CITY of ORONO • " ,�°�e�=� RESOLUTION OF THE CITY COUNCIL ,�,� 1��, �� ti N0. _'3 4 �c � :, ti, , ���� Og�G ESI; A RESOLUTION GRANTING PRELIMINARY A.PPROVAL OF A CLASS III SUBDIVISION OF OUTLOTS B AND C, OLD CRYSTAL BAY ROAD ADDITION - FILE NO. 1933 WHEREAS, Tandem Properties and Peter Andrea Company (hereinafter the "subdividers"), on April 26, 1994, filed a formal subdivision application with the City for approval of a 21 lot residential plat of property legally described as: Outlots B and C, Old Crystal Bay Road Addition, Hennepin County, Minnesota (hereinafter "the property"); and WHEREAS, after due published and mailed notice in accordance with Minnesota Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono • Planning Commission held a public hearin� on June 20, 1994, at which time all persons desiring to be heard concerning this application were given the opporiunity to speak thereon; and WHEREAS, at their regular meeting held on June 27, 1994, the Orono City Council considered the subdivision application of the�subdividers, noting the following findings of fact: 1. The properties are located within the RR-1B Single Family Rural Residential Zoning District, requiring a minimum of 2 acres of contiguous dry buildable land within each newly created lot. 2. The property contains a total of 57 acres with 7 acres of designated wetland and retention/treatment area. 3. The proposed plat consists of 21 residential lots, each meeting the minimum -- requirement of 2 acres of dry buildable area. � 4. Lots 15 and 18 that abut the cul-de-sac area within the Coffin second phase . division do not meet the required lot width of 200' at the rear of the front street setback line. All 21 lots have been found to have adequate and suitable soils for on-site septic treatment facilities. 6. Private roads shall serve 11 lots within the second phase division of the Dickey property and 8 lots within the Coffin property. Both curb cuts for the private roads have been approved by the City Engineer finding there is adequate siting distance for egress and ingress at a 40 mph road. No additional curb cuts will be allowed from these properties. 7. The City has approved a back lot configuration for Lots 16 and 17 of the Coffin property allowing the continued use of a private driveway to serve two properties. 8. The City has approved the platting of the back lots within the 10 lot division of • the Coffin property second phase based on the following findings: A. Lots will meet 150% of the area and setback standards required for back lots. B. Alternative of providing access via an extended road corridor or loop road would have the following impacts: (1) The loss of mature trees providing screening for existing development to north. This will also allow existing natural amenities to remain for future residential development of the surrounding area. The City approves the interior trail plan for the second phase division of the Coffin property allowing for the placement of wood chips on existing grade not to exceed a 5' to 8' width. This approval is based on the following findings: A. No land alterations are proposed within the wetland or within 26' of wetlands. B. The proposed trail design will have no impact on the existing wetlands nor on their interaction. C. Proposed trail will not impede surface runoff nor would it create down stream flooding or pollution problems. 10. The City has based preliminary approval of this plat on the applicants' engineer ' and the City engineer's reports and findings confirming that drainage from the • second phase residential development will not intensify drainage/flooding of down stream area. NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby approves the preliminary plat applicantion of Tandem Properties and the Peter Andrea Company per plat drawings by Mark S. Gronberg, a licensed surveyor of Coffin and Gronberg, Inc., dated November 29, 1993, most revised date May 25, 1994, subject to the following conditions: - 1. Cul-de-sac roads on the Coffin and Dickey parcels within Phase 2 shall be private. The City shall obtain underlying road and utility easements. The developer shall create private covenants for the maintenance of private roads. 2. Applicants should also address the ownership of Outlot C and whether that shall � be a shared ownership. If not, then one owner shall be responsible for granting an easement to the second owner. �, 3. Subdivider shall be responsible for installing pedestrian interior trails as shown � on trail plans drafted by Mark Gronberg of Coffin and Gronberg, Inc. Dedication of drainage and utility easements 5' along all interior lot lines and 10' along the perimeter boundaries and adjacent to road right-of-ways. 5. Prior to any site improvements within the second phase, erosion control as shown on preliminary grading and drainage plans must be installed and maintained until natural groundcover is restored. 6. Prior to site grading improvements, all tested septic sites on both the Coffin and Dickey parcels must be fenced off (exception Lots 16 and 17, Coffin parcel). 7. All wetlands designated on City conservation maps shall be shown as drainage easements on the plat. Designated wetland within Lot 16 must be designated by a drainage easement. 8. Drainage easements shall be taken over all retention ponding areas and drainage • ways as in the first phase review, such easements shall be recorded in the chain of title and developer shall create covenants to define future home owners association's responsibility for the upkeep and maintenance of all drainage facilities. 9. Payment of a park dedication fee prior to final plat approval. The City will require no park or trail dedications with the second phase platting of this property. 10. The following lots have been found to contain protected wetlands not designated on the City's conservation area maps: Dickey Parcel: Lots 8, 17, 18 and 19, Block 2. As with the first subdivision, the subdivider shall create covenants to be filed in the chain of title of each these properties advising future owners of the limitations on the use of these specific areas and the need to first apply to Corps of Engineers and the Minnehaha Creek Watershed District if any improvements are proposed at some future date before obtaining necessary permits from the City of Orono. 10. Applicant to execute developer's agreement to ,insure all grading/drainage improvements and road improvements are installed to City's satisfaction. No land alterations can take place until erosion control is established and septic sites staked and the City is in receipt of final grading and road plans. No improveznents can begin until City Engineer has approved improvement plans. . A letter of credit or an approved form of a supplemental mortgage must accompany a fully executed developer's agreement written to 150% of the cost of the proposed road and site improvements. No building permits will be issued until all drainage facilities have been installed and approved satisfactory road base ' completed. . The following list of final submittals must be submitted to the Zoning Administrator�two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month. These submittals are as follows: � 1. Record plat drawings in the form of three (3) mylar copies (with one copy for the City's records and two for filing with Hennepin County) and one copy reduced to 1" = 200'. Drawing to include: ' A. Lot lines platted per preliminary survey by Mark S. Gronberg of Coffin and Gronberg, Inc. dated November 29, 1993, most revised May 25, 1994. , • B. Dedication of "drainage and utility easements" as noted in Item 4 above. C. Designation and dedication of drainage easements over detention areas within both the Dickey and Coffin parcels. • D. Designation of private roads as Outlots and private driveway outlot at 30' width serving Lots 16 and 17. Dedication and designation of drainage easements over all protected � wetlands within second phase plat. F. Naming of plat. 2. Legal documents required: A. Title opinion addressed to the City. All owners, mortgage holders or others with property interest indicated therein shall sign the plat and all other documents affected by such interest. The City Attorney's office to determine if title opinion for first phase subdivision is still acceptable for second phase subdivision. � B. Signed and executed drainage easements to be taken over detention areas within plat. Applicant to obtain copies of standard easement documents • from City. C. Signed and executed developer's agreement and either a letter of credit or supplemental mortgage for site improvements and construction of private roads and drainage facilities. Applicant to obtain copies of standard developer's agreement. D. Signed and executed road and utility easements over private road outlots within Coffin and Dickey properties. E. Signed and executed declaration of private covenants covering upkeep and maintenance of private roads arid drainage facilities. F. Completed application for private road name on both Coffin and Dickey properties. Please note the selection of the road name is a separate action of the Council and should be submitted as soon as applicant has completed � ' the selection of three name choices for each roadway. . G. The private covenants of the subdivision shall include special limitations on both the private and public interior trails. Future owners shall be advised that trails within Dickey parcel are public. The trails within the • Coffin property are private and shall be constructed of wood chips placed on existing grade. As in the first phase review, the covenants should include a map and metes and bounds description and to be in a form suitable for filing. 3. � Fees to be paid: Total due: 375.00* A. Final plat fee = $175.00. B. Legal review and filing fees for subdivision and associated documents = $200.00. . C. *Payment of park fee for the second phase subdivision. Assessor to determine final fee.
