A RESOLUTION GRANTING
A VARIANCE TO
MUNICIPAL ZONING CODE
SECTION 10.27, SUBDIVISION 5 (B)

WHEREAS, Richard O. Miller (hereinafter "the applicant") is owner of the
property located at 4520 Watertown Road within the City of Orono (hereinafter "City") and
legally described as follows:
The East one-half of the West three-eighths of the East one-half of the Northwest
Quarter of Section 31, Township 118 North, Range 23 West of the Fifth Principal
Meridian, lying north of the Watertown Road, Hennepin County, Minnesota (hereinafter
"the property"); and
WHEREAS, the applicant has applied to the City for a variance to Municipal
Zoning Code Section 10.27, Subdivision 5 (B) to permit the construction of a single family
residence on a lot containing 3.6 acres dry buildable area where 5 acres of dry buildable area
is normally required, and lot width 287.56' where a lot width of 300.0' is normally required.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #2089.
2. The property is located in the RR-1A, Zoning District, requiring 5.0 acres of dry
buildable area and 300' of width for a building site.
3. The Orono Planning Commission reviewed this application on November 20,
1995, and recommended approval of the proposed variance based upon the
following findings:

A. - The parcel would have been buildable without variances at the time the
applicant purchased it in 1972.
B. Applicant has demonstrated that suitable primary and alternate sites for
an on-site sewage treatment system exist on the property.
C. A single family residence can be constructed on the property meeting the
required lot line, wetland and drainfield setbacks.
D. Construction of a single family residence on the property will be in
keeping with the rural nature of the neighborhood.
E. The buildable envelope of approximately 140x400' provides ample arca
for 'construction of a single family residence, driveway (already

constructed), and on-site sewage treatment systems without impacting
neighboring properties.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicant; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants a variance
to Municipal Zoning Code Section 10.27, Subdivision 5 (B) to permit construction of a single
family residence on a lot containing 3.6 acres dry buildable area where 5.0 acres of dry
buildable area is normally required, and said lot having width of 287.56' where lot width of
300' is normally required, subject to the following conditions:
1. Applicant shall protect the tested and approved on-site sewage treatment system
drai.nfield sites from any traffic or disruption which could render them unusable.
2. No variances other than lot area and lot width will be granted for this property.
3. Authorities granted by this variance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council approval, or this variance will
expire on that date (December 11, 1996).

4. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
5. The undersigned applicant has read, understood and hereby agrees to the terms
of this resolution and on behalf of himself, his heirs, successors and assigns,
hereby agrees to the recording of this resolution in the chain of title of the
property.

SUBJECT: Variance application#2089, Richard Miller - Septic Review
The applicant proposes a new residence on a vacant lot requiring the use of on-site septic
systems. Soil testing has been provided by Don's Backhoe and Excavating indicating primary
and alternate sites exist for a five bedroom residence.
Review of the soil testing has been completed and proposed drainfield sites meet all City and
State Codes. Both drianfield sites are located on slopes less than six percent and meet all
hardcover and lot line setbacks. Soil mottling indicates a seasonal water table at depths
between 12 and 36 inches resulting in the use of "mound" drainfields.
Based on the soil testing, I would recommend approval of the application.

We were retained by Mr. Miller to evaluate this site for suitability of an individual sanitary
sewage treatment system to handle the sewage flow generated by water-use appliances within a
single family dwelling.
PROCEDURE
A total of six (6) soil percolation tests were performed on May 16, 1995 in areas to the northeast
of the proposed house. Three additional percolation tests were performed on November 10,
1995 to the west of the proposed house.
In addition , six(6) soil boring's were drilled with a 2" i.d.x 3 1/4" o.d. Hand auger to check for
the position of the ground water table and to identify the underlying soil types. Location of tests
and boring's are shown on the site plan. Three additional sil borings were drilled on November
12, 1995.
The percolation tests were performed in accordance with the provisions of"Minnesota Pollution
Control Agency Rules and Standards Chapter 7080". The percolation test holes were drilled to a
alternate mound depth of 12 inches with a 5" i.d. x 6" o.d. auger. Two inches of pea gravel were
placed in the bottom of each hole to prevent scoring. Water was then added to the test holes and
replenished as necessary,maintaining a saturation_,each hole was refilled to a 12-inch head of
water over the bottom,and the percolation tests commciccd.

The contents of this site evaluation and design report are to he applied to the property listed,
reprints for other applications only with the permission of Don's Backhoe and Excavating, Inc...
The soil conditions have been established at the test hole locations only. There may be
variations in soil stratigraphy between and around the boring's, and interpolation and
extrapolation of the results is not warranted.
All requirements of this design shall be followed in order for the system to perform up to the
designed capabilities
