Upon review of your permit application, engineering staff for the Minnehaha Creek
Watershed District feel your project is not currently addressed by either the District
Rules or the 1991 Wetlands Conservation Act. Therefore, the District is not
requiring a permit for the above referenced project.

Dear Mr. Oman:
I spoke with Mr. Loren Butterfield regarding a site in the
southwest corner of Section 32 , on the south side of the Luce Line.
It is my understanding that Mr. Butterfield is requesting City of
Orono approval for continuation of some type of peat mining
operation at this location.
There are no wetlands subject to DNR water permit jurisdiction on
the site, so no DNR Protected Waters Permit would be required.
I also discussed the site with Martha Reger, DNR Trails &
Waterways. Mr. Butterfield has a trail crossing easement from the
DNR. As long as Mr. Butterfield's activities are consistent with
the conditions of the trail crossing easement, DNR Trails &
Waterways has no objection to Mr. Butterfield's continued
operations at this site.

Dear Mr. Butterfield:
We have reviewed the information provided us about your project to
excavate approximately 2b0 cubic yards of peat from an unnamed wetland. The
project site is in the sW 1/4 SW 1/4 Sec. 32, T. 118 N., R. 23 W. , Hennepin
County, Minnesota.
Because this work is part of a continuing or seasonal excavation, a
Department of the Army permit is not required to do this work, provided that
the work is completed by September 24, 1994. You should submit a permit
application if you wish to continue excavating in this area after that date.
Because it appears that the excavation site is historically adjacent to Lake
Minnetonka, you would need to gptain an individual Department of the Army
permit to continue working at this site under the current rules. (An
application is enclosed. Note that many nearby sites, that are part of
smaller drainage systems, are covered by nationwide general permits that could
expedite our approval of such a project. In addition, we are working on
regional general permits that may simplify our review of such projects, even
at your current site. We will advise you of any changes in the need for a
permit if you submit an application or Contact our office about future work. )
This letter is valid only for the project referenced above. If any
change in design, location, or purpose is contemplated, contact this office to
avoid doing work that may be in violation of Federal law. PLEASE NOTE THAT
THIS CONFIRMATION LE'T'TER DOES NOT ELIMINATE THE NEED FOR STATE, LOCAL, OR
OTHER AUTHORIZATIONS, SUCH AS THOSE OF THE DEPARTMENT OF NATURAL RESOURCES OR
COUNTY, INCLUDING THE STATE WETLAND CONSERVATION ACT.
