The above-entitled matter came . on before The Honorable
Steven Z. Lange, Judge of District Court, at the Hennepin County
Courthouse, Minneapolis, Minnesota, on February 16, 1996 . It
appearing to the Court that each of the Defendants named in said
action have been duly served with the Summons herein, and that none
of them have appeared by answer, demurrer or otherwise, and that
. more than twenty (20) days have elapsed since the service of said
Summons; and that a Notice of Lis Pendens in said action was duly
filed in the Office of the County Recorder in and for said County
of Hennepin prior to the commencement of this action, the Plaintiff
appearing by his attorney, Thomas C. Grindberg, and there being no

appearance for any of said Defendants, the Court hereby makes the
following:
FINDINGS OF FACT
1. That Plaintiff, Richard Harry Evans, Sr. , aka R. Harry
Evans, aka Harry Evans is the owner in fee of the following
described real estate lying and being in the. County of Hennepin and
State of Minnesota:
That part of Government Lot 2, Section 11, Township 117
North, Range 23 West of the 5th Principal Meridian, which
lies westerly of the west line of Lots 1 and 2, N. J. Stubbs
First Subdivision in Lot 2, Section 11, Township 117, Range.
23, Hennepin County, Minnesota, and southeasterly of the
southeasterly right of way line of H. C. S. A. H. No. 15,
Plat 51, per .Document No. 4701348.
2 . That said property is in the possession of Plaintiff,
and has been inthepossession of Plaintiff since 1950 .
3 . Plaintiff' s possession of said property has been actual,
hostile and underclaimof right, open and notorious, exclusive,
and continuous since 1950 .
4 . That the claims of Defendants or each or any of them to
any right, title, estate, interest in or lien upon said property
are null and void.
5 . That said property is not assessed for taxation.
ONCLUSIONS OF LAW_
1. That Plaintiff, Richard Harry Evans, Sr. , aka R. Harry
Evans, aka Harry Evans is entitled to a judgment against Defendants
and each of them that he is the owner in fee of the following
described real estate lying and being,. in the County of Hennepin and
State of Minnesota:

2. That the adverse claims of the Defendants and each of
them, and of all other persons having or claiming any right, title,
estate, interest in or lien on the real estate described herein or
any of them to any right, title, estate, : interest in or lien on the
said real estate are null and void, and none of said Defendants
have any right, title, estate, interest in or lien upon said real
estate or any part thereof. -
3 . That judgment may be entered without the filing of an
Affidavit of the military status of the Defendants.
4. Thatjudgment shall be entered immediately ,
notwithstanding the automatic stay in Rule 125 of the General Rules
of Practice for District Courts.
