I have pulled up the attached two additional documents. I agree, it looks like it covers the whole lot, but it doesn't say it's exclusive.This is a private easement, not a public one. The City does not typically consider private easements in its development review process. I don't think you should withhold permits based on its existence. The easement is appurtenant, meaning it runs with the land. In order to get rid of it, they would need to get a release from all owners of the land benefitted by it. In addition, it looks like the easement was duplicated in the attached document#2887366, so technically they'd need a release of that document too. If that's something they want to pursue, I would encourage them to contact a title company and get title commitments, to see if there are any other related easement documents that would need to be released. We have proof of wells being dug on the adjoining properties which makes the easement no longer needed. If we want to attach the garage and future house and move the house back from the lake we will need to build within that outdated easement space. What does the city of Orono need for us to be able to build within that space? Is the proof of new wells on the other properties enough? Thanks for your help! I can only assume that the contract for deed (copy attached) was not assigned (or the assignment was not recorded) and therefore there are blanks on page 2. That does not affect the rest of the document. 2 I looks like there is an easement for water service between the properties that is contained in the two warranty deeds listed. I obtained a copy of one of the deeds (attached) and it is dated 1/16/1956. The deed indicates"an easement for water for domestic purposes as set forth in Contract for Deed Document No. 2818702 . . ." I can order an ONE if you would like.
