Non permitted events will not be allowed. 5 Sec.13.04 RIGHTS OF SUBJECTS OF DATA Subd. 1. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd.2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a)the purpose and intended use of the requested data within the collecting state agency,political subdivision,or statewide system;(b)whether he may refuse or is legally required to supply the requested data;(c)any known consequence arising from his supplying or refusing to supply private or confidential data;and(d)the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13.82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority,an individual shall be informed whether he is the subject of stored data on individuals,and whether it is classified as public,private or confidential. Upon his further request,an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and,if he desires,shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning,the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making,certifying,and compiling the copies. The responsible authority shall comply iimmediately,if possible,with any request made pursuant to this subdivision,or within five days of the date of the request,excluding Saturdays,Sundays and legal holidays,if immediate compliance is not possible. If he cannot comply with the request within that time,he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays,Sundays and legal holidays. Subd.4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right,an individual shall notify in writing theresponsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a)correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data,including recipients named by the individual;or(b)notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to contested cases. With regard to the untreated sills installed in the screen porch; I have been unable to locate any treated 2x6 materials on the jobsite despite having purchase records. I can only assume there was a problem with delivery. The sills rest on an average 10"depth 4000#floor mix, and are secured with 1/2"anchor bolts and liberal quantities of PL-400 construction adhesive. According to the 1988 UBC General Construction Requirements §2516, ¶7,Wood and earth separation(unrevised): "... Where located on concrete slabs placed on earth,wood shall be treated wood or wood of natural resistance to decay.Where not subject to water splash or exterior moisture and located on concrete having a minimum thickness of 3 inches with an impervious membrane installed between concrete and earth,the wood may be untreated and of any species" As indicated in the attached drawing SK-3,the sill will be protected from contact with splash and exterior moisture. In a conversation with technical representatives from ChemRex Inc., manufacturers of PL adhesives and sealants, I was informed"PL-400 is a solvent based, synthetic rubber compound which, upon curing,passes or exceeds moisture penetration requirements"(see attached white paper). I hope that this information will fulfill Orono's requirements for an accessory use structure such as the pool house in question. The City's position is that the plates are required to be of treated lumber. The first sentence refers to concrete slabs placed on earth, your screen porch is not on a slab place on earth, it is a slab on a foundation. I agree that PL-400 is a vapor barrier. However, I have never seen anyone completely coat a member before it is glued down. The code section you quoted refers to wood not subject to water splash, I think the bottom plates of a screen porch is subject to water splash. It also refers to an impervious membrane between concrete and earth. Your existing foundation is lacking this item also. Therefore, the City must enforce the Building Code on this matter. Orono, MN. 55356 RE: John Serena 4605 Watertown Road Orono, MN. Dear Lyle: I was contacted by John Serena to visually inspect a pool house project he is constructing on his property at 4605 Watertown Rd. in Orono. I met with John on Thursday July 30th. and he explained to me how this was a existing structure that he was remodeling into a pool house. He had submitted to the city of Orono the required documents to get a building permit and it was issued to him. I was able to inspect a majority of the framing of the walls and roof system. Portions of roof and wall framing were covered by finish material. I was not able to inspect the framing at the center post and rafters, however John explained to me how it was framed and it sounded like that system would be very sound structurally. It is my opinion that the wall framing was done following normal and sound construction practices . The roof framing system using a center post supporting rafters and tied together using collar ties at 4' -0" centers is a structurally sound system and would support snow loads encountered in Minnesota. The interior transverse ceiling boards will also help to stiffen the roof system. John has used very sound construction procedures and his building should meet the requirements of the State Of Minnesota Building Code and building codes used in the city of Orono. I have 23 years of structural experience in various fields such as bridge design, bridge construction inspection, timber frame construction, timber frame design. My current position is the Engineering manager for a Treated Timber Supplier in St. Louis Park MN. They supply treated timber materials for bridges, salt storage buildings, miscellaneous buildings, along with the design necessary to get permits, bidding documents, etc. necessary to proceed with the project. I have not seen or reviewed any design calculations for this pool house project, so my inspection was only visual and in my opinion the construction practices generally comply with industry standards for this type of construction. ! r " If you have any questions of comments regarding this inspection, you can call me at 612-955-1953 Sincerely, David J.
