Since our last email, City Code has changed and the location of the sport court is no longer an issue as it meets the setback requirements. Please log in to CitizenServe and submit General Zoning Permit (permit type), Hardcover-Patio (sub type) to cover the construction of the sport court. Once we receive the after-the-fact permit, and the fees are paid we can close out this permit and refund your escrow money. The MCWD will be following up with you and/or the developer regarding vegetation disturbance within the wetland buffer. Also, please work with Steve Groen with the Hennepin County Transportation Department regarding the removal of the construction access off of County Road 6. I do not want to shoot the messenger on this but your email was most upsetting. Over the past 3 years, we have worked with the city, MCWD, the developers, had countless surveys and as-builts performed, had engineers and the city discuss, and analyze our backyard, gone through vacation easement proceedings and city council meetings to jump through all the hoops we are supposed to and NEVER once in all those discussions, meetings, reviews did ANYONE every mention or place on a survey or as-built the fact that there is a buffer to the MCWD buffer. The only concern ever stated or placed on the surveys or as-builts or in association documents has been the MCWD wetland buffers. The fact that there is a buffer to the buffer is ridiculous. 2 A permit was not needed for the pad, according to our landscape designer, but we made sure to be out of the wetland buffer. To remove/modify the concrete pad after we have spent tens of thousands of dollars and time to finally finish it puts us in a difficult position. Add on to that, the traffic situation on our cul-du-sac because of the no left turn on Old Crystal Bay Rd, and this is more than we can take. We have been patient and compliant for 3 years waiting and working with the city for things the developer should have done but blatantly didn't and had no intention of doing right. There must be some resolution available other than to tear it up because of 5 feet that is already outside the wetland buffer. Please help us to find a solution. This was not intentional and like I said, I do not mean to shoot the messenger but we have had more than we can take and this is the straw that broke the camels back. We want to be able to enjoy our house and where we live and we thought we were finally moving past these incredibly frustrating 3 years.
