Dunlcley, husband and wife, " (hereinafter "Owners") are owners of the property located at 2709 Walters Port Lane within the City of Orono (liereinafter "City") and legally described as: Lot 4 Block 3 Walters Port, Hennepin County, Minnesota(hereinafter "the property"); and WHEREAS, for the purpose of adding a second story to the existing residence Vogue ICF Homes, Inc. (hereinafter "Applicant") has made application on behalf of the Owners to the City for variances to Municipal Zoning Code Section 78-1279 to allow a • lakeshore setback of 30 feet when 75 feet is required and an average lakeshore setback to allow expansioii of a house entirely forward of the average lakeshore setback; and WHEREAS, after due published notice and mailed notice iii accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on October 16, 2006, at which times all persons desiring to be heard concenling this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: . FINDINGS 1. This application was reviewed as Zoning File#06-3238. 2. The property is located in the LR-1B zoning district, where 1 acre is the minimum lot area and 140 feet is the minimum lot width. The property is approximately 0.4 acres in area and 300 feet in width. 3. The Planning Commission reviewed tlus application on October 16, 2006 and on a vote of 5 - 1 recommended approval of the variances subject to the center pealc being lowered to 28 feet 11 inches,based on the following findings: a. The slope of the existing roof is very shallow. It zs difficult to maintain • and is not in character with other houses in the neighborhood. The existing fouiidation and exterior walls will be retained. The interior will be stripped, but because past roof leaks have created concerns about mold. c.� The Applicant agreed to lower parts of the roofline to address concerns about the mass of the addition. 4. The City Council reviewed the application on November 13, 2006, and determined it would be appropriate to require that the remodeling of the exterior incorporate the use of dark earthtoiie colors to reduce the visual impact of the additions so close to the Lalce. 5. The City Council has considered this application including the findings and • recommendation of the Planning Commission, reports by City staff, comments by the applicant, owners and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 6. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the owners, but is necessary to alleviate a demonstrable hardship or difficulty; is necessaiy to preserve a substantial property right of the applicants; and would be in keeping wit11 the spirit and intent of the Zoning Code and Comprehensive Plan of the City. r CONCLUSIONS, ORDER AND CONDITIONS Based upon the above findings, the Orono City Council hereby grants variances to Orono Municipal Zoning Code Section 78-1279 to allow the addition of a second story to the existing residence, subject to the following conditions: 1. Council approval is based on the house plans submitted by the Applicant and annotated by City staff, attached to this Resohrtion as Exhibit A. Hardcover in the 0-75' zone shall be limited to 5,933 s.f. or 33.8% and 3,386 s.f. or 47.6 %, in the 75-250', per allowance summary as depicted on Exhibit B. The Owners are advised that aiiy future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existnig hardcover. 3. Owners shall incorporate darker earthtone colors in their exterior materials, subj ect to approval by City Staff. 4. Owners shall not place any plastic or fabric liner material under any landscaping on the property to ensure their permeability as non-hardcover surfaces. � 5. Authorities granted by this resolution run with the property not with the Owners, but are permissive only and must be exercised by obtaining a building permit for the new construction before November 27, 2007 or the variance will expire on that date. 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall coilstitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned Owners have read, understand and hereby agree to the terms of this resolution and on behalf of their heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property.
