I have reviewed the permit application and have the following comments: • Bolton and Menk has reviewed the wetland delineation and concluded the report is complete. • Based on the Functional Assessment of Wetlands (FAW) Map,these wetlands are considered as Preserve Level and would trigger the Wetland Protection ordinance and require a 50' buffer. • Per the Wetland Protection Ordinance Sec 78-1601 & 1605 the code indicates a 50' buffer is required around the wetlands that are potentially adversely impacted apply. Based on the proposed grading and contours,this means only Wetland 1 is the only wetland which will be affected by the proposed project and will trigger the buffer requirement. • Please refer to Bolton & Menk's letter which outlines what is required for the buffer requirement, Item 4, a through e. Based on our review, we offer the following comments for your consideration: 1. The wetland delineation report is complete. 2. We concur with the findings of the report regarding the location,identification,and the boundaries of the three wetlands. 3. The report does need to be forwarded to the MCWD for dissemination to the Technical Evaluation Panel. 4. The Functional Assessment of Wetlands (FAW)Map indicates the wetlands located on site are classified as Preserve level. If the Wetland Protection ordinance requirements are triggered due to new development or redevelopment,the following should also be considered: a. The wetlands will require 50 foot buffers. b. Buckthorn and turf grass were found in the buffers and are considered to be undesirable plant species. The Owner will be required to remove these species from the buffer. In areas where turf is removed,native vegetation will need to be established. MnDOT seed mix 350 is recommended for upland buffer areas. c. A Landscape Plan including methods for removal and control of turf grass and buckthorn and a schedule of native vegetation establishment should be submitted for review. d. Wetland Buffer Markers should be placed at the upland boundary of the buffer edge, located at the lot lines and spaced a maximum 100 feet apart. e. Christine, I have reviewed the resubmitted survey dated 5/10/12 regarding the building application at 4115 Watertown Rd and have the following comments: • The survey cannot be hand drawn. The applicant will need to have the surveyor show the proposed contours on a signed survey. • The hand drawn submittal now shows the removal of an existing retaining wall and installation of a new wall. The survey needs to show the top and bottom elevations of the proposed retaining wall. If the wall is over 4' in height,the applicant will need to submit signed engineering plans and specifications for the proposed retaining wall. • The hand drawn survey also shows a proposed swale. This needs to be reflected on the survey with proposed contours. • Once we have an approved wetland delineation, Bolton & Menk will review the application for what is required for Orono's wetland/buffer regulations. There was no contact information on the paperwork I received; therefore I sent it to you as you are the last contractor contact we have on file for this property. I apologize for my assumption. We received the engineered plans for the walls on August 8. Attached is a building permit application. A buildingpermit is required rather than a zoning permit as I previously stated as the walls are require an engineer's design and review. Please have a representative from the company constructing the retaining walls complete the application. It must be submitted with 2 copies of an updated survey showing the proposed walls, noting top and bottom of walls as well as existing and proposed grades. Our engineer will review and provide any comments, if necessary. Building permit costs are based on the estimated construction value. Hand drawn copies are not sufficient. • The survey should indicate top and bottom of wall elevations and how the elevations will be tied into the existing grade. 2 • The details provided show each tier of the wall to be at 4' in height, but only show a separation of 4'. Tiered walls need to be separated by 2x the height or an 8' minimum separation. The separation will be measured from the back of the lower wall to the face of the upper wall. • Also each wall is shown to be 4' in height. I will be performing an on-site inspection of the walls as part of the final review. If either of the walls exceed 4' in height or if the separation (as defined above) is not separated by 2x the height (min),then the applicant will be required to provide engineered plans signed by a registered professional engineer.
