Regular Meeting of the Planning Commission, 7:30 P.M.
August 19, 1974
The Planning Commission met on the above date
with the following members present: Chairman
Guthrie, Curtis, Hake, Kullberg, and Van Nest.
Elliott at 8:00 P.M. Pesek at 8:25 P.M.
Absent: Gasch and Kallestad.
Curtis moved, Kullberg seconded, that the MINUTES
Minutes of the Regular Meeting of July 15, July 15, 1974
1974, be approved. Motion, Ayes (5) - Nays (0).
Curtis moved, Kullberg seconded, that the MINUTES
Minutes of the Public Hearing of July 29, July 29, 1974
1974, be approved. Motion, Ayes (5) - Nays (0).
Guthrie opened a public hearing on the PUBLIC HEARING
vacation of Lake Street in Ottoville. STREET VACATION
Since nobody wished to be heard, the hearing Lake Street
was closed.
Tom Betz showed the realignment proposed to STREET VACATION
compensate the Village for the present 30' 3775 Bayside Road
�f Lake Street by detouring it another way.
Van Nest moved, Hake seconded, that the
realignment as submitted be approved. Motion,
Ayes (5) - Nays (0) .
William Dolder represented himself in a VARIANCE
petition for a variance to construct a 3505 Livingston Avenue
residence on Lot 1, Block 4, Navarre Heights,
3505 Livingston Avenue. He was asking for a
variance in size from one -half acre to 6,750
sq. ft., in width from 100' to 50', from one
side setback of 10' to 41, to place a
26' X 50' house thereon. He showed a letter
from the neighbor being encroached on stating
he had no objection. The neighbor's residence
was 40' ffom the line.
Van Nest moved, Kullberg seconded, that since
the lot size is consistent with many other lots
in the area, there is a sewer and water
assessment on the lot and service available
to avoid any health problems, approval be
recommended. Motion, Ayes (6) - Nays (0) .
�-en Roelofs represented Erling Falk in a VARIANCE
petition for a variance to place a garage 1981 Fagerness Point Rd.
addition on his home at 1981 Fagerness Point
Road. Members agreed it was the only place a
garage could be constructed due to terrain.

Kullberg moved, Hake seconded, that the
addition be allowed 8' from the, front.--...
?roperty line in alignment with'the present
residence, conditioned on reducing any
excessive hard cover on both sides of the
road due to proximity to the lake. Motion,
Ayes (6) - Nays (0).
Members studied the preliminary plat for a
simple subdivision as presented by John
Burger to divide off a parcel from his
16 -acre homesite to contruct a residence
for his son. Since the lot met the require-
ments of the proposed zoning and showed an
adequate 50' easement to the property and
there was no need for future streets in the
araa I
Pesek moved, Curtis seconded, that.approval
be recommended contingent on approved
percolation tests. Motion, Ayes (7) -
Nays (0) .
T110 Investment was represented by Frank
Berman in a presentation of a preliminary
,
to divide Parcels 1185 . •1525, 4520,
4510, 3500 & 2500 in Sec. 30 & 31 into
54 lots and one outlot. The engineer's
report was read recommending:-
1. All preliminary plats should be in accord
with the Comprehensive Plan for the City:
2. Preliminary street showing present grade,
proposed grade (every 1001) complete with per-
of grade and showing satisfactory disposition
of storm water.
3. Proposed building setback line on all lots.
4. Names of adjacent property owners.
5. The maximum length of a cul -de -sac has been
set by the City's building Code.- Preliminary
street layouts must comply with this code.
A further study of the plat, and also site
reviews by members showed there was much marsh
area being divided. Van Nest explained the
rationale behind Ordinance No. 125 and a copy
was given to Mr. Berman along with a check list
for requirements for a preliminary plat..
`_scussion now centered around the proposed

explained that placing 54 residences in an SUBDIVISION,
isolated area as this, with on -site systems TMG Investment
would only pave the way fora sewer project (Continued)

propeaty. T,Ir. Berman agreed to.submit a
revised plat.
Kullberg moved, Curtis seconded, that the VARIANCE
variance petition of David Maiser, 498 Park 498 Park Lane
Lane, be deferred until he presents himself
to answer questions. Aiotion, Ayes (7) - Nays (0).
Kullberg moved, Curtis seconded, that the
variance petition of Les Raskob, 860 Dakota
Avenue, be deferred until he presents himself
to answer questions. Motion, Ayes (7) - Nays (0)..
The chairman, noting there were many people
in audience, asked if they wished to be heard
on any matter. Mr. & Mrs. Frank Rheinhardt,
ktrr. & Mrs. Dick Oliver and Mr. & Mrs. Howard
White said they were there to protest the
proposed parking lot construction on the 60'
public access at Sandy Beach. Their complaint
was that there was an over -usage of the site
presently and this would only compound it.
It was explained to them this was no function
of the Planning Commission and the matter
would be heard by the Park.Commission.
Van Nest presented to all members policy
recommendations concerning subdividing land
containing privately owned common land, before
referred to as "outlots ". The policy and
rationale read as follows:
Policy: Each lot in future subdivisions shall
meet all requirements of the Zoning Code
concerning, but not limited to, minimum lost
size and width. Substandard lots in size and
width can only be plotted for purposes of
public dedication. Therefore, "outlots"
shall not be permitted in any future land
subdivision.
T.ati =scale: 1. "outlots" are not created for
single family dwellings and are not therefore,
presently a permitted -or conditional use in any
residential use district.
At any future time, the Planning Commission
.r Council may determine that "outlots" would
be desirable in a particular residential "use
district. At that time, "outlots" may be
added as a conditional use with such restrictions
and conditions as deemed proper by amending the
nonir_g Code.

3. If any building lot is sold to a private
corporation or association of homeowners for
%ommon use, the Village would still have
control over the following:
a. The issuance of building permits for any
use other than single family residential
uses.
b, The,issuance of a multiple dock license
required for mooring of more than four
boats on lakeshore lots.
c. If the need for common ownership ceases
to exist or Village policy dictates, the
lot can be sold for development as a
single family residential use.
4. By prohibiting the creation of lakeshore
"outlots ", the Village will make no implied
or express transfer of Riparian Rights to
Non - Riparian owners.
Curtis moved, Hake seconded, that recommendation
be given to this policy. Motion, Ayes (7) -
Nays (0) .
Curtis moved, Kullberg seconded, that the
'meting be adjourned at 9:30 P.M. Motion,
