August 26, 1974 The'Planning Commission met on the above date with the following members present: Chairman Guthrie, Curtis, Elliott, Gasch, Hake, Kallestad, and Pesek. Absent: Kullberg and Van Nest. Also present: Mayor Searles and Councilman Paurus. Guthrie stated that all municipalities were PUBLIC HEARING required to hold a- public hearing at the Comprehensive Guide Plan completion of the Comprehensive Plan then vote on recommendation. Then the Plan is forwarded to the Village Council for approval. From there it goes to the Metropolitan Council for review and recommendations, which could take from 30 -60 days. The Plan is based on } two reports by Brauer & Associates, one based on a series of seminars, the other on a general survey of Orono. It was meant to be a simple, readable complete policy statement based on the best thinking of today to make j a reasonable package. There also could be future unforeseeable things that could r 7 "' "change thp, policy. -* This would be done when necessary. Mayor Searles and Chairman Guthrie now commenced reading the Plan and invited comments from the audience. When the estimated population growth was read, the .question was asked if major shopping centers, - as Ridgedale, would not have an impact on growth as projected. Searles stated it i` `definitely could be a factor. When the need to retain wetlands was read, Ray South - worth asked if there was a clear definition of wetlands. Searles stated the geodetic map used could be somewhat obsolete but when new development takes place, both the project and Village engineers make topographic maps to clearly define the wetlands. After the chapter on lakeshore commercial was read, Ray Kempf commented that all marinas would be wiped out if they wished to meet these qualifications. Searles stated that the Plan intended merely to limit and regulate future growth and it was recognized some consideration would have to be given existing facilities. •Y- PUBLIC HEARING MINUTES AUGUST 26, 1974 Page 2 Steve Shank, of Tonka Toys, commented that changing any zoning to residential along .railroad tracks would render property worth- less as the two are not compatible. Searles stated that the railroads in Orono are very limited in use and some of our most beautiful residences lie along these tracks. Mr. Ewald, of Northwestern Bell Telephone Company, expressed some concern for any rezoning: After the reading, Guthrie stated there were limited copies that could be had for anybody genuinely interested in studying the Plan further. Since nobody else wished to be heard, Elliott moved, Pesek seconded, that the Comprehensive Guide Plan, as written, should be recommended for approval. Motion, Ayes (6) - Nays (0). Hake left early. VILLAGE OF ORONO Regular Meeting of the Planning Commission, September 16, 1974 The Planning Commission met on the above date with the following members present: Chairman Guthrie,,Curtis, Hake, Kullberg, Pesek, and Van Nest. Absent: Elliott; Gasch, and Kallestad. Also present: Mayor Searles. Curtis moved, Hake seconded, that the Minutes of the Regular Meeting of August 19, 1974, be approved. Motion, Ayes (6) - Nags (0). David Maiser, 498 Park Lane, represented himself in a front setbAck variance from the requited 351 to 51 citing the hardship to construct at the 351 building line was due to the steep dropoff to the lake that would involve enormous construction costs and destroy the natural beauty of the area by tree removal. Since there were only two potential building sites on this unmaintained dead end, Kullberg moved, Van Nest seconded, that the variance be allowed conditioned that the jarage be set so there would be no parking infringing on the street. Motion, Ayes (6) - Nays (0) . Les Raskob represented himself in a lot size variance to construct a residence at 860 Dakota Avenue, legally described as Lot 6, Johnson's Rearrangement of Albees. Since there are only two other building sites left in this old subdivision and the lot size conforms substantially with the built- upon -lots in the subdivision, Van Nest moved, Kullberg seconded, to recommend approval contingent on approved percolation tests. Motion, Ayes (6) - Nays (0) . Jim Argabright represented himself in a lot size variance to construct a residence on Lots 6 -7 -8, Block 7, Minnetonka Summit Park. It was noted that the lot size conforms or surpasses most of the built upon sites in the area and sewer would soon be .vailable. Kullberg moved, Van Nest seconded, approval be recommended subject to using holding tanks until sewer is available. Motion, Ayes (6) - Nays (0) . 7:30 P.M. MINUTES VARIANCE 498 Park Lane VARIANCE 860 Dakota Avenue VARIANCE 4085 Oak Street 6 PLANNING COD94ISSION MINUTES OF SEPTEMBER 16, 1974 The application for Dr. M. M. Yokoyama, 2675 Shadywood Road, was tabled for lack of an appearance to answer questions. Samuel Marfield represented himself in a variance to grade and remove trees within the 751 lake setback area on a lot he proposes to construct on in the newly platted DiCon subdivision. Adjacent neighbors, Mr. & Mrs. Levy, appeared in opposition to setting any precedent in allowing any variance to the ordinance prohibiting this. On studying the topographic map Mr. Marfield submitted showing proposed changes, members felt there would be a diversion of runoff now going into an adjacent marsh to the lake. Van Nest moved, Curtis seconded, that because there was no hardship shown to warrant a variance, denial be recommended. Motion, Ayes ( 6) - Nays (0) . James Dir-acles represented the Cheyenne Land Company in obtaining approval for a, preliminary plat. He said the company had aow removed the objectionable long cul -de -sacs and felt the plat as now presented should be approved because: 1. It should be evaluated under the present zoning, not the proposed. 2. That future Highway 1012 should not be considered in the evaluation of this plat because it is not on the five -year capitol improvement plan for District 5 nor on the 10 -year improvement plan. He then stated that in 1971 there were proposed three alternatives for the highway, not all of them going through the property and that no firm commitment to use any one of them has been arrived at. Mayor Searles stated that while no condemnation proceedings have started, there have been many serious studies and hearings made on the location and there is some reasonable assurance of the location. Guthrie said'some traffic studies should be generated to determine'the hazards involved in entering present Highway #f12 at the under- pass; also, that Orono Orchards Road is Tanned for a parkway in the new zoning plan. Page 2 SUBDIVISION 2675 Shadywood Road CONDITIONAL USE PERMIT Scotch Pine Lane PRELIMINARY PLAT Cheyenne Land Company • PLANNING COMMISSION MINUTES OF SEPTEMBER 161 1974 Searles questioned whether Long Lake had the capacity to absorb the sewage of.a.Y: subdivision as large as this and this should be explored. Van Nest felt the plat as presented did not meet the present code in some areas, namely: Lot 3, Block 4 shows 1.07 acres -- 0.75 acres dry, 0.37 acre wet; �dt 4, Block 4 shows 1.05 acres - 0.80 acre dry, 0.25 aore wet. The road going thibugh tots lb,,Block 9 shows an elevation 5' higher than the marsh it goes through. The road going through Lots 7 -8, Block 3 shows an elevation 4' -5° higher than a swamp. Mr. Diracles stated he would run down valid faults in the plat. Van Nest moved, Pesek seconded, that the Planning Commission recommends that the Cheyenne Land Company plat be disapproved as it does not meet the requirements of our present code in the following areas: 1. Lot 3, Block 4 does not meet the requirement of one acre of dry buildable land. 2. Lot 4, Block 4 does not meet the requirement of one acre of dry buildable land. 3. Part of Cheyenne Trail is to be constructed on a marsh requiring fill and therefore is not in compliance with•Ordinance No. 125. 4. Part of Westwood Trail is to be constructed on a marsh requiring fill and therefore is not in compliance with Ordinance No. 125. Furthermore, this preliminary plat is not consistant with the comprehensive plan and the proposed zoning code. The land area is proposed at a two -acre residential land use suitable for onsite sewer and water systems. This decision was proposed by the Planning Commission as a result of several important factors, two of which are as follows: 1. Several years ago, Mr. Dwain Brown of the Minnesota Highway Department discussed possible routes for the new Highway #12, many of which included the use of this area. It should be noted that the plat map shows land directly to the east has already been platted as Highway #12 right -of -way. The comprehensive plan shows Orono Orchard Road as part of the scenic parkway system within Orono. This fact together with a public safety consideration concerning the two dangerous underpasses on Orono Orchard Road, dictate that this entire area be zoned to a low density rural residential land use. The comprehensive plan was adopted by the Planning Commission on August 25, 1974 and was accepted by the Village Council on August 26, 1974 in accordance with State statutes. The Village fully intends to maintain the building moratorium in force until the comprehensive plan has been adopted and the general rezoning package has been passed into law. This should be completed not later than December 31, 1974. It is not the intention of the Planning Commission to delay or impede the developer Ln the rightful development of this land and we again wish to suggest that the developer resubmit this preliminary plat in accordance with the proposed zoning code. The Planning Commission will make every effort to expeditiously process any new preliminary plat recommending that the Council grant a variance to the building moratorium and approve the plat provided it meets the requirements of the proposed zoning code. Motion, Ayes (6) - Nays (0). The preliminary plat to T M G Investment was studied. Since there were no appearances to answer questions, the matter was tabled. The secretary was instructed to contact the Highway Department if there was any usage being planned for this area for future ring routes that are in the offing. A letter from Rex Ressler stating the garage he said would be removed when a permit was granted for a new one would be removed by 1pproximately October 1, 1974.
