The City <br /> does not typically consider private easements in its development review process. I don't think you should withhold <br /> permits based on its existence. <br /> The easement is appurtenant, meaning it runs with the land. In order to get rid of it, they would need to get a release <br /> from all owners of the land benefitted by it. In addition, it looks like the easement was duplicated in the attached <br /> document#2887366, so technically they'd need a release of that document too. If that's something they want to <br /> pursue, I would encourage them to contact a title company and get title commitments, to see if there are any other <br /> related easement documents that would need to be released.
