Dear Mr. Leekley:
This letter is to follow-up our conversation of a few weeks ago,
regarding the potential buildability of the above mentioned
property.
According to the Hennepin County Tax Records, this lot contains
approximately 0.88 acres. It is possible that an actual survey
of the property might show slightly more, but I doubt if the
acreage is much more than one acre excluding the abutting
roadways .
This property is .zoned RR-1A, single family rural residential, 5
acre minimum lot size. It is my recollection that the central
portion of the property is very low and contains a drainageway,
while it is relatively high at the east and west ends. The
slopes and narrow width of the lot likely would create severe
limitations for septic systems.
In order to build on this lot, variances would have to be granted
for the following:
1. Lot area (5 acres required)
2. Lot width (300 ' required )
3 . Side setback (50 ' required)
4 . Side street setback from Watertown Road ( 100 '
required) .

With less than 100' in width, there is virtually no buildable
envelope within this lot. The front and rear setbacks of 100' ,
the side setback of 50 ' , and the side street setback of 100 ' ,
yield no place on this property to construct a residence without
significant variances.
In our discussion, there was a question about the taxes on this
property and the value of the property as a building site. I am
enclosing a copy of the current 1990 Hennepin County Tax Book
which indicates the land being valued at a nominal $3 , 000 with
total non-homestead tax of $ 180 . 56 . Although I have not
researched prior years, this property currently is not valued as
a building site. Compare it with the entry just below for the
property at 75 Stubbs Bay Road, which is nearly identical in
size, but has a land value at $18 ,000. Clearly the Assessor is
not valuing your subject property as a building site.
If you wish to pursue the buildability of this lot, the next step
would be to make a variance application. You would have to
provide a Certificate of Survey and septic system testing, along
with a proposed house plan and location. While you have a right
to do this , my sense is that you would be wasting your money.
The magnitude of the variances needed is so great that I would be
surprised if the Council approved them. Perhaps the most
appropriate use for this property would be a sale to the abutting
property owner.
