road formerly known as County Road No. 27 which separated Lots
59 and 63, Auditor's Subdivision Number 184, Hennepin County, Minn., from Lots 60 and
64, said Auditor's Subdivision lying between the Southerly extension of the East line of Lot
