A couple of notes on the comments— 1—I know that we discussed the item of escrow on top of the permitting fees. I don't recall that a firm decision was made so I am including some cost for wetland delineation in the escrow amount. If you would like us to adjust this, please let us know. 2—Because this is an estimated buffer need in lieu of final findings in the wetland delineation,the language in the recommendation is a little different from other recommendations. We hope that this language is clear enough and complete enough to address this type of situation. If you would like us to word it differently, let us know. We offer the following observations,comments,recommendations, figures and pictures for your consideration. 1. This is a wetland determination made for the purpose of determining buffer requirements, if any. This is not to be used in place of an approved wetland delineation. An official wetland delineation should be completed in the spring,once the growing season starts,and submitted to the Minnehaha Creek Watershed District(LGU)for approval,with a copy provided to the City. 2. One potential wetland was identified just south of the property boundary(see Fig 1). The potential wetland is a shallow, narrow ditch channel. The soil directly adjacent to the ditch is not hydric and therefore,the area outside the ditch would not qualify as wetland. 3. Based upon the assumption that there is a wetland present,the proposed construction has the potential to adversely impact the wetland which will trigger the wetland protection ordinance requirements. Therefore,the following should be considered: a. This wetland is listed as a"Manage 2"wetland management class in the MCWD's Functional Assessment of Wetlands inventory,which requires a 25 foot buffer per City code. b. The exact extent of the buffer area cannot be determined until an approved wetland delineation is performed. An estimate of the buffer area can be measured from the edge of the ditch(see fig 2). c. The proposed buffer area consists mostly of a short steep slope which has been recently graded and stripped of vegetation. A portion of the buffer area lies within a wooded area that is dominated by buckthorn in the understory. d. Buckthorn is considered to be an undesirable plant and should be removed within the buffer zone and replaced with native vegetation. MnDOT seed mix 350 is recommended for upland buffer areas. A Vegetation Management Plan, including methods for removal and control of any invasive plants and a schedule of native vegetation establishment, should be submitted for review. e. Wetland Buffer markers should be placed at the upland boundary of the buffer edge located at lot lines and spaced a maximum 200 feet apart. f. A$3,000 escrow should be submitted by the Owner to cover the cost of a wetland delineation and buffer development if required but not completed by the applicant.
