I have made note of some of the violations and provided some options for code compliance. It is not the job of this Building Department to .design the building for you but we can make suggestions. You may want to hire a building contractor to design the addition. Due to the fact that this addition was done without a building permit the City must require you to submit revised plans before 7-31-92. One of those conditions involved the removal of accessory structures or portions of accessory structures on Lot 1,Block 1 that did not conform to required setbacks from the newly defined lot lines. A copy of the resolution(#3427) is enclosed for your information. You may wish to refer to Condition 11,F on Page 3 of that resolution. The subdividers of the property, as well as your real estate agent, Mimi Ryerse,were aware of this condition prior to the sale of the property. The specific structure to be removed is defined as a"lean-to" addition that was constructed by the previous owner, William Dickey,without the benefit of a building permit. Mr. Dickey was unable to provide the necessary information to complete an"after the fact" building permit application. As a result,this addition has never been inspected by the Building Staff. You should also be aware that the developer of Crystal Bay Road Addition has been responsible for posting financial security for the past three years to ensure the removal of the unauthorized addition and expansion of the detached garage. We recommend that you contact the developers to resolve the matter of the removal of the illegal structure. A demolition permit will be required to ensure structural integrity/stability of the portion of the detached garage that will remain. We would appreciate your immediate response to this letter. A ��'EsBog� A RESOLUTION APPROVING THE PLAT OF CRYSTAL BAY ROAD ADDITION FILE NO. 1901 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for the subdivision of a 25 lot plat by Orono Limited Partnership, a Minnesota Limited Partnership (hereinafter "the subdivider"); and WHEREAS, the subdivision has been found to meet all standards of the RR-1B Rural Residential Zoning District finding that each lot is of a size and configuration that will allow its use as a single family residence to be fully developed without the need of any variances; WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, including: 1. Completion of all the requirements of Resolution No. 3415, the resolution granting preliminary approval of the Class III subdivision. 2. Dedication on the plat of drainage and utility easements. 3. Dedication on the plat of right-of-way for public roads shown as Countryside Drive West and Watertown Road. 4. Creation of a new private road shown on the plat as Outlot E to be known henceforth as Deer Run Trail. 5. Concurrent with the creation of this private road, the subdivider has dedicated to the City a road and utility easement granting to the City permanent access, improvement and utility easements over said outlot; the subdivider has created non-exclusive ingress, egress, drainage and utility easements over said outlot in favor of all abutting lots including a declaration of covenants, conditions, restrictions and private roadway easement wherein any lot shall be sold, Page 1 of 4 � O� O O CITY of ORONO RESOLUTION OF THE CITY COUNCIL 1 ti NO.46 Y kEsBog' transferred and conveyed together with an undivided 1/10 interest in said road outlot whereby benefitting lot owners covenant and agree to permanently maintain and pay cost of maintenance for said private road. The subdivider has also created certain maintenance covenants wherein each of the abutting lot owners adjacent to the public road Countryside Drive West covenants and agrees to maintain and pay the cost of maintenance for said public road while it remains a cul-de-sac road and not a through road connecting to Willow Drive. 6. The subdivider has dedicated to the City a temporary road and utility easement over the area of the cul-de-sac not included within the 50' dedicated right-of-way of Countryside Drive West. 7. The subdivider has dedicated to the City drainage easements over all detention areas, wetlands, and drainageways within the plat providing for limitations on the use of these areas and shown on the plat as drainage easements. The subdivider shall create private covenants covering the upkeep and maintenance of all drainage facilities. 8. The subdivider has created protective covenants for all lots containing protected wetlands not included within conservation maps of the City of Orono and the areas defined as mitigation area. Covenants have been drafted to include metes and bounds descriptions of the areas and maps defining the location of these areas within each lot. 9. Dedication to the City of a bicycle trail easement along the east side of Old Crystal Bay Road located within Blocks 2 and 3 and a pedestrian trail easement located within Blocks 1, 2 and 3. 10. Dedication by deed of Outlot A for public use. 11. Execution of a subdivider's agreement providing for the installation of certain improvements as a condition of subdivision approval as follows: a. Bike trail and interior pedestrian trail (located only within Dickey parcel). e. Removal of all structures within Outlot A. f. Removal of all accessory structures on Lot 1, Block 1 that do not conform to required setbacks from newly defined lot lines. g. Cleaning/upgrading of existing ditch that runs along the Luce Line adjacent to Coffin property. h. Replacing existing 18" culvert (to the west of the intersection of Luce Line and Old Crystal Bay Road) which is in disrepair with a 12" opening at inlet. Install a second higher culvert through Luce Line to act as an overflow or lower elevation of the Luce Line at this location providing applicant's plans meet the requirement that slope is no greater than 1%. i. Installing a new culvert under the horse trail in the area by the pond south of the Coffin property. The subdivider has posted a Letter of Credit in the amount of $308,122.50 to ensure that these required improvements are completed to City's satisfaction. 12. Payment to the City of a park dedication fee in the amount of $25,468.00. 13. Payment to the City for the legal review and filing of the plat, easements and covenants in the amount of $200.00.-- NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of Old Crystal Bay Road Addition, Hennepin County, Minnesota, subject to the following conditions: 1. The subdivider shall fence off the following drainfield sites prior to construction of roadway and drainage improvements and this fencing shall be maintained in place until lots are developed; Lots 1-6, Block 2, Lots 3-7, Block 3, Lots 1-10, Block 4. 2. Erosion control shall be installed as shown on preliminary grading and drainage plans and maintained until natural groundcover is restored. Page 3 of 4 -T�M.M. Engineering plans for public and private roads must be approved by the City before any land alterations involving road improvements can begin. No building permits will be issued until all drainage facilities have been installed and approved, and a satisfactory road base completed. 4. Stormwater/detention ponds shall be constructed prior to commencement of any other land alterations. These ponds shall be re-excavated to design elevations after the project has been completed to ensure permitted sediment storage capacity. 5. The designated wetland within Lot 7, Block 4 must be staked and erosion control installed prior to the installation of a driveway to the site of the future residence. The future owner must obtain the required permit from the MCWD as it will be necessary to fill a protected mitigation area with the construction of the drive. 6. The aforesaid plat shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before November 23, 1994 together with a certified original copy of this resolution and executed copies of the easements, deeds and covenants noted above. The approval granted by this resolution shall expire if the plat has not been filed by the date specified above.
