Dear Mr. Wyatt:
This letter is in regards to the damage to your septic system by Northern States Power Company(NSP)
on or around December 20, 1999.
The existing septic system is a non-compliant septic system due to the fact that the drainfield does not
meet the required three (3) foot separation to the seasonally high watertable. A soil boring was
conducted by Orono City staff to determine the depth to the watertable. Due to the fact that the septic
system is non-compliant, the septic system will need to be replaced.
Orono Municipal Code does not allow an existing non-compliant septic system to be repaired. This
is found in Section 12.30, Subdivision 5, Letter C, Number 3:
"Existing non-compliant systems shall be replaced by code systems whenever such classification is
reasonably attainable. If a code system is not achievable due to soil, watertable, or lot limitations, the
ISTS may be replaced or repaired such that it becomes a compliant system."
The existing septic system cannot be repaired as per Orono Municipal Code. Orono Code requires that
a"code" septic system be installed. A septic design submitted by S-P Testing appears to meet all the
requirements of a "code" system required by Orono. The septic tanks will need to be pumped and
inspected by Orono Staff. The tanks can be used if they are water tight and of the appropriate size.
If the tanks do not meet both criteria, new tanks will need to be installed.
