Boz 66 xES11 Orono, MN 55356 Crystal Bay, MN 553230066 October 5, 2005 Hickory Fine Homes Joe Mailhot 1344 Wayzata Blvd Long Lake, MN 55356 RE: 3240 Watertown Road—Building Permit Application The City is in receipt of a building permit application dated 9-26-05 for property located at 3240 Watertown Road. A preliminary review indicates the following revisions and submittals must be made in order to continue review of the permit: • The City adopted a new wetland ordinance on August 22, 2005 that requires new development to install buffers and maintain setbacks from, the required buffer, all dependent of wetland type. As this permit application was received after the ordinance was adopted and formally published, development of this lot must meet the new wetland regulations. There exist two .wetland bodies on this property both classified as "Preserve" wetlands requiring a 50' buffer and a 20' setback from that buffer. Based on those requirements it appears that the proposed house location will have to shift approximately 20' south and the grading for the walk-out may have to be revised so that the 50' buffer remains undisturbed. Grading may occur within the 20' setback from the buffer but not within the buffer. The buffer and buffer setback requirement from the wetland to the south appears to work and exceptions will be made to allow for the driveway crossing. Implementation of 50' buffers must be included in the plan for both wetland bodies. I've enclosed the new ordinance language for your review. • Submittal of MCWD permit allowing for the driveway crossing. • The proposed septic design and sites do not match the septic design and sites that were approved with the subdivision. The design submitted for the new sites show site locations that differ from the locations shown on the survey. If the approved septic sites are not going to be used, then the proposed sites need to be shown on contour and that they meet all the following required setbacks: o 75' from wetland edge o 20' from property line o 20' from driveway and any other hardcover or structures o 20' from septic tanks Telephone(952)249-4600 © Fax (952) 249-4616 ww•w.ci.orono.enn.us • The proposed house exceeds the 30' height limitation established under Section 78-1: definition of building height of the Zoning Ordinance. Based from the highest point of the existing grade (979') to the midpoint of the highest gable (using midpoint of top of window to top of peak) the total height measures 31.75'. The plans must be revised so as not to exceed 30' as defined under the building height ordinance. • The cupola shown atop the highest gable requires a conditional use permit per Section 78-1366 of the Zoning Ordinance. It appears the cupola atop the garage section of the house would be permitted as it does not extend above the highest peak that is used for determining building height. Any cupola that extends above the peak height would require approval of a conditional use permit. • Hardcover calculation worksheets must be submitted as hardcover limitations exist within 300' of the bank of the creek. At this time the building permit application remains incomplete. Revised plans must be submitted meeting the requirements noted above, at which point the City will continue review of the application including City Engineer review of a grading plan.
