After our conversation and reviewing your site on our GIS map,we do not feel that this project needs a MCWD permit. It
does not trigger any of our rules. We ask that you please keep the disturbance to a minimum and have some sort of
erosion control to the west of the existing garage location, as that is the only place on site that we see potential for
wetland onsite. But because the disturbance is under 5,000 sf and the construction is just a garage and not a single
family home with increased impervious,our rules are not triggered.

Good Morning Brett,
Thank you for your time on the phone. As requested here are the project details for the new garage being built
at 3245 Watertown Road, Orono.
The new garage will be in the similar building area as the old garage. The total finished construction will be
under 5000 square feet of disturbance. There is no wetland area in the proposed build site. No delineation is
needed. The new garage will be 20' x 22'.
The City of Orono Building Department has asked that I provide them with written documentation from your
office that we do not need additional permits and that our proposed plan has not triggered any issues.
Thank you for your assistance with this matter, as we are in hopes of attaining our building permit immediately,
needing only this to do so.

The building permit application for the detached garage has been approved. We will be contacting your builder Heinen
Contracting this afternoon to inform them that the building permit is ready for pick-up.
Also please note, according to condition #4 of the approved variance Resolution,we will have the City's wetland
specialist perform a site visit to evaluate the vegetation in the required wetland buffer. Once we have a copy of his
report, I will forward a copy to you detailing what, if anything, is required regarding improving the wetland buffer
vegetation.
Your escrow will be refunded once the building inspector has passed all the necessary inspections and the buffer
improvements, if any, have been approved.

for the new garage building and the demolition application for the removal of the existing slab. (Old garage has
already been removed).
I apologize for the oversight in submitting these, I was under the impression that the Rhame's had already done

Your variances were approved last night on the Consent Agenda with a 5 to 0 vote for approval, consistent with the
conditions in the draft resolution.
You and your husband will need to stop in to sign the approval resolution; the draft resolution was included with the
Council packet. This resolution will be ready for signature beginning on Wednesday. Both of you will need to stop in to
sign at our front desk. You should bring your ID or driver's license for the notary.
Once the resolution is signed, you can submit for building permit; 2 full sized copies of the final survey and 2 full sized
copies of the final garage plans will be needed. Your signature on a revised escrow agreement will also be necessary; no
additional escrow money is required. We will prepare the escrow agreement and email to you to print and sign.

Recitals
1. A building permit application has been filed for a variance and building permit for a new detached
garage located at 3245 Watertown Road the ("Subject Property'), legally described as That part of Lot 2,
Auditor's Subdivision No. 203, Hennepin County, Minnesota, lying northerly and easterly of a line drawn from a
point on the North line of Section 5, Township 117 North, Range 23 West of the 5"' Principal Meridian, 335 feet
west from the Northeast comer of said Section, to a point on the East line of said Section 5, 263 feet south from
cerin Ncxttieast comer of said Section 5.
2. Owners request the City to review this application.
3. The City will commence its review of the application and incur costs associated with said review
only if the Owner establishes an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE,THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement,the Owners shall deposit$2,500 with the City. All accrued interest, if any, shall be paid to the City to
reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal
consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the
Owners would be responsible for under a building permit application. The escrow will also guarantee
reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in
accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79.
The financial security may also be used by the City to eliminate any hazardous conditions associated with the
work and to repair any damage to public property or infrastructure that is caused by the work (including planning,
engineering, or legal consultant review) associated with Land Use Application #12-3583 & Building Permit
#2013-00119 if compliance with the approved building permit is not accomplished.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs,the City will in tum
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make payment
to the City within the timeframe outlined in#3 above, shall issue a Stop Work Order until the Owners pay all expenses
invoiced pursuant to #3. The City may draw from the escrow account without further approval of the Owners to
reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when the review has been completed and written notification is received from the Owners requesting the
funds.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners,or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat.§§415.01 and 366.012.

payment to the City within the timeframe outlined in#3 above, the City may draw from the escrow account without
further approval of the Owner to reimburse the City for eligible expenses the City has incurred. The City shall
notify the Owner of such draw and the nature of the expense for which the reimbursement is being made. If the
Escrow amount falls below 75% of the original escrow amount the Owner shall deposit additional sums as
directed by the City, or the City shall discontinue all review.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owner when the review has been completed.
