OPEN SPACE EASEMENT
THIS INDENTURE, made and entered into this / )..., day of Sep-
tember, 1980, by and between Ministers Life Development Company
its successors and assigns, (hereinafter collectively referred to
as the Grantor) and the City of Orono, its successors and assigns,
. a municipal corporation under the laws of the State of Minnesota
(hereinafter referred to as the Grantee) .
WITNESSETH,, Grantor, for and in consideration of the sum of
One Dollar and other good and valuable consideration, hereby cove-
nants, grants, gives, quit claims and conveys to Grantee the right
to restrict and Grantor agrees to limit and preclude the use,
improvement and development, under the conditions and covenants
herein contained, the following described land in the County of

Outlots A, C, and D, Green Trees, according to the recorded •
plat thereof,

1. Grantor hereby covenants and agrees:

B. No trees, shrubs or other vegetation shall be destroyed

written consent of Grantee.

C. No earth, loam, peat, gravel, soil or any other natural
material or substance shall be moved or removed from the
Land and there shall be no grading, dredging or excavation

,z D. No soil, sand, gravel or other substance or material as

'. E. No use shall be made of the Land except uses, if any,
which will not change or alter the natural condition of
the Land, and no use which would tend to change the
drainage, flood control, water conservation, erosion
control, soil conservation, fish and wildlife habitat
charActeristics shall be made of the Land or the water
• situated thereon. Each outlet shall be entitled to
• have constructed upon or appurtenant to it, one dock.
No more than two boats (as defined by the Lake Minne-

tonka Conservation District) shall be moored, docked or
stored at any dock.
F. Grantee may enter upon the Land for the purposes of
inspection and enforcement. of the covenants contained
' • herein and to cause to be removed from the Land without
any liability any structures, uses, rr.,.terials, substances,
or unnatural matter inconsistent with the covenants
contained Lerein and the natural state of the Land.
G. Not withstanding any of the above provisions, the Land
may be used for boat dockage and for agricultural
purposes including pasturage therefore, which use may
. , include the erection of fences, corrals and watering or
feeding stations for such animals except no barn,
stable shall be permitted thereon without specific
_ written consent of Grantee.
2. This Open Space Easement or any provision contained
+. herein may be released by Grantee but only by adoption of a Reso-
lution to that erect by the City Council.

In addition to any other remedy the Grantee may have, the
covenants and restrictions contained herein may be enforced by in--
junction.
Grantor does not intend that the public should have any interest
in the above land by virtue of this indenture or otherwise, except
as hereinabove set forth.
The Grantor herein certifies that the Land herein described
is free and clear of all encumbrances except:
covenants, conditions, restrictions and easements of
record.
All the provisions hereof shall run with the land and shall
extend to and bind the heirs, successors, representatives, grantees
