Dear Mr. Serena:
Due to the extremely wet year, we realize that the required repair of your septic system may
have been difficult to complete last summer. This is a reminder that the septic system repair
will be required next year.
A licensed septic contractor must get a permit from the City of Orono by July 15, 1994 for the
repair of your septic system. The procedure for completing septic system repairs is shown
below. Please contact me at the City offices if there are any questions.
PROCEDURE FOR SEPTIC SYSTEM REPAIR
1. Hire a Site Evaluator/System Designer to do the soil testing and system design.
2. Submit the design to the City for approval.
3. Once the design is approved, have one or more contractors bid on the approved design.
4. The contractor you choose should then obtain a permit from the City before starting work.
He will call the City for the required inspections.

Dear Kamil:
Earlier today I received a visit from a member of Ostrom Construction (the builder who performed the
renovation) who explained that you wanted them to examine the roof. After viewing the cedar shake
locations which exhibit silicone and other waterproof caulk, he informed me that none of it had been
applied during the roofs installation(ref. my letter dated 05, Aug. '93). He also told me that a portion of
it had been applied by them,at your request,after a leak had developed.
In addition, there is one area which is covered with what appears to be white or gray asphalt caulking
compound; something which he is sure was not applied by the builder at any time.
At this time I want to remind you that the thirty day period before we begin arbitration expires August 30,
1993;and you have yet to address the problems with the septic field.

Pursuant to our telephone conversation earlier this week; we are ptoceeding with actions against the
previous owner to correct the septic problems. As soon as we come to a settlement, repairs will begin.
As more information becomes available I will advise you.

Dear Kamil:
In the six months since my wife and I have purchased the above referenced property from you, we have
discovered several major leaks in the roof, and have been informed by the City of Orono (dated 07-06-93)
that we must replace the septic system within 90 days . Prior to the closing (01-29-93)you signed a Real
Estate Transfer Disclosure Statement (dated 11-12-92) which indicates that the roof is less than four
years old with no history of leakage; and that there has been no history of septic leakage or other
problems. Since we were buying the house during winter months, we realized neither of these problems
would have been immediately apparent. I questioned you specifically about the integrity of these systems,
and you assured me that they were in perfect condition.
Two independent roofing contractors have inspected the roof and found evidence of silicone caulk in the
areas which leak,indicating prior knowledge of these conditions.
Independent inspection of the septic system indicates that it had not been pumped in at least four years;
and records from the City of Orono indicate that they had notified you of septic leakage as far back as
1990. In addition, Art Fries, longtime gardener for the property, states that the leakage from the septic
field has been forming damp, muddy depressions in the northern lawn directly over the field for "several
years".
Estimates place the costs of these repairs at approximately $15,000.00 [FIFTEEN THOUSAND
DOLLARS]. Please contact me within next thirty days to make arrangements for completing these
repairs, or I will submit this complaint and all pertinent documentation to the Minnesota Association of
Realtors for arbitration as per the purchase agreement, lines 135-148.
