Additional Message:
The attached memo describes the City's position regarding Lot 2, Block 1 Wakefield Farms and
Outlots D &E and Lot 6, Wakefield Farms 2nd Addition. In order to create an additional lot from
these various properties, you must show that:
- each resulting lot has at least 2.0 acres of contiguous non-wetland area with the existing or
proposed homesite (this will require a delineation of the wetlands on the properties);
- each resulting lot has tested and acceptable primary and alternate on-site sewage treatment system
sites;
- each resulting lot can gain access to a public or private road; the need for wetland impacts to
accomplish access may be problematic;
- each resulting lot meets all other standards for subdivision within the RR-1 B 2-acre zoning district.
If the above items can be satisfied,a subdivision to create a new lot might be possible,subject to the
City Council's willingness to amend the legal combination requirements imposed in 1981. If you
choose to proceed, please provide me with your suggested lot layout so we can point out any
potential issues...

Subject: Outlots D &E, Wakefield Farms 2nd Addition
Synopsys: Outlots D &E were supposed to become part of 430 Wakefield Road. They have
since been acquired by the owner of 360 Wakefield Road. An attempt to combine Outlots D
& E with 360 Wakefield Road will require Council ap rp oval.
We have received an inquiry regarding the potential for combination/division of Outlots D & E,
Wakefield Farms 2nd, with Lot 6, Wakefield Farms 2nd (360 Wakefield Road) to create a new
building site.
Outlots D & E were created as part of the plat of Wakefield Farms 2nd Addition in 1990. A
condition of plat approval (Resolution No. 1284) was that Outlots D & E were to be "legally
combined for tax purposes with Lot 2, Block 1, Wakefield Farms (430 Wakefield Road) which
together shall be thereafter considered as one building site."
Outlot D was intended as additional potential septic site area for 430; Outlot E was added to the plat
toward the end of the subdivision process,probably as part of an agreement between the subdivider
and the owner of 430 at that time.
Apparently, Outlots D&E never were legally combined with Lot 2,Block 1,Wakefield Farms. In
1990 Outlots D&E went tax forfeit.The City released them for sale to certain adjacent landowners
specified in Resolution No. 2910; however, Lot 6, Block 1, Wakefield Farms 2nd Addition (360
Wakefield Road),was not one of the specified potential recipients. It is unknown whether this was
on purpose or through error; it is also possible that certain laws may have prohibited the City from
specifying which adjacent owners were eligible.
At any rate,the owner of 360 has since acquired Outlots D&E but has not legally combined them.
Such a leizal combination at this time would be in conflict with the conditions of Resolution No
1284 and would require Council approval. If such approval was granted,any proposed subdivision
to create a second building site from the combination would have to stand on its own merits.

OF WAKEFIELD FARMS
WHEREAS, the City of Orono is a municipal corporation organized It
and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application for
a subdivision plat by Wakefield Holding Company, Inc. , a Minnesota
corporation, the subdivider; and

WHERE-AG, the subdivider has completed all requirements of
' the platting regulations of the City, including:
-j 1. Dedication on the plat of drainage and utility easements.
2. Dedication on the plat of rights of way for public streets
and roads, shown as Cold Long Lake Road.
3. Creation of a new private road shown on the plat as Outlot B.
Concurrent with the creation of this private road, the j

Easement (Exhibit A) granting to the City permanent access

e City has required the upgrading of the access road
meeting all current private road standards for a plat
of eight residential lots, any future resubdivision of
Outlots A and B, Wakefield Farms Second Addition or
OutlotC, Wakefield Farms, may require the paving
of the existing road in addition to an extension or re-
location of said road.
2) Outlot D and Outlot E shall be legally combined for tax
purposes with Lot 2 , Block 1, Wakefield Farms,
which together shall be thereafter considered as one
building site.
3) All conditions of Resolution No. 1229 approving the
original plat of Wakefield Farms which applied to the
property now redivided as Wakefield Farms Second Addition
shall continue in effect including the recorded flowage
and conservation easement over the wetlands areas on
Outlot A, Outlot D, Outlot E and Lot 6, Block 1, Wakefield
Farms Second Addition.
4) The aforesaid plat shall be filed by the City of Orono
with the Hennepin County Recorder ' s Office together
with a certified original copy of this Resolution and
executed copies of Exhibits A and B as noted above.

ik A RESOLUTION APPROVING THE PLAT OF
WAKEFIELD FARMS SECOND ADDITION
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and;
WHEREAS, the City Council of the City of Orono has adopted
subdivision. regulations for the orderly, economic and safe develop-
ment of land within the City; and
WHEREAS, the City Council has considered the application
for a subdivision plat by Dale K. Warner and Ann C. Warner, the
subdividers, and;
WHEREAS, the subdivision has been approved as meeting
all septic standards and the standards of the RR-lB zoning dis-
trict finding that each lot is of a size and configuration that
will allow its use as a single family residence to be located
without the need of any setback variances; and
WHEREAS, the subdivider has completed all requirements
of the platting regulations of the City, including:
1) Dedication on the plat of drainage and utilities easements.
2) Creation of a section of private road shown on the plat
as Outlot C together with the remainder of the private
road designated as Outlot B, Wakefield Farms , to be known
henceforth as Wakefield Road.
3) Concurrent with the creation of this private road, the
subdivider has dedicated to the City a Road and Utilities
Easement (Exhibit A) granting to the City permanent access,
improvement and utility easements over said Outlot; the
subdivider has created non-exclusive ingress, egress ,
drainage and utility easements (Exhibit B) over said
Outlot in favor of all abutting and/or benefiting lots
including a declaration of certain maintenance covenants
wherein each of the abutting and/or benefiting lot owners
covenants and agrees to, permanently maintain and pay the
cost of maintenance for said private road.
4) Payment to the City of a Park Dedication Fee in the amount
of $1, 200. 00.
5) Payment of the City for legal review and filing fees is
the amount of $50. 00 .
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Orono hereby approves the plat of Wakefield Farms
Second Addition, Hennepin County, Minnesota; subject to the follow-
ing conditions:

TAX FORFEITED LAND RELEASED
FOR PRIVATE SALE TO ADJACENT OWNERS
WHEREASI the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota;
and
WHEREAS, pursuant to Minnesota Statutes 282, the City
has received from Hennepin County a list of lands within the City
which have become the property of the State of Minnesota for non-
payment of real estate taxes; and
WHEREAS, the City Council has reviewed said lands for
compliance with local zoning ordinances, for the amount of
outstanding special assessments remaining unpaid to the City,
and/or for possible public use by the City as authorized by the
Statutes.
NOW, THEREFORE BE IT RESOLVED that the City Council of
the City of Orono, pursuant to Minnesota Statutes 282, hereby
approves the classification of each of the following parcels of
land as non-conservation land, and furthermore, approves the
public sale of each parcel of land as listed below to adjacent
property owners.
All parcels remain subject to all applicable zoning
ordinance provisions, including those regulations providing ' for
minimum lot area and minimum lot width. Substandard parcels may
be useable only in combination with other adjoining parcel (s) .
Release of these lands by the City Council is subject to
the condition that all outstanding special assessments shall be
paid in full to the City upon return to private ownership. Any
amount not recovered at the time of sale shall be subject to
reassessment by the City.

POLICE OFFICER TEMPORATY APPOINTMENT CONTINUED
Bernhardson replied, "The City is required to pay for three
weeks of leave and may have already paid for two weeks of active
duty. "
It was moved by Peterson, seconded by Mayor Grabek, to
employ Mr. Timothy Roberts as a full time, temporary police
officer at leve'_ 6 of the Orono pay plan at a rate of $11. 359
hourly with no benefits. Employment .is effective December 4,
1990, subject to satisfactory physical examination. This
temporary position is :o run until Officer Dembouski returns to
duty. Motion, Ayes-4 , Nays-0. Motion passed.
EXTENSION OF UNPAID LEAVE OF ABSENCE - JAMIE BOSMA*
It was moved by Mayor Grabek, seconded by Peterson, to
extend the unpaid leave of absence of Jamie Bosma to Wednesday,
January 16 , 1991, and to employ Laurie Scheffler as a temporary
clerical employee on January 9, 10 , and 11, 1991 for a total of
5h hours per day, at a rate of $9.182 per hour. Motion, Ayes-4,
Nays-0. Motion passed.
TAX FORFEITED PROPERTY
RESOLUTIONS #2910 and #2911
Councilmember Goetten requested the removal of this item
from the Consent; Agenda. She asked how large the parcels are and
what process occurs once a parcel becomes tax forteited.
Bernhardson replied, "Unless the City has a public purpose
for a tax foreited parcel , we cannot take it. One of the parcels
is 90 , 00 square feet. "
Mabusth added that parcel is mainly wetlands. She stated
that the smaller parcel is dry buildable land and was created for
the property owner to the immediate north to acquire for septic
expansion.
Goetten asked what would happen to the larger parcel with
the wetland area. '
Mabusth replied, "We are recommending the sale of that
parcel to an adjacent property owner. "
Callahan asked if there is any law that requires tax
forfeited parcels to be sold only to adjacent property owners.
Bernhardson stated that there is no such law, but that the
city in which the property is located can require that as a
condition of sale.
It was moved by Goetten, seconded by Peterson, to adopt
Resolution #2910, releasing tax forfeited land for private sale
to adjacent owners, and Resolution #2911, conveying tax forfeited

land for public use by the City of Orono. Motion, Ayes-4,
Nays-0 . Motion passed.
COUNCIL SELECTION PROCESS
Councilmember Goetten requested the removal of this item
from the Consent: Agenda. She referred to the draft letter that
would be sent to the applicants for the vacant Council seat.
Goetten asked whether it is still everyone ' s wish to include
Navarre Redevelopment in paragraph #3. She also asked whether
"Long term street and transportation planning" included the issue
of public/private roads.
Bernhardson replied, "It may no longer be necessary to
include Navarre Redevelopment and the street and transportation
planning can include public/private roads. "
It was moved by Goetten, seconded by Mayor Grabek, to
authorize staff to transmit the letter to all interested
applicants with the changes noted by Councilmember Goetten.
Motion, Ayes-4 , Nays-0. Motion passed.
1991 FEE ORDINANCE AND SUMMARY PUBLICATION

It was moved by Mayor Grabek, seconded by Peterson, to adopt
Ordinance #91, Second Series , approving the 1991 Fee schedule and
€-� summary for publication as presented in Attachment A. Motion,

AUTHORIZATION TO DISBURSE CITY FUNDS FOR CLAIMS RECEIVED*
It was moved by Mayo= Grabek, seconded by Peterson, to
authorize the City Treasurer to disburse City funds in payment of
claims received for the December 24th Council meeting, which has
been canceled and that such paid claims are to be presented at
the January 14 , 1991 regular Council meeting for formal approval.
Motion, Ayes-4 , Nays-0. Motion passed.
1991 INTERFUND TRANSFERS AND LOAN PAYMENTS*
It was moved by Mayor Grabek, seconded by Peterson, to
approve the interfund operating transfers, loan payments, and
special assessment payments on City property as presented,
effective December 31, 1990. Motion, Ayes-4 , Nays-0. Motion
passed.
ADMINISTRATOR'S INFORMATION*
It was moved by Mayor Grabek, seconded by Peterson, to
accept the City Administrator ' s Information regarding: Rules of

General Review and Comments
Lot Configuration - There is 00+ feet at the proposed building sites of each
lot. Lot 3 has a 60ft wide corridor providing access to private road. Outlors
A and B are to be combined with Lot 2, Blk 1, Wakefield Farms. Outlot C is to krgk' •
be combined with Bruce Dayton's property to north and west. Outlot D is to be
combined with the Warner residence directly south of outlot. Oudot C of the r �

original Wakefield Farms plot should be designated as an exception or repeated
as an outlot.
Access road - Access road will serve 8 resid::nces. Developer must upgrade �F
existing road to gravel base, 24ft wide surface, 5 ton capacity and cul de sac
for turn-a-round. Where should cul de sac br; located?--- Should cul de sac
abut outlot C? Does Planning Commission feel an access dedication to the
western property creating a future loop road reasonable at this point in time?
Wetlands - As presented in this plan Lot 6, B1k. 1, Outlots A, B C and D are

Septic Testing - Septic test information *-u being reviewed by stair. A
