The subject property on Shoreline Drive is zoned LR-1C-1 - "One Family Lakeshore Residential
Subdistricts." The minimum lot size requirement is generally 1/2 acre per dwelling unit.
Per Section 10.26, Subd. 3, a credit for a 50% increase in dwelling unit density may be obtained
with:
A. Compliance with Section 10.32 planned residential development.
B. Public sanitary sewer is available.
C. All dwelling units must be attached but not more than 4 dwelling units per structure
and maximum height of 30 ft.
D. No more than 35%hardcover on lot.
E. Building size and location approved by Council.
F. Vehicle access approved by council (note: county highway too).
G. A minimum of 2 parking spaces per dwelling unit. One space enclosed and attached
to principal structure it serves.
H. Density provisions in Section 10.60 are not exceeded.
Please be aware that the City of Orono has an 8%park dedication requirement. In this case,the City
may want to acquire more than 8%to provide adequate park facilities to serve the needs of the area.

The following is a review of property located at 3760
Shoreline Drive, P.I.D. 17-117-23 34 0004.
This property has been assessed on Levy #9086 for sewer.
The original amount was $1,770.00. ( $150.00 for the trunk,
$1 , 620.00 for acreage of .81). It was assessed for only one
sewer unit.
This property is located in the LR-1C-1 Zoning District,
which is the One Family Lakeshore Residential Subdistrict, 1/2
acre minimum area required per unit.
This property could be used for a duplex because it is
located 200 feet from commercial property. The price of an addi-
tional sewer unit would be $1,345.00.

NOTICE OF HEARING ON PROPOSED ASSESSMENT
TO WHOM IT MAY CONCERN:
Notice is hereby given that the Council will meet at
7: 00 p.m. on Monday, August 28, 1989 , at the Council Chambers of
the City of Orono, 1275 Brown Road South, to pass upon the
proposed assessment for street lighting improvement on County
Road 15. The following is the area proposer to be assessed:
The South 1/2 Section 17, Township 117, Range 23
and the North 1/2 Section 20 , Township 117, Range
23 and in particular all property abutting County
Road 15 (Shoreline Drive) beginning at the western
border of Orono then easterly to a distance 320
feet east of County Road 15 (Shadywood Road) all
property abutting County Road 19 (Shadywood Road)
563 feet north of County Road 15 (Shoreline Drive)
and 622 feet south of County Road 15 (Shoreline
Drive) .
The amount to be specially assessed against your particular lot,
piece, or parcel of land is $ 924. 00 . You may at
anytime prior to certification of the assessment to the county
auditor, pay the entire assessment of such property with' interest
to the date of payment, to the City of Orono. No interest shall
be charged if the entire assessment is paid within 30 days from
the adoption of this assessment. You may at any time thereafter ,
pay to the City the entire amount of the assessment remaining
unpaid, with interest accrued to December 31 of the year in which
such payment is made. Such payment must be made before November
15 or interest will be charged through December 31 of the
succeeding year. If you decide not to prepay the assessment
before the date given above the rate of interest that will apply
is 8 percent per year. The right to partially prepay the
assessment is not available.

ASSESSING
The proposed assessment roll is on file for public inspection at
the City Clerk's office. The total amount of the proposed
assessment is $ 118,040.94. Written and oral objections will be
considered at the meeting. No appeal may be taken as to the
amount of an assessment unless a signed , written objection is
filed with the clerk prior to the hearing or presented to the
presiding officer at the hearing. The council may upon such
notice consider any objection to the amount of a proposed
individual assessment at an adjourned meeting upon such further
notice to the affected property owners as it deems advisable.
If an assessment is contested or there is an adjourned hearing,
the following procedure will be followed:
1 . The city will present its case first by calling witnesses who
may testify by narrative or by examination, and by the
introduction of exhibits. After each witness has testified,
the contesting party will be allowed to ask questions. The
procedure will be repeated with each witness until neither
side has further questions .
2. After the city has presented all its evidence, the objector
may call witnesses or present such testimony as the objector
desires. The same procedure for questioning of the city' s
witnesses will be followed with the objector's witnesses.
3. The objector may be represented by counsel .
4 . Minnesota rules of evidence will not be strictly applied;
however , they may be considered and argued to the council as
to the weight of items of evidence or testimony presented to
the council .
5. The entire proceedings will be tape-recorded .
6. At the close of presentation of evidence , the objector may
make a final presentation to the council based on the
evidence and the law. No new evidence may be presented at
this point .
An owner may appeal an assessment to district court pursuant to
Minnesota Statutes Section 429.081 by serving notice of the
appeal upon} the mayor or clerk of the city within 30 days after
the adoption of the assessment and filing such notice with the
district court within ten days after service upon the mayor
or clerk .
Under Minnesota Statutes, Sections 435.193 to 435.195, the
council may, in its discretion, defer the payment of this special
assessment for any homestead property owner by a person 65 years
of age or older for whom it would be a hardship to make the
payments. When deferement of the special assessment has been
granted and is terminated for any reason provided in that law,
all amounts come due. Any assessed property owner meeting the
requirements of this law and the ordinance adopted under it may,
within 30 days of the confirmation of the assessment, apply to
the city clerk for the prescribed form for such deferral of
payment of this special assessment on his property.
