The Honorable Barbara Peterson IN REPLY REFER TO:

REVALIDATION
Dear Mayor Peterson:
When a new National Flood Insurance Program(NFIP) map panel becomes effective,it automatically supersedes
previously issued Letter of Map Change(LOMC)actions(i.e.,Letters of Map Revision-based on Fill [LOMR-Fs]
and Letters of Map Amendment[LOMAs])that have been issued on that map panel, even if they are still valid and
should apply to the new NFIP map as well. Because a revised NFIP map has been prepared for your community, it
is necessary for the Federal Emergency Management Agency(FEMA)to take administrative action to prevent valid
LOMR-Fs and LOMAs from being superseded. Accordingly, the purpose of this letter is to revalidate the
determinations for properties and/or structures in your community as described in the LOMR-Fs and LOMAs
previously issued by FEMA on the dates listed below. As of the above-referenced effective date, these LOMR-Fs
and LOMAs will revise the effective NFIP map for the referenced community, dated September 2,2004, and will
remain in effect until superseded by a revision to the NFIP map panel on which the property is located. The FEMA
case numbers, when available, project identifiers, and Flood Insurance Rate Map(FIRM)numbers of the revalidated
LOMR-Fs and LOMAs are listed in the attachment to this letter.
Because these revalidated LOMR-Fs and LOMAs will not be printed or distributed to primary map users, such as
local insurance agents and mortgage lenders, your community will serve as a repository for these new data. We
encourage you to disseminate the information reflected by this letter throughout your community so that interested
persons, such as property owners, local insurance agents, and mortgage lenders, may benefit from the information.
If you feel a LOMC has been omitted from the list that should have been included,we encourage you to submit the
LOMC for re-determination. When requesting a re-determination,we ask that a cover letter be sent along with a
copy of the original detern-iination letter to: FEMA, LOMA Depot,P.O.Box 2210,Merrifield,Virginia 22116.
If you have any questions regarding this matter, please contact the FEMA Regional Office in Chicago,Illinois,at
(312)408-5548. Copies of previously issued LOMR-Fs and LOMAs, if needed, can be obtained by contacting our
Mapping Coordination Contractor,Dewberry, in Fairfax, Virginia, either by telephone at(703) 876-0148,or by
facsimile at(703)876-0073.
Sincerely,
Doug Bellomo,P.E.,Acting Chief

DEAR MR.AND MRS.DUNKLEY:
This is in reference to a request that the Federal Emergency Management Agency (FEMA) determine if the
property is located within an identified Special Flood Hazard Area, the area that would be inundated by the
flood having a 1-percent chance of being equaled or exceeded in any given year (base flood), on the
effective National Flood Insurance Program(NFIP)map. Using the information submitted and the effective
NFIP map, our determination is shown on the attached Letter of Map Amendment (LOMA)Determination
Document. This determination document provides additional information regarding the effective NFIP
map,the legal description of the property and our determination.
Additional documents are enclosed which provide information regarding the subject property and LOMAs.

ADDITIONAL CONSIDERATIONS(Please refer to the appropriate section on Attachment 1 for the additional considerations listed below.)
PORTIONS REMAIN IN THE SFHA
This document provides the Federal Emergency Management Agency's determination regarding a request for a Letter of Map Amendment for the property
described above. Using the information submitted and the effective National Flood Insurance Program (NFIP) map, we have determined that the
structure(s)on the property(les)is/are not located in the SFHA,an area inundated by the flood having a 1-percent chance of being equaled or exceeded in
any given year(base flood). This document amends the effective NFIP map to remove the subject property from the SFHA located on the effective NFIP
map; therefore, the Federal mandatory flood insurance requirement does not apply. However, the lender has the option to continue the flood Insurance
requirement to protect its financial risk on the loan. A Preferred Risk Policy(PRP)is available for buildings located outside the SFHA. Information about
the PRP and how one can apply is enclosed.
This determination is based on the flood data presently available. The enclosed documents provide additional Information regarding this determination. If
you have any questions about this document, please contact the FEMA Map Assistance Center toll free at(877)336-2627(877-FEMA MAP)or by letter
addressed to the Federal Emergency Management Agency,P.O.Box 2210,Merrifield,VA 22116-2210.

Dear Tammy:
The current Lake Minnetonka elevation is 928.95 feet, 1929 datum. The 100 year flood
level for the lake is 931.5 feet. We measured the basement floor elevation of the
William Dunkley residence at 2709 Walters Port Lane, Excelsior at 940.8 which is well
above the 931.5 elevation. The first floor elevation is at 950.0 feet.
