A RESOLUTION APPROVING THE
PLAT OF OLD CRYSTAL BAY ROAD SECOND ADDITION
FILE NO. 1933
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS, the City Council has considered the application for a subdivision of
a twenty-one lot plat by Orono Limited Partnership, a Minnesota limited partnership (hereinafter
"the subdivider"); and
WHEREAS, the subdivision has been found to meet all standards of the RR-113,
Rural Residential Zoning District finding that each lot is of a size and configuration that would
allow its use as a single family residence to be fully developed without the need of any
variances; and
WHEREAS, the subdivider has agreed to complete all requirements of the
platting regulations of the City, including:
1. Completion of all the requirements of Resolution No. 3444, the resolution
granting preliminary approval of the Class III subdivision.
2. Dedication on the plat of drainage and utility easements.
3. Creation of two private roads shown on the plat as Outlots C and D; Outlot C to
be known henceforth as Somerset Trail and Outlot D as Thoroughbred Lane.
4. Concurrent with the creation of these private roads, the subdivider has dedicated
to the City road and utility easements granting to the City permanent access,
improvement and utility easements over said outlots; the subdivider has created
non-exclusive ingress, egress, drainage and utility easements over said outlots in
favor of all abutting lots including a declaration of covenants, conditions,

restrictions and private roadway easements wherein any lot shall be sold,
transferred and conveyed together with an undivided one-eighth interest in Outlot
C and one-eleventh interest in Outlot D whereby benefitting lot owners covenant
and agree to permanently maintain and pay cost of maintenance for said private
roads.
5. The subdivider has dedicated to the City drainage easements over all detention
areas, wetlands, and drainageways within the plat providing for limitations on the
use of these areas and shown on the plat as drainage easements. The subdivider
has created private covenants covering the upkeep and maintenance of all drainage
facilities.
6. The subdivider has created protective covenants for all lots containing protected
wetlands not included within conservation maps of the City of Orono and also
includes the areas defined as mitigation areas. Covenants have been drafted to
( include metes and bounds descriptions of the areas and site plans to define the
location of these areas within each lot.
7. Dedication of a pedestrian trail easement located within Lot 6, Block 2.
S. The subdivider has executed a Subdivider's Agreement providing for the
installation of comprehensive improvements required as a condition of approval
of both Old Crystal Bay Road Addition and Old Crystal Bay Road 2nd Addition.
The subdivider has posted security to ensure that these required improvements are
completed to the City's satisfaction.
9. Creation of Outlots A and B to serve as driveway outlots; Outlot A shall serve
Lot 7, Block 4, Old Crystal Bay Road Addition; Outlot B to serve Lots 2 and 3,
Block 3. Outlot A shall be under common ownership with Lot 7, Block 4. The
subdivider shall create either an appropriate easement and/or agreement for the
installation and maintenance of shared drive within Outlot B.

10. Creation of private covenants to include special limitations of both private and
public interior trails. Trails within Block 2, Old Crystal Bay Road Second
Addition are public. Trails within Blocks 3 and 4, Old Crystal Bay Road Second
Addition are private and to be constructed of wood chips placed on existing
grade. Notice to future owners shall advise that any future land alterations of
these trail areas must be approved by the City of Orono.
11. Payment to the City of a park dedication fee in the amount of $40,790.80.
12. Payment to the City for the legal review and filing of the plat, easements and
covenants in the amount of $200.00.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono
hereby approves the plat of Old Crystal .Bay Road Second Addition, Hennepin County,
Minnesota, subject to the following conditions:
( 1. Erosion control shall be maintained over all disturbed areas until natural
groundcover is restored.
2. No building permits will be issued until all drainage facilities have been installed
and approved by the City, and a satisfactory road base completed.
3. Subdivider shall be responsible for obtaining a demolition permit from the City
before any existing structures on Lot 2, Block 3 are to be raised.
4. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or Registrar of Titles Office on or before April 10,
1995 together with a certified original copy of this resolution and executed copies
of the easements, deeds and covenants noted above.

The approval granted by this resolution shall expire if the plat has not been filed by the
date specified above. In that event,Dated ll be necessary to file a nw this 10th day of Octobere 1994plication with the City
of Orono for subdivision review.
