Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 NOTICE OF VIOLATION OF ZONING CODE May 25, 2006 Mark and Kristen Anderson 575 Oxford Road Long Lake MN 55356 Mr. and Mrs. Anderson: In response to several calls expressing concern about horses being kept near the lake I visited your neighborhood yesterday. I found you are keeping two ponies on your property at the above address. Their corral is immediately adjacent to wetlands and has no ground cover. In addition I noted some sort of construction/earthmoving project was underway along your southerly lot line between the house and the pony corral that has resulted in a sizable area with no ground cover and a slope near the house that was disturbed during remodeling and as a result has no ground cover. Keeping the ponies on this property violates the following City of Orono code provisions: LR-1A zoning district regulations - Sec. 78-303. Conditional uses. Within any LR-1A one-family lakeshore residential district, no structure or land shall be used for the following uses except by conditional use permit: (12) The keeping of domestic animals for noncommercial purposes, including horses for the use of the occupants of the premises. A minimum of one acre in aggregate, exclusive of one acre for the principal building, must be available for each animal unit, except as set forth in this subsection. A minimum of two acres of open pasture must be available for a single horse, and one additional acre must be available for each additional horse. When the horses are kept stabled and do not require pasture for feed purposes, the minimum pasture requirement may be adjusted at the discretion of the council. Such minimum pasture acreage shall not include wetlands as defined in section 78-1602. Any person keeping such animals must comply with the provisions of this Code. Nonencroachments. 7) Fences erected in all zoning districts are considered as a nonencroachment when they conform to the following standards: b. Lakeshore lots. 2. Fences within the required side yard of a lakeshore lot shall not exceed six feet in height, and any portion located lakeward of the average lakeshore setback line shall not exceed 42 inches in height. The term "average lakeshore setback line" means a line drawn between the most lakeward projection of the fence owner's principal residence structure and the most lakeward projection of the adjacent affected principal residence structure. 3. Fences shall not be constructed within the defined lakeshore yard of a lakeshore lot, i.e., shall not be located within 75 feet of the shoreline for general development lakes. Shoreland regulations - Sec. 78-1290. Agricultural use standards. (b) Animal feedlots must meet the following standards: (1) New feedlots, if permitted, must not be located in the shoreland of watercourses or in bluff impact zones and must meet a minimum setback of 300 feet from the ordinary high water level of all public waters basins; and (Per 78-1211 Animal feedlot means a lot or building or combination of lots and buildings intended for the confined feeding, breeding, raising or holding of animals and specifically designed as a confinement area in which manure may accumulate, or where the concentration of animals is such that a vegetative cover cannot be maintained within the enclosure. For purposes of this Code, open lots used for the feeding and rearing of poultry (poultry ranges) shall be considered as animal feedlots. Pastures shall not be considered as animal feedlots when the area enclosed as pasture is equal to or greater than 1.0 acre per animal unit.) And wetland regulations - Sec. 78-1606. Permitted uses. (b) Within wetland buffer areas no land may be used except for one or more of the following uses: (1) Native vegetation, provided that no change is made to the ground elevation; (2) Wildlife and nature preserves; (3) Boardwalks, docks or other reasonable access to the wetland not exceeding eight feet in width, poles that are less than two feet in diameter to be used for boardwalks and bridges; (4) Public and private flood control structures, ponding and drainage facilities and associated accessory appurtenances as approved by the city; (5) Environmental monitoring or control facilities, including those related to water quality and wildlife regulation; Mark and Kristen Anderson May 25, 2006 Page 3 (6) Overhead utility poles and lines that are less then two feet in diameter, under- ground utility lines and distribution equipment, light poles, traffic signals, traffic regulatory signs, mailboxes and other equipment that provides an essential public service; (7) Retaining walls if the city determines that the retaining wall will protect the wetland from conditions of erosion, when approved as part of a wetland permit application. The land alteration is in violation of the following City of Orono code provisions: Shoreland regulations - Sec. 78-1286. Topographic alterations/grading and filling. (d) Except for those projects requiring permits for construction of structures, sewage treatment systems and driveways, a land alteration permit will be required as follows: (1) For movement of one through 500 cubic yards of material anywhere within the Shoreland Overlay District, a staff-issued land alteration permit shall be required. (2) For movement of more than 500 cubic yards of material within the Shoreland Overlay District, conditional use permit approval by the city council is required in addition to the required land alteration permit. Wetland regulations - Sec. 78-1601. Purpose and intent. c) This article applies to, and wetland buffer areas must be created or existing buffer areas must be maintained around, a protected wetland located partially within, wholly within, or directly adjacent to the property in the following situations: 4) When any construction or land alteration activity that does not fall within the meaning of 'redevelopment' has the potential to adversely impact a wetland. For purposes of this section, "the potential to adversely impact a wetland" exists when all of the following three conditions exist: a. The portion of the property disturbed by construction or land alteration activity drains to the wetland; and b. The amount of grading exceeds 50 cubic yards or the construction activity involves the disturbance of more than 5,000 square feet of area; and c. The redevelopment activity results in a net increase in the square footage of impervious surfaces that drain to the wetland, or results in the relocation of impervious surfaces closer to the wetland, or results in changes to drainage patterns (slopes, meander patterns, etc) that the city engineer determines will increase the velocity or rate of runoff to the wetland. Mark and Kristen Anderson May 25, 2006 Page 4 This letter will serve as your notice that in order to avoid legal action by the City you must do the following within ten days of your receipt of this letter: 1. Remove the ponies from the property and not return them or bring any other horses to the property until you have received a conditional use permit and satisfied the conditions of the permit. 2. Erect silt fence around all disturbed and/or portions of your property without ground cover. and further, by Noon on June 21 you must: 1. Seed and mulch, sod, or otherwise establish ground cover on the slope from your house to the north property line that appears to be at final grade. 2. Make application for a land alteration permit OR restore the disturbed area to its original grades and begin to re-establish ground cover. You may find the application for a land alteration permit on the City's website or you can obtain one at City offices on Kelly Parkway. If you have any questions call me at 952-249-4623. If you wish to return the ponies to the property, you will also find an application for a conditional use permit at the City's website. But please contact me before you begin to fill out the application so I can let you know the specific information that will be required. I must also tell you that City Staff will not recommend approval of a conditional use permit for horses on the property.
