Driveway Restoration Memorandum of Understanding/ Release
1. Purpose. The purpose of the this document is to outline the understanding between the Property Owner and
the City of Orono regarding the restoration of the driveway at the subject property with respect to the 2018 West
Lafayette Road Reconstruction Project.
2. Background. As a result of the 2018 Road Reconstruction Project on West Lafayette Road, the driveway
access at 2615 West Lafayette Road to the road was restored by the City's contractor. The property owner claims
the restored driveway is too steep for proper access.
3. Special Consideration. Rather than having the city contract to adjust the driveway grade, the property owner
has agreed to include any adjustments as a private driveway re-pavement project. In consideration for a full and
final release the City will pay the Property Owner $ 2,750.00 for the adjustment to the grade of the driveway.
4.Release. In consideration of the payment by the City, Property Owner hereby releases the City of Orono, its
elected officials, employees, agents and insurers, and affiliated agencies and organizations('`Released Parties")
from any further claims related to the driveway restoration claim. The property owners acknowledge and agree
that the City intends to adopt, by way of compromise and accord, a full and final settlement relating to the Claim
with the understanding that the City has agreed to pay the consideration set forth herein strictly as a business
accommodation to avoid the uncertainty and expense of litigation and resolve the Claim without any admission of
liability.
