Public Hearing before Plainrilin§ Commission, 7:30 P.M.
July 29, 1974
The Planning Commission met bn the above date
with the following members present: Chairman
pro tem Kullberg, Curtis, Gasch, Hake, Kallestad,
Pesdk, and Van Nest.- Elliott arrived at 8:15 P.M.
Absent: Chairman Guthrie. Also present: Council-
man Paurus, Engineer Willis Gilliard; representing
DiCon: Messrs. Dickey, Lynch, and Jarvis.
Mr. Lynch, representing DiCon, opened the meeting PUBLIC HEARING
showing a series of sketches indicating that DiCon - Farview
there were 57 acres in the subdivision along
with 750' of shoreline on Maxwell Bay. The
sketches showed lot and road configurations,
slope analysis, green area and a drainage
pattern, showing 100% drainage into Maxwell
Bay. Proposed is: 19 lots with a minimum of
two acres, one outlot on the lake proposed
for a recreation area and one 8h acre lot
encompassing the original estate residence.
Mr. Lynch then presented another drainage plan
whereby there would be a 16% diversion of
draiAwater to French Lake via a.culvert across
the proposed entrance to the property at County
oad #84 and along County Road #84 to French Lake.
It also reflected a storm drain to remove excess
water from the marsh near the Old Crystal Bay
Road access to the marsh near the lake. Another
sketch showed a new configuration of lots to
allow the road servicing the property to skirt
the marsh near Old Crystal Bay Road instead of
the original proposal to go through it.'
At this time, Chairman Kullberg opened the hearing
to the public. The following people spoke:
Mr. DeLessops asked hoar the 16% water deflected MR. DE LESSOPS
to French Lake would*get* there. Mr. Lynch
showed the drainage plan indicating the drainage
would go along County Road #84. Mr. DeLessops
stated that there already is a drainage problem
on his property caused by water coming down
County Road #84, and'felt another 16% drainwater
diverted from this property would increase the
problem.
The problem�on' their property is similar to NANCY KALLESTAD
Mr. DeLessops.

Kullberg queried the engineer as to how natural KULLBERG
retention would compare with developed retention.
Gilliard stated developed retention would be
less than natural.
Curtis asked whether the 501 proposed street CURTIS
would have 50' of hardcover and was assured it
would only be 241.
Since nobody else wished to be heard, the public
hearing was closed at 8:25 P.M. Members now
commenced discussion on the merits of the
proposed subdivision.
Van Nest stated that while this was the type VAN NEST
of development the City desired, there were
still areas of concern and felt number one
was the commons. He felt it should primarily
be used for swimming, picnicing with elimination
of dockage and no structures should be permitted.
Kullberg wondered if the Park Commission should KULLBERG
be brought in for evaluation of the subdivision.
Members felt since this would all be private
property, there was no need for this.
Curtis felt since there are 19 lots proposed, CURTIS
they should be each allowed a slip with no
on -land storage.
allestad opined that if 19 present commercial KALLESTAD
slips could be disallowed, he would be in favor
of 19 extra residential slips, but under present
,onditions, would not be in favor of them.
How the water retention capabilities of the GASCH
swamp was arrived at.

His firm has registered engineers, and while JARVIS
tot hydrologists, as the Hickok firm, they do
study water retention. The water retention of
a swamp is estimated by the area, slope, depth
and the estimated 100 year rainfall duration.
Gilliard at this time stated that was 6" in
24 hours. Mr. Jarvis continued that:
1. DiCon is willing to abide with any conditions
if the plat approval was given.
2. They are not asking for dock approval at this
time and would abide by any regulations
placed by regulatory agencies.
3. Merely wanted to be given treatment that
would be common to other subdivisions.
Discission was commenced on riparian rights.
Paurus cautioned members not to grant anything PAURUS
to the developer that would set a precedent for
future development in the matter of transfer of
riparian rights and that lots adjacent to the
outlot should have no more rights than somebody
at the far end of the subdivision.

- akeshore for each of the 17 lots if it were
equally divided.
Elliott opened discussion on the possibility ELLIOTT
of making the outlot public.
Van Nest moved, Hake seconded, to recommend
that the Council give preliminary approval
conditioned on the following conditions:
1. The lakeshore outlot common area be allowed
provided that it shall contain no boat launch-
ing, storage or dockage, nor shall it contain
any temporary or permanent structures and
ownership of membership shall be limited to
only the original 17 off -shore lots so that
any future additional subdivided lots would
be specifically excluded from ownership or
membership of the outlot.
2. Farview Avenue shall be rerouted so as to
avoid the low area located in the northwest
corner of the plat. The drainage from this
low area to the marsh along the lakeshore
shall be through natural drainage concourses
with proper storm water easements and designed
in such a way as to slow the runoff into the
marsh area.
3. All lots are to meet the minimum requirements
for the LR -lA district in all regards.

4. The maximum amount of drainage be diverted
to French Lake provided the City engineer
finds no detrimental effect will be caused
a to the people in this drainage area.
5. Cash dedication in lieu of land be made to
park fund. ,
At this time, it was decided to vote on each
condition separately.

Pesek and Kallestad moved to amend this to
read: "the engineer to make a study of all
drainage from the subject property and explore
the possibility of diverting some drainage into
French Lake without causing any undue problems
to neighboring properties in the process of
doing so.'
4. Recommend approval as amended. Motion,
Ayes ( 8) - Nays (0) .
5. Amended to read: 5% of the raw land value
to be dedicated to park fund in lieu of
land. Recommended approval. Motion,
Ayes ( 8) - Nays (0) .
Kullberg moved, Kallestad seconded, that the ADJOURNMENT
hearing be adjourned at 9:30 P.M. Motion,
Ayes (8) -Mays (0) .
