In return for issuance of said Demolition Pennit, the undersigned owner hereby agrees as follows:
1. The structure(s) shall be kept enclosed avd/or secured until such time as demolition is
complete.
2. Demolition debris will be lcept�ff adjoining property and/or the public rights-of.-way unless
specific prior approval is obtained in writing for temporary use thereof.
3. Fotmdations shall be completely removed from the ground.
4. All demolition debris shall be completely disposed of off site in accordance with all
applicable PCA requirements.
5. Water wells must be abandoned in accordance with State Health Department regulations.
6. Sewer and water must be disconnected at the services at the street by qualified contractors.
7. Inspection required when all debris has been removed, before backfilling.
8. Within 5 working days of superstructure removal,a final inspection shall be requested. The
site shall be left clean and clear of all debris,with any excavation filled with earth level with
the adjacent ground elevation (except when such excavation is to be used as part of a new
building and such new building is actually under construction).
9. The undersigned owner shall and hereby does indemnify and hold harmless the City of
Orono, its agents, employees and assigns from and against all claims, damages, losses or
expenses,including attorney fees,against the City,its agents,employees and assigns arising
out of or resulting from the demolition described herein as performed by the property owner,
his employees, agents, subcontractors or assigns.
10. Septic systems must be abandoned per Minnesota Rules Chapter 7080. All septic tanks must
be pumped,crushed and filled with native soils. An inspection is required after the tanlcs are
pumped and before the tanks are crushed and filled.

To the property owner: Demolition of the principal dwelling structure on a
property may automatically terminate certain rights which may have accrued to the property by virtue of the
continued existence of that building.
• Rebuilding on a substandard lot of record (i.e. a lot that does not meet the zoning district required lot
area or width standards) will, with few exceptions, require variance approval by the City Council, and
such approval is not automatic nor guaranteed but requires that a hardship be demonstrated.
• Additionally, all current zoning standards will have to be met by the new principal dwelling including
setbacks, lot coverage by structures, hardcover (impervious surface), height limits, etc.
• Where municipal sewer is not available, provision of two (2) sites far a conforming on-site sewage
treatment system is mandatory.
• Unless specifically approved by the City, all accessory structures must be removed at the time of
principal dwelling demolition. This also applies to seasonal and permanent docks,which may not be
re-installed until a new principal dwelling has reached the framing stage.

1.0 INTRODUCTION
1.1 PURPOSE AND SCOPE
This report presents th� results of the envirvnmental evaluativn compfeted by Apex
Environmental, Inc. (APEX) of the listed property on Juhe 16, 2006.The purpose of the
environmentgi evaluation was to determine the potential praaence of asbestos within
the buiidings lacated on the referenced property scheduled for remade6ng, or
demolition. Mr. Erickson of APEX periormed the on-site investig�tinn and ewaluation.
See Appendix A for the appropriate cert�cations. During the investigation APEX
identlf;ed, sampled, and analyzed suspect or presumed Asbestos Containing Building
Materials (ACBM).
1.2 LIMITATIONS
Although Apex put forth a detailed and conscientious effart to identily ACBMs at the
site, ceRain variables may affect the idendfication of ACBMs within a bui�ing to a
signif�ant degree. Survey evaluetions w�re preformed only in exposed and/or
accessible building ar�s, which were readily accessible and safe for entry. APEX did
not collect samples from the roof, flr�e doors, �lectrical wi�s, insulators and/or other
m�terials that may have damaged or jeoparclized the ir►tegrity of the facilities structure.
The samples taken were representative af the suspect matetials, but do not preclude
the presenoe of a�besb�s in other similar materia�. If ihere is a question or cbncem
whether a mafieri�l oontains asbestos,Apex r�ecommends further testing ta►asc:ertain
asbestos content of the suspect material. Apex report was prepared in au;onia�ce
with the proposal, scope of w�ork, arrd Apex's general be►ms and condNions. No�ther
warranties, represent�tions, or certifications er+e m�de.
2.0 METHODS AND PROCEDURES
(3ENERAL SURVEY M�YHODS
A certified inspector perForrned the buitding inspeclions atuf sampling acfivities. A
walk-through survey of the tacility was first conducted to identify suspect materials and
potential areaa of concem to develop a sampling strateqy. Each sample was
assigned a unique sample idantification number that was written an the sampling
media. GeneraNzed sample locations and analytical r�su�s are documented in the
appropriate Survey Tabies in Appendix A.

feesible to scoess ail areas of a building untii dem0lition oocurs. Therefore Apex can not
be heid responsible for the pr�ence of anyuch hidden materials. The demolition
contractor and other contractors involved in the project shoukl sample and analyze
suspect hazardaus materi�ls exposed during their a�ivities, prior to any disturbance.

for the presenoe of ACBM, and PCBs. Samples of suspect mat�er'ial� were oolleCted
from random access�le areas where materiels were observed or assumed to be
p�+esent. The Survey Tables in Appendix A addr+ess only those areas wher�s suspect
ACBM was observed and sampled. tn general, Apex beiieves that all relevant and
representative ar�as of the facility were accessed and �specc:ted.
2.2 SAMPLING PROTOCOVMETNODOLOGY
ASBESTOS
Suspect andlor presumed ACBM was obsen�d in the referenced building. The
mater�als which were identified and sampl�d during the on-aite investigation are
documented in the appropriate Sutvey Tables in Appendix A.
Sampling and analysis of the suspect materials were conducted as part of the
environmental evaluation prior to demolition. Apex collec�d a minimum of(1)sample
Trom miscellaneous maberials(i.e. suspended ceilinp tlles,floor covering, sheet radc,
adt�ives, hard plaster etc.)and a min�num of(3) samples f�om thermal and
surf�cing materials(i.e., 7hermal pipe insulatian, textured oeiling materiats etc)in a
random sampling acheme from varioua bcations and levels of the facility. Some
building ma�terials were assumed to contain asbestos and either sampled to quanMy
the proportion of asbestos, or were not sampled at all.
EMSL Labs tnc, asbestos tabor�taties using polari�ed liqht micrnscopy (Pl.M) in
accordance wittt AHERA analydcel protocol{EPA-600/R-93/116}analyz�d bulk
ss�mples. Copies of the labaatory reports ane fncluded in Appendix A.
Samples will be retained at EMSL Labs Inc. laboratory for a period af 30 days from the
date af the report Samptes will then be discarded unleas other inatructions are
nec:�ived from the client.
Mat�eriaba that were analyzed and found to c;ontain less than 1%asbestos a�
considered to be non-asbestos and witl be indicated as "Non-De�ecl�ed" on the Survey
T�bles in Appendix A.

The United Staied Environmental Prot�ction Agency(USEPA), the Minnesata
Poliution Cwitrol Agency(MPCA), and the Minnesota Departn�ent af Health (MDH)
have gensrally �opted the de�inition that a product is deemed to contain asbest�s if it
conteins morQ than one percent asbestos by area. However,the�federal Oacupational
Safety and Health Administration (OSHA)regulations define an ACBM as any material
which contains 0.1 petcent or more a�bestos by weight.
The MDH (Nancy Laplant: 651-215-0897)and the MPCA(Jadcie Deneen:651-297-
8506)can be co�tacted regarding further cfarification of their agency interpretations of
ACBMs end reguletions conceming building demotition and the ACBMs observed
within the site structures. 7he USEPA, MPCA, �d OSHA require nabticcation prior to
building demdition�nd disp�sal of ACBM ma�erials.

PCBs may be fiourxi in light ballasts, smail capacitors ftwnd in old applianc�s, and
transformer oils. Fiuorescent light fixtures are located within the building, the bulbs,
which may contein mer�ury ahould be r�emoved and properfy disposed. The ballast
from these fixtures, which may contain PCBs, should be removed arxi prope►1y
disposed of be#aro discard�ng the fixtures. Apex observed no additional sources for
PCBs, such es pad type dry trensformera in the buildings.
