Absent: Hake and Kullberg. Councilman Paurus also present. Curtis moved, Pesek seconded, that the Minutes of the Regular Meeting of September 16, 1974, be approved. Motion, Ayes (7) , Nays (0). This variance for Donald Ekeberg, Lot 4, Loma Linda, 1056 Loma Linda Avenue, was approved as a buildable lot by Village Council action in 1969. Some discussion was held on placing a statute of limitations on variances in the new code using a six month to one year period as a guideline. Since this is a lot of record and in single separate ownership, sewer is available and many other lots of the same size exist in the area, Curtis moved, Elliott seconded, to recommend )proval. notion, Ayes (7) - Nays (0). Members agreed that the wetlands variance for the Thomas Development Company, North Arm Lane, should be tabled until topographical maps are submitted showing present areas and elevations versus final, after filling. Members agreed that the wetlands variance for Ray Southworth, 405 Willow Drive South, should be tabled until topographical maps are submitted showing present areas and elevations versus final, after filling. Members agreed that the wetlands variance for John Burger, 3700 Bayside Road, should be tabled until topographical maps are submitted showing present areas.and elevations versus final, after filling. 7:30 P.M. Members concurred that Arthur Bendel since Ivy Lane, running parallel with subject 3559 Ivy Place 'lot, only shows.•.a width of 181, a survey should s presented to the panel before any further study )De made. Dr. C. C.. Berg, 4080 Bayside Road, presented a DIVISION & VARIANCE new subdivision' proposal showing the new lot size Dr.' C.. C. Berg to be'2h acresjinstead of the original one acre, 4080 Bayside Road Pesek stated that one of the conditions to granting a variance was that a hardship be indicated. Since'`.there was enough land available to meet the piroposed five acre zoning, he felt value should not be variable in considering variances, using, a -rule of thumb that more lots make easier soles, Van Nest felt Dr. Berg had met the spirit of the zoning by increasing his acreage 23�-, time the..original proposal and the topography was such that this would be adequate lot. Pesek moved, Kallestad seconded, that the division be denied.. Motion, Ayes (4).- Nays (0). Guthrie and Van-Negt Nay. Gasch abstained. Gasch moved, Kallestad seconded, that the CONDITIONAL USE PERMIT: cond*tional use for Butterfield Flowers, 3743 Butterfield Flowers Watertown Road, to place a sign according to 3743 Watertown Road asign submitted, conditioned on its placement meeting the zoning standards of a 10' setback from any lot lines, be approved. Motion, Ayes (7) - Nays (0). Fred Rogers, 3175 North Shore Drive, represented VARIANCE himself in a presentation. Questioning revealed Fred Rogers he lived on Tract H, adjacent to Tract G. Since 3175 North Shore Drive the two lots Tracts G & H more closely met the present zoning than Tract G alone, which was a bit shy of ene -half acre of the required one acre, and the topography was such to make the two lots look like a single lot, Van Nest moved, Guthrie seconded, that the variance be denied. Motion, Ayes (7) - Nays (0). Fred Rogers represented himself in regard to a VARIANCE variance request for 1410 Bohn's Point Road, Fred Rogers Parcel 1210, Sec. 9. Since this lot could not 1410 Bohn's Point Road be combined with any other property of the owner, Van Nest moved, Guthrie seconded, that the variance be allowed conditioned on: No other variance but lot size and width be allowed. 2. The present house be razed by August 1, 1975. 3. The barn be razed as soon as a new residence is constructed. Motion, Ayes (7) - Nays (0) . PLANNING COMMISSION MINUTES, OCTOBER 15, 1974 Charles Schoen, 1225 Briar Street, Monterey on Minnetonka, request for a division. oince there was a need for a garage, this was a'log,ical placement and the 12' transfer of property did not appreciably affect the subject properties, Kallestad moved, Van Nest seconded, that the division be allowed. Respectfully submitted, Michael Scheller Building Inspector Page 3 DIVISION 1225 Briar Street ADJOURNMENT VILLAGE OF ORONO Continued Meeting of the Planning Commission, October 16, 1974 The Planning Commission met on the above date with the following members present: Chairman Guthrie, Curtis, Elliott, Gasch, Hake, Kallestad, and Van Nest, Councilman Paurus also present. Absent: Kullberg and Pesek. A study of the application for a variance for Russell Wenkstern, 645 North Arm Drive, Aud. Sub. 332, Parcel 1010, brought out: 1. The high buildable land was 0.95 acre, 0.5 acre short of the one acre zoning required. This was our engineer's calculation. 2. The area will be sewered in the near future, this being planned as the end of the line. 3. This is a long narrow lot, necessitating a small setback variance from either the street or the lake. Van Nest moved, Elliott seconded, that the lot size be recommended for approval and a variance of 15' from the required 75' required from the lake, be granted. Motion, Ayes (7) - Nays (0). Charles Gross and Wallin Jungquist presented a petition for a conditional use permit to change a non - conforming dry cleaning plant to an antique store usage. Letters were read from the Chief of Plice and Officer Ward, stating there was some trepidation regarding traffic problems that could arise at this site. The building department has forwarded a recommenda- tion that the building was hazardous in so far as the exterior porches were concerned. There was also concern about a precedence being established.. In light of the above, Curtis moved, Kallestad, seconded, that disapproval be recommended. Motion, Ayes (7) - Nays (0) . 7:30 P.M. VARIANCE 645 North Arm Drive CONDITIONAL'USE PERMIT 2259 Shadywood Road I Calhoun Realty represented Dr. M. M. Yokoyama, DIVISION 2675 Shadywood Road, Lot 24,�Pheasant Lawn, 2675 Shadywood Road in an application for a'division. Since the subdivision met the zoning standards, -4uthrie moved, Gasch seconded, that approval be recommended conditioned on both lots using the same curb cut on Shadywood Road. Motion, Ayes (7) - Nays (0). PLANNING COMMISSION MINUTES, OCTOBER 16, 1974 A legal representative spoke for T.M.G. Investment in an application for a subdivision. Lthrie read a letter from Hennepin County High- way Department, dated October 1, 1974, stating intent to carry County Road #6 through this property in the future. The representative stated this was a surprise to him. Members felt that before any further study of this plat could be made, the owners should dedicate a right of way.through this property. Members felt that since this was a revised plat for Cheyenne Land Company, Orono Orchard Road and Wayzata Boulevard, this should be placed on the Village Council agenda for another referral to the Planning Commission. Russell Lund represented himself in the matter of a 140' short -wave antenna constructed without a building permit. Mr. Lund spoke 15 minutes in technical terms on the rationale for a 140' antenna. I have asked him and he has agreed to send me a letter to be a matter of record on his reasons, as it is extremely difficult for a layman to take minutes on a .atter.as technical as this. Messrs. George Johnson, Willard Hurr, and Gabriel Jabour appeared in opposition to the antenna stating that if we have height restrictions, they should be enforced. Van Nest moved, Elliott seconded, that this be tabled for further study and'that a committee of three be appointed to make a special study group to accomplish this. Volunteering were: Kallestad, Curtis and Hake. Motion, Ayes (7) - Nays (0) . John Holmquist represented Samuel Marfield in his application to grade in the 75' lake setback. He showed new plans showing the removal of two mature trees instead of three and a diversion of runoff to the existing marsh instead of the lake. Van Nest asked Mr. Holmquist what the purpose was for the application and was notified it was for the explicit purpose of improving; acco» to the lake and improve the walk -out site. Members felt the impact of work being done on the environment was not in line with benefits received and there was no demonstrated hardship shown. Gasch moved, Van Nest seconded, that denial be recommended. Members felt they should have some technical input from somebody knowledgeable on the Flood Insurance Plan. This variance for Howard Larson, 1465 Long Lake Boulevard, was tabled in 1974 awaiting the completion of the Comprehensive Guide Plan. The owner wished to reopen the case again. After studying the plat maps and based on personal viewing of members, Van Nest moved, Gasch seconded, that the matter be tabled. Since the area needs on -site septic systems, they felt that the owner should provide the panel with a certified report by a licensed engineer showing how such an on -site system could be installed on this hilly site. Motion, Ayes (7) - Nays (0) . an Nest moved, Hake seconded, that the words 50% of the lot width and area in the sewered-area" as proposed in the lot of record ordinance should be changed to 80 %, and that all variance applications for unsewered areas would require Village Council and Planning Commission action. Motion, Ayes (7) - Nays (0). A memo from the Building Inspector asking for recommendation on a proposed privacy fence ordinance was recommended to go to the Village Council for input. Hake moved, Guthrie seconded, that the meeting be adjourned at 11:15 P.M. Motion, Ayes (7) - Nays (0) .
