Planning & Zoning Administrator <br /> DATE: January , 1996 iipelL <br /> SUBJECT: Kip Nelson, 4560/4580 Watertown Road - Change in Septic Billing <br /> Units - Request for Credit <br /> Attachments: - Letter of Request <br /> - Septic Inventory Card <br /> - Guest House CUP Resolution <br /> Kip Nelson, owner of 4580 Watertown Road, has requested that his septic system inspection <br /> program billing be revised from two units to one unit. His request is based on the fact that <br /> both the guest house on his property (which is currently billed as 4560 Watertown Road) and <br /> his residence at 4580, are connected to a single septic system. <br /> In reviewing other similar situations in the City, of which there are just a handful, it would <br /> appear to be consistent to bill just one septic unit to this property. <br /> Mr. Nelson also requests that his past payments for the second unit be credited towards future <br /> septic billings. <br /> I have not attempted to confirm, but will assume for discussion, that Mr. Nelson has been <br /> billed for two units since the septic program began. This may have been an oversight, since <br /> Nelson has not previously brought it to the City's attention, or it may have been a policy <br /> decision made early on. However, based on current practice and policy, we are only billing <br /> one unit for other similar situations staff is aware of on Orono Orchard Road and Fox Street. <br /> I am not familiar with City policies regarding credit or repayment of billings which were <br /> (arguably) in error. The fact that Mr. Nelson did not notify the City of this billing issue until <br /> December 1995, when it should have been fairly obvious to him for many years, is somewhat <br /> confounding. <br /> To resolve the situation I would recommend the following: <br /> 1. Since he notified us of the discrepancy in 1995, it would be reasonable to <br /> forgive the 1995 overpayment. <br /> 2. Since the 1995 past due billing for the entire property has been certified for <br /> collection with his taxes, bill the entire property no units for 1996 and then <br /> merely one unit for 1997 and thereafter. <br /> ch <br />
