As part of this permit review, it has come to our attention that an existing septic system treatment mound serving 3250 Fox Street exists across the common property line between the properties listed above. The purpose for this letter is to initiate a resolution to this encroachment. The two properties were part of the 3 lot Maxwell Bay Estates subdivision completed in 2004.The home on 3250 Fox Street was intended to remain following being platted as Lot 2.As part of the subdivision approval and according to the approval documents (enclosed)the existing septic mound serving 3250 Fox Street was allowed to remain, conditioned upon the filing of a temporary easement for the mound until such time when a building permit was requested for Lot 1 (3280 Fox Street). According to the City's records,that easement was never recorded. However,the triggering event for removal of the encroaching septic mound treatment area has occurred as the owners of 3280 Fox Street have submitted a building permit. It is the City's hope that the septic system encroachment can be resolved between the two property owners. To move the encroaching septic treatment area,submit a design and permit request to install a new septic mound in a conforming location on the 3250 Fox Street property. The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Planning Director, and City Engineer that all requirements of the platting regulations have been satisfied. 3. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Registrar of Titles Office on or before December 14, 2004 together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. The approval granted by this Resolution shall expire if the conditions of this Resolution have not been met or the plat has not been filed by the date specified above. Stickney (hereinafter the "subdividers") on March 17, 2004, filed a formal subdivision application with the City for approval of a three lot residential plat of property legally described as: _ Tract E,R.L.S.NO. 1358,Hennepin County,Minnesota (hereinafter"the property"); and • WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the • Orono Planning Commission held a public hearing on April 19, 2004, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, at their regular meeting held on May 10, 2004, the Orono City Council considered the subdivision application of the subdivider noting the following findings of fact: . 1. The property is located within the LR — 1A One Family Lakeshore Residential Zoning District requiring a minimum of 2 acres of contiguous dry buildable land within each newly created lot. 2. The property contains a total of approximately 14.830 acres of land; 0.13 acres of which is delineated wetland. 3. The proposed plat consists of three residential lots each meeting the minimum lot standard requirements of the LR — 1A, One Family Lakeshore Residential Zoning District, each meeting the minimum 2 acre lot area requirements and each having over 200' in defined width at the shoreline and 75' lake setback. All lots will be served with septic systems and private wells. . 5. Lot 3 will be served off the existing drive access from the public portion of Fox Street. 6. Lots 1 and 2 will be served off private driveways accessed from the private portion of Fox Street. 7. Several primary and alternate septic sites meeting all pertinent standards have been identified for each of proposed Lots 1, 2, and 3. 8. It would be appropriate to establish a single average setback line for all 3 lots to avoid having an average setback line that changes each time one of ' the lots is built on. NOW, THEREFORE,BE IT RESOLVED, that based upon one or more of the III findings noted above, the City Council of the City of Orono hereby approves the preliminary plat application of Bruce and Kristine Paddock and George W. Stickney at 3250 Fox Street per preliminary plat drawings by Mark Gronberg of Gronberg & Associates, Inc., dated March 1, 2004 and revised 4-12-04 and 4-14-04, subject to the following conditions: 1. The developer shall grant to the City 10 foot drainage and utility easements along perimeter property boundaries and 5 foot drainage and utility easements along all interior property boundaries. 2. Proposed lot 3, at the time of construction, must gutter drain the roof and direct the drainage to the west and to the proposed dry pond. Also, proposed lot 3 front yard, sidewalk and side and back yard drainage shall be routed to a new swale along the east side of the property. 3. Payment of standard Park Dedication Fee for Lots 1 and 3. 4. Payment of standard storm water and drainage trunk fee for the property. 5. The average lakeshore setback line shown on the preliminary plat shall be the line used to define the average lakeshore setback for all 3 lots. 7. If the existing mound on lots 1 and 3 is proposed to remain in use during the interim period, a temporary easement, expiring at the time of site grading for proposed lot 1, may be permitted but only by approval of the City. • 8. The subdivider shall implement all currently provided or forthcoming recommendations of the City Engineer regarding grading, drainage, stormwater management and site improvemens. 9. The developer shall comply with all requirements of the Minnehaha Creek ' Watershed District. 10. Subdivider is hereby advised that preliminary subdivision approval will • expire within one year of the date of City Council approval,May 10, 2005. Should the subdivider fail to complete the filing of the final plat application within the year deadline, it shall be necessary for the subdivider to file a new preliminary subdivision application with the City. Final Nat Submittals: The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled City Council meeting on the second and fourth Mondays of the month. These submittals are as follows: 1. Record plat drawings in the form of two (2)mylar copies (one copy for the City's records and one for filing with Hennepin County) and one (1) copy reduced to 1"=200'. Drawings to include: a. Lot lines platted per preliminary survey by Mark Gronberg of . Gronberg &Associates, Inc., dated March 1, 2004 and revised 4-12-04 and 4-14-04. b.
