A RESOLUTION
GRANTING A CONDITIONAL USE PERMIT
FOR AN ADDITION TO
THE MAINTENANCE BUILDING
PER SECTION 78-418(4)
FILE NO. 09-3432
WHEREAS, the Wayzata Country Club, Inc., a non-profit corporation,
(hereinafter"the Owner") is the owner of the properties located at 200 Wayzata Boulevard
West within the City of Orono (hereinafter the "City") and legally described as:
Attached as Exhibit A; and
WHEREAS, the Owner has made an application to the City of Orono for
approval of a conditional use permit to allow a 12' x 44' addition to the maintenance building
addressed as 430 Old Long Lake Road; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hearing on October, 19, 2009, at which time all persons desiring to
be heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#09-3432.
2. The Planning Commission reviewed this application on October 19, 2009 and
on a vote of 5 - 0 recommended approval of the conditional use permit based
on the following findings:
a. The maintenance building has existed on the property for many years and
is undersized for the current needs.

b. It is the intent of the Owner that the addition be a temporary fix to
accommodate additional office and restroom spaces while a permanent
solution is developed.
c. The addition will be painted to match the color of the existing maintenance
building.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the owners and the public, and the effect of the proposed
additions on the health, safety and welfare of the community as well as the
impact on properties in the vicinity.
5. The City Council finds that the proposed additions are in accord with the
objectives and purposes of the RR-1B zoning district in which the site is
located and with the comprehensive municipal plan and that the proposed
additions would not be detrimental to the public health, safety or welfare, or
materially injurious to properties or improvements in the vicinity.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a conditional
use permit for a 12' x 44' building addition, subject to the following conditions:
1. Council approval is based on the site plan submitted by the Owner and annotated by
City staff, attached to this Resolution as Exhibit B. Any changes or amendments to
this plan may require further Planning Commission and City Council review.
2. The addition shall be painted to match the existing maintenance building.
3. Authorities granted by this resolution run with the property not with the Owner, but
are permissive only and must be exercised by obtaining building permits before
December 14, 2010 or grounds will exist for revocation of the conditional use permit.
4. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.

5. The undersigned Owner has read, understands, and hereby agrees to the terms of this
resolution and on behalf of the Owner and the Owner's successors and assigns, hereby
agree to the recording of this resolution in the chain of title of the properties.
Adopted by the Orono City Council on the 14`" day of December, 2009.
