Dear Mr. Merideth:
I received your letter of November 30, 2007 in regards to septic systems for the two
houses. As you stated in your letter, the septic system for the main house is a 1996
mound system. This system would still require a point of sale septic certification when
you go to sell. The system for the guest/caretaker house is non-conforming and would
have to be brought up to code at the time of sale.
The only exception to this would be that if a buyer had no interest in occupying the house
at the time of purchase with the intent of tearing down the structure. The buyer would
need to provide in writing their intent and I would grant a one year moratorium on the
septic update. If they were to occupy the house then the system would need to be
updated and sized accordingly for the new house.

Dear Mr. Gibbs,
I received your letter of November 19 concerning a non-compliant SSTS. I have a
question about my property which is currently listed for sale.
There are two houses on my property. The main house has a newer septic system. The
smaller house, a guest house or caretaker's house, has a non-compliant SSTS. This house
is vacant and has not been used for about four years. I was told previously that this house
could not be occupied unless the septic system was replaced. I had planned to replace this
system. A new system was designed and approved by the city approximately four years
ago but was not installed because I decided to sell the property.New owners might want
to remove this house or use it only for storage.
Your letter states that a non-compliant SSTS must be brought up to code at the time of
property transfer. Does this apply for a secondary house such as this that may not be used
as a residence? If the new owners wish to use it as a residence, could a new septic system
be installed after the property transfer similar to the provision for property transfer during
winter conditions?
