The proposal appears to show modifications and/or expansions in some areas, however it is not clear enough for our review. As stated in our November 3, 2015 letter we still need the following items to be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Wetlands. Based on our available information, it appears there is a wetland within the property. This wetland appears to be located within 150 feet of the proposed project. According to Orono City Code Section 78-1605 (copy enclosed) a wetland delineation is required for projects within 150 feet of a wetland; a 35-foot setback is required from any delineated wetland edge for structures or hardcover. Contact a wetland delineator to conduct a wetland delineation. The delineation report must be submitted to the Minnehaha Creek Watershed District (MCWD) for their approval. Following the MCWD approval, the location of the delineated wetland edge and 35-foot setback must be shown on a survey. 2. Certificate of Survey. The copies of the survey submitted do not meet the City's survey requirements(see Ord. No 152, enclosed). Please provide two copies of an updated, full size certificate of survey which meets all of the City's survey standards(enclosed) indicating the location of the existing and proposed driveway;proposed sidewalks;delineated wetland edge;and 35-foot wetland setback. Please note,our engineer has not reviewed the plans submitted,so additional comments may be forthcoming. 3. Landscape Plan. Will there be any other changes to the landscaping? If so,the City requires a landscape plan be submitted showing all the proposed exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls, etc. The plan should include the name of the individual performing the work. Any proposed patios,grading,sidewalks,retaining walls,etc.shown on the landscape plan must also be shown on the survey. 4. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is$2,000. Section 86-68 of the City of Orono Municipal Code is hereby amended by adding and deleting text within Sections 86-68 (b) as follows: (b) Surveys required: (1) Initial survey or site plan. Any building, zoning or general permit application for construction of a new structure, or expansion of an existing structure or land alteration shall be accompanied by a certificate of survey or site plan drawn to scale prepared by a person registered by the Minnesota Board of Architecture, Engineering, Land Surveying, Landscape Architecture, and Interior Design. A certificate of survey or site plan shall conform to the City of Orono Survey and Site Plan Requirements. a. The certification of the plan by a licensed professional may be exempted by the city engineer if the project meets all of the following: 1) An existing survey accurately describes existing property conditions; 2) Proposed project exceeds the setback requirements by 150%; 3) Proposed project footprint does not exceed 200 square feet; 4) Evidence that the Average Lake Shore setback is met is provided, and 5) Information necessary to ensure the project conforms to City codes and ordinances, including hardcover, grading, and landscaping requirements is provided. (2) Foundation survey. A foundation survey shall be submitted to the city for review and approval, unless exempted by the building official, upon completion of the foundation work for all buildings and all additions to buildings. The foundation survey, prepared by a Minnesota Registered Land Surveyor, shall certify the lot dimensions; front, side, rear, lakeshore, and wetland setbacks; and foundation elevation. A foundation survey must be submitted before proceeding with framing or further construction. In lieu of a survey a letter prepared by a Minnesota Registered Land Surveyor containing the same information as a foundation survey may be submitted. (3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land Surveyor, shall be submitted to the city for review and approval upon the completion of all buildings and all additions to buildings, unless exempted by the building official. The Page 1 of 2 as-built survey shall certify the final topography of the site; verify drainage patterns; and provide hardcover calculations for lots in the Shoreland Overlay District. An as- built survey must be approved before the issuance of a certificate of occupancy. In the event that weather or other conditions prevent the completion of an as-built survey at the time the Certificate of Occupancy is requested, applicant shall provide a sufficient financial guarantee and establish an escrow agreement to ensure completion of the as- built survey. SECTION 2. EFFECTIVE DATE: This ordinance shall take effect immediately upon its passage and publication. Page 2 of 2 Orono, MN Code of Ordinances Page 1 of 2 Sec.78-1605.-Wetland buffer areas and setbacks. (a) This subsection establishes authority for wetland buffer areas around protected wetlands. Buffer areas are necessary and beneficial to maintain the health of wetlands. Buffer areas protect the edge of wetlands from erosion while filtering sediment,chemicals and other nutrients from runoff that drains into wetlands. Buffer areas can improve the biological diversity and health of a wetland environment while reducing the adverse impacts of human activities. (b) All wetlands within the City of Orono are within the Minnehaha Creek Watershed District(MCWD),which has rules and regulations for the establishment and maintenance of wetland buffers. In an effort to avoid overlapping or conflicting regulations,the city defers jurisdiction for the establishment and maintenance of wetland buffers to the Minnehaha Creek Watershed District. If application of MCWD buffer regulations is in conflict with city regulations,the more restrictive requirements shall apply. (c) In order to provide for a minimum level of wetland protection where Minnehaha Creek Watershed District buffer rules do not provide for adequate separation between wetlands and buildings or other structures or surfaces,the city shall require setbacks from the delineated edge of a protected wetland as follows: Minimum distance setback from delineated edge of wetland to any building(principal or accessory)or other structure, hardcover, septic systems or wells: Where no formal buffer exists and where MCWD 35 feet does not require a buffer Where a formal buffer exists or where MCWD 35 feet or established buffer width plus 10 feet, buffer is required whichever is greater Areas within the required setback area subject to filling,grading or excavation as part of a construction project shall be revegetated immediately upon completion of such earthwork.Setbacks must be verified with wetland delineation information.The determination of whether a Level 1 delineation or Level 2 delineation is required shall be at the discretion of the planning director.Level 2 delineation information shall be provided on a certified certificate of survey.The requirement for delineation shall be applied in cases where the wetland exists within 150 feet of the proposed project. Staff conducted a preliminary review based on the information provided and recommends the following items be submitted or revised in order for your application to be considered complete and for the plan review to continue: 1. Wetlands. Based on our available information, it appears there is a wetland within the subject property. This wetland appears to be located within 150 feet of the proposed project. According to Orono City Code Section 78-1605 (copy enclosed) a wetland delineation is required for projects within 150 feet of a wetland;a 35-foot setback is required from any delineated wetland edge for structures or hardcover. Contact a wetland delineator to conduct a wetland delineation. The delineation report must be submitted to the Minnehaha Creek Watershed District (MCWD) for their approval. Following the MCWD approval the location of the wetland edge and 35-foot setback must be shown on a survey. 2. Certificate of Survey. The copies of the survey submitted do not meet the City's survey requirements(see Ord. No 152, enclosed). Please provide two copies of an updated, full size certificate of survey which meets all of the City's survey standards(enclosed) indicating the location of the existing and proposed driveway;proposed sidewalks;delineated wetland edge and 35-foot setback. Please note,our engineer has not reviewed the plans submitted,so additional comments may be forthcoming. 3. Landscape Plan. Will there be any changes to the landscaping? If so, the City requires a landscape plan be submitted showing all the proposed exterior/landscaping improvements, i.e. patios, grading, sidewalks, retaining walls,etc. The plan should include the name of the individual performing the work. The landscaping plan should be reflected on the survey. 4. Escrow&Escrow Agreement. Permits involving grading and/or review by the City's engineer require submittal of an escrow and an escrow agreement. The purpose of the escrow is to guarantee reimbursement to the City for out-of-pocket costs incurred during the review of your plans. Additionally this escrow will guarantee conformance with City Code Chapter 79 relating to erosion control and stormwater. The required escrow amount for this project is$2,000.
