the approved plans and specifications,applicable City approvals,and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions of laws and ordinances governing this type of work
shall be compied with whether or not specified herein.This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance,or if construction is
suspended for a period of 180 days at any time after work has commenced.

An as-built survey was submitted on August 19th via email. However, according to a letter sent to you on
August 8th and subsequent follow up emails sent on August 31st(enclosed) we have not yet received all
of the requested information, specifically as noted in the Bolton & Menk letter dated 08/26/16 as follows:
1. The survey must be revised to show all contours shown on the approved grading plan dated
September 18, 2015. In addition, all improvements that have been made to the property must be
shown. Additional improvements include but are not necessarily limited to the following:
a. Landscaped berm along the west property line;
b. Well and other irrigation features;
c. Fountain; and
d. Limits of gravel surfaces.
2. Additional detail must be provided for the southwest corner of the property, including contours
into the neighboring property as shown on the approved plan. Additional detail must also be
shown to better define the overflow Swale to Watertown Road.
3. As shown on the approved plan dated September 18, 2015, the approved wetland boundary
must be shown on the survey along with the 2014 excavated area that was to be restored to the
original elevation of 997.5.
4. A significant amount of fill has been placed within the approved wetland boundary. Coordinate
with the Minnehaha Creek Watershed for immediate removal and restoration of the wetland.
5. The landscaped berm constructed along the west property is not an approved improvement.
Although attempts have been made to work with you to restore the drainage patterns along the
berm to pre-project conditions, drainage issues still exist. Therefore, the berm must be
immediately removed and the area must be restored to pre-project conditions.
6. Provide the cut and fill calculations both in and out of the wetland on the property.
Wetland Credits: In your most recent correspondence you acknowledge that you have put fill in the
wetland. This fill was not authorized, is contrary to your approved plan, and violates the law. Your most
recent correspondence indicates that you will be applying for wetland credits. Please be advised that the
wetland credits will not satisfy the approved plan. The fill must be removed.
On August 29th the City issued a permit for installation of a flagpole on your property. At that time you
were provided with the City's regulations regarding height which you acknowledged. As constructed the
flagpole appears to exceed the maximum 30-foot height limit and must be removed immediately.

The City has been attempting to work with you over the last f3 months to obtain the necessary as built
survey. If the items listed in my letter are not completed by September 21, 2016 I will initiate the
revocation of the CUP that was approved on June 22, 2015 and/or turn this matter over to our City
Attorney for criminal prosecution. Please feel free to contact me at 952.249.4627 or
